Subj: SOLE SOURCE MEMORANDUM TO PURCHASE PACSTAR 444 SWITCH AND 447 ROUTER (PURCHASE REQUEST 1300856689)

Identification of the agency and the contracting activity and specific identification of the document as a “Limited Source Justification.”

This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department Code 02).

Nature and/or description of the action being approved.

This action will award a firm fixed price purchase order for ruggedized switches and routers to Pacific Star Communications, Inc. (hereafter Pacstar) , 15055 SW Sequoia Pkwy, Ste 100, Portland, OR 97224 (Cage Code 1RZG3)

A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The purchase is to acquire the following:

Item DescriptionPart NumberQuantity
PacStar 444 SwitchPS444-02-NA2 units PacStar 444 Service PlanSSP-PS444-02-NA-122 units PacStar 447 RouterPS447-NA250-012 units PacStar 447 Service PlanSSP-PS447-NA250-01-12 2 Units

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00. Delivery of the items will be 60 days after award of the order.

Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR6.302-1.

The Naval Surface Warfare Center Panama City Division (NSWC PCD) A Division, Code A33, Relay System Project has a design that utilizes the PacStar 444 switch and PacStar 447 router in our program of record system. This purchase is not suitable for full and open competition for the following reasons. No other equipment can be substituted for these units according to the system design requirements. Engineering integration and drawings have already been produced that specify these exact products. Pacstar is the original equipment manufacturer (OEM) of the items and they are not available from any other source.

A determination by the ordering activity contracting officer that the order represents the best value consistent with 13.106)(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

This requirement will be synopsized on the Beta.SAM.gov website per FAR 5.2. Market research was conducted as part of the design phase of the relay system. Other embedded switches and routers were compared with the PacStar 444 and 447 and the PacStar devices were determined to have the best combination of performance, longevity, and total ownership cost.

Any other facts supporting the justification.

None

A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

The selection of the switch and router will be reevaluated by NSWC PCD when the next obsolescence baseline is designed.
