Sole Source Justification Summary

This is a Sole Source Justification document under FAR 13.5 Simplified Procedures for Certain Commercial Items submitted by the Department of Veterans Affairs, Regional Procurement Office-East, Network Contracting Office 4 for the Lebanon VA Medical Center in Lebanon, Pennsylvania. The procurement is for preventative maintenance inspections and repairs on CareFusion Pyxis automated medication dispensing equipment. The Lebanon facility operates 29 standardized Pyxis BD CareFusion medication dispensing systems that are critical to hospital operations, storing medications, syringes, IV fluids, and controlled substances while tracking usage and maintaining proper temperature control for temperature-sensitive medications. Equipment failure would result in complete work stoppage of patient care, risk loss of medication supplies, compromise controlled substance accountability, and potentially expose patients to improper dosing.

CareFusion Solutions, LLC, located at 3750 Torrey View Court, San Diego, California 92130, is identified as the sole source vendor. As the exclusive manufacturer and provider of Pyxis products and services, CareFusion is the only company capable of providing maintenance and software support; third-party maintenance would void warranties and manufacturer support. The previous order 36C24420P0933 with CareFusion Solutions, LLC expired on 29 September 2024, necessitating a follow-on contract. Market research was conducted with an Intent to Sole Source posted to SAM.gov, resulting in only one commercial price offer response, with another respondent failing to provide required capability statements. The procurement is structured as a Firm Fixed Price order with price analysis to be conducted comparing proposed prices against previously determined reasonable prices. The justification certifies the requirement as a bona fide need of the Department of Veterans Affairs.

DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL ITEMS IN

ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID:

2237:

Contracting Activity:

Department of Veterans Affairs, Regional Procurement Office-East (RPO-E), Network Contracting Office 4 (NCO4) provides contracting support for DVA, Veterans Integrate Services Network, (VISN 4), 595 - Lebanon VA Medical Center, 1700 South Lincoln Ave, Lebanon PA 17042.

Nature and/or Description of the Action Being Processed:

This service is for Preventative Maintenance inspections to be performed on CareFusion Pyxis automated medication dispensing equipment at Lebanon VA Medical Center in accordance with FAR

13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. The usage of a Firm Fixed Price (FFP) type order is appropriate for this procurement action.

The previous order 36C24420P0933 with Carefusion Solutions, LLC expired on 29 September 2024 and the Lebanon VAMC requires a follow-on contract directly with the OEM, Carefusion, for continued support.

3. :

The Lebanon VA Medical Center (LVAMC) has a requirement for a full-service contract for preventive maintenance inspections and repairs to be performed on CareFusion Pyxis automated medication dispensing equipment, as listed in the SOW. This equipment is needed to store medications and/or supplies within the Lebanon facility. This equipment also provides the ability to efficiently track usage of medical supplies throughout the entire hospital: ensuring accurate counts, dosing, storage and on time stocking of supplies.

The Lebanon VA Medical Center has standardized all 29 medication dispensing systems with the Pyxis BD Care fusion brand. The servers are already in use and tailored to the VA network. Should a lapse in service occur or if a Pyxis machine would malfunction and not be repaired, it would result in a total work stoppage of patient care. A hardware failure causes the carts to be inoperable which means all medications cannot be dispensed. These medication dispensing systems are not limited to patient medications but also include, syringes, and IV fluids which would not be retrievable. The Pyxis machines also maintain proper cooling of specified medication, and if the refrigeration should fail, entire supplies can be lost at great expense to the Government. Controlled substances would be at risk and even untraceable; thus, this would overall greatly impact patient care. In addition to the patient care impact, there would be a compliance issue if narcotics cannot be properly tracked.

Outdated or improperly serviced and maintained equipment can put patients at risk of improper dosing.

5.

the Use of the Authority Cited Above (applicability of authority):

The suggested vendor is CareFusion Solutions, LLC, 3750 Torrey View Court, San Diego, California 92130.

CareFusion Solutions, Inc., is a wholly owned subsidiary of BD, is the exclusive manufacturer and provider of Pyxis products and services and the sole company capable of performing maintenance and software support. Any maintenance to the product or its software performed by a third-party vendor, other than their Field Service Technician Affiliates, would render null and void any existing warranty and be unsupported by CareFusion Solutions, LLC.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

The determination to sole source for the BD Pyxis arose when technical experts in the Biomedical Engineering department stated they do not have the resources or skill set to provide preventative maintenance or repair services without the assistance of a third-party. When speaking with end-users and technical points of contact, it was a clear determination that only the manufacturer was able to provide services in an efficient manner to avoid down-time and delay patient care.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

Price analysis will be conducted using comparison of proposed prices with prices found reasonable on previous purchases. A determination will be made by the Contracting Officer that the anticipated cost(s) to the Government is fair and reasonable.
