About this file
This is a Department of the Air Force Justification for Other Than Full and Open Competition (CUI) document supporting a sole source contract award.
The document approves a single award, firm-fixed price contract with Butler for Cypress Aircrew LLP to procure Cypress Aircrew LPP equipment, Part Number AAD2C2LPPL, in support of the 920th Operations Support Squadron for active para-rescue operations. The estimated contract value is $67,000 for 7 units (approximately $9,500 per unit). The contracting activity is FA2521 45 Contracting Squadron PKB under U.S. Space Command (USSPACECOM). The justification for sole source procurement is based on 10 U.S.C. § 3204(a)(1) and RFO 11.204(a)(2)(ii) (Brand Name authority). The required items are certified as Safe to Fly (STF) equipment by Air Force Special Operations Command (AFSOC) and are prescribed in an approved STF list for use on C-130 and C-17 aircraft. Alternative items, while potentially meeting technical specifications, cannot be used operationally without undergoing testing, certification, and incorporation into the AFSOC STF list—a scope beyond this acquisition. Butler is the only source of these mandatory STF-listed items and has no authorized resellers. The document notes that while other potential sources exist, none possess the required AFSOC certification and testing. The Contracting Officer is responsible for determining that the contract cost is fair and reasonable in accordance with applicable regulations.

I. Agency and Contracting Activity (RFO 6.104-1(a)(1)):
Agency: USSPACECOM Contracting Activity: FA2521 45 Contracting Squadron PKB
II. Nature and/or description of the action being approved (RFO 6.104-1(a)(2)):
This document approves the award of a single award contract action on a sole source basis to Butler for Cypress Aircrew LLP, Part number:AAD2C2LPPL in support of the 920th Operations Support Squadron for use in active para-rescue operations.
This justification is made on individual basis on the grounds of items being certified safe to fly (STF) for the C130 and C17 as prescribed by AFSOC.
III. Description of supplies/services required to meet agency needs (RFO 6.104-1(a)(3)):
Single award firm-fixed price contract for Cypress Aircrew LPP, Part Number: AAD2C2LPPL. Items are from a prescribed list to be compliant with the AFSOC STF Program. Use of differing items/products would require certification and publishing of a new approved STF item list. Estimated value of $67k for 7 units, roughly $9.5k per unit.
IV. Statutory Authority Permitting Other Than Full and Open Competition (RFO 6.104-1(a)(4)):
10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
RFO 11.204(a)(2)(ii) (Brand Name)
V. Rationale for Use of Authority (RFO 6.104-1(a)(5)):
The item provided by Butler are tested and certified by AFSOC and prescribed in guidance from the agency as certified Safe to Fly (STF) equipment. Items not on this list while technically meeting technical specifications, will not be allowed for use on the C130 and C17 by military personnel until they are potentially incorporated into the STF list. Testing, training and mitigation of potential safety issues for alternative items is not within the scope of this acquisition effort meaning that items can only be procured as provided in the AFSOC mandated STF list making this requirement a brand name. Butler does not have any authorized resellers making them the only source of these mandatory list items.
VI. Integrated Market Analysis and Efforts to Solicit Competition (RFO 6.104-1(a)(6), (8), and (10)):
Other potential sources for this requirement exist and were found in research but none had the completed certification and testing to be per scribed on the STF listing. Items not on the STF listing are not usable and would not serve to be placed into active service even if technical specifications are met. Testing, Mitigation, and Incorporation of new items would only be reasonable in a larger acquisition for a potential refresh of the entire inventory of parachutes for AFSOC on the respective airframes.
Determination of Fair and Reasonable Cost (RFO 6.104-1(a)(7)):
The Contracting Officer is responsible for evaluating, determining, and documenting the anticipated contract cost/price is fair and reasonable in accordance with RFO Subpart 15.4, Contract Pricing.
