SOLE SOURCE JUSTIFICATION

for SIMPLIFIED ACQUISITIONS OVER $3,000 AND UP TO $150,000

Date: 17 March 2015 PR Number: M30004-15-SU-00357

1. Nature and/or description of the item/service being procured and its intended use

(include the anticipated cost):

This requirement is an interim solution for contractor provided and maintained National Fire

Protection Association (NFPA) 70E protective clothing for Facility Maintenance Division

(FMD) personnel. Additionally, contractor support will include providing bins for storage of soiled protective clothing in between scheduled pick-ups and lockers for storage of laundered protective clothing.

The critical performance requirements contractor services must adhere to are prescribed in

OSHA 29 CFR 1910.132. In particular, NFPA 70E protective clothing must be laundered to maintain a reliable and sanitary condition as prescribed by law. Assurance must be made that

FMD personnel experience no periods where they do not have protective clothing readily available. Accordingly, contractor must have the capability to: 1) provide a sufficient supply

NFPA 70E protective clothing; 2) provide laundering and maintenance of NFPA 70E protective clothing on a weekly basis, sufficient to ensure no periods of clothing non-availability; 3) provide soil and holding bins or lockers to store protective clothing before and after use.

According to service providers operating under the applicable NAICS code, these critical performance requirements are not outside of standard industry terms and conditions.

The anticipated cost for six (6) months of service is $40,000.00.

2. Sole Source Justification rationale (Check one and explain below):

______ Only one responsible source.

__X___Urgent and compelling circumstances exist.

______ Other

Explain:

Contract M00264-14-P-0210 expired on 3 March 2015. Upon expiration, the requiring activity procured an additional two (2) weeks of service while the RCO – NCR established a competitive solicitation for one (1), six (6) month base, and one (1), six (6) month option. Market research indicated that at least two (2) small business concerns were interested and capable of fulfilling the task requirements of the Performance Work Statement (PWS). As a result, the requirement was set-aside 100% for small business. What was not captured in the market research was the costs prospective contractors must incur to establish an inventory of the necessary number of

NFPA 70E PPE clothing. After issuance of the solicitation, one of the interested small businesses used to establish the set-aside contacted the RCO – NCR and stated they would not submit a quote for the requirement as it was written. The contractor stated that they would not be able to

Sole Source Justification for Simplified Acquisitions Over $3,000 and Up To $150,000 Template recover the PPE procurement costs under a 12-month contract. This sentiment was echoed by the other small business concern used to establish the set-aside.

Based on this information, the RCO – NCR determined it is in the best interest of the

Government to cancel the solicitation and develop a longer term contract solution of 60-months.

Given this change course, however, the Government is now pressed to ensure no lapse in mandatory required services occurs. NFPA 70E clothing is required by 29 CFR 1910.132. Any lapse in service would render the Government not in compliance with the statutory requirements set forth in the aforementioned statute.

3. Market Survey. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest:

Thorough market research was conducted for the original solicitation and indicates possibilities exist for small business participation through set-asides. The longer-term contract solution will likely be set-aside for small business as originally intended.

4. If this is a determination for sole source, the Contracting Officer certifies:

a. Only one source is available, or urgent and compelling circumstances exist.

b. The anticipated price will be determined fair and reasonable using standard price analysis techniques described in FAR Part 13 and NAVSUPINST 4200.85D.
