DEPARTMENT OF THE ARMY
JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Agency:
Department of the Army Albuquerque District, Corps of Engineers 4101 Jefferson Plaza, NE Albuquerque, NM 87109-3435
2. Description of the Action being Approved:
It is necessary to award a new sole-source, firm-fixed price contract for Law Enforcement Services. O&M funds will be used to fund the contract. Award shall be made to the local authorities authorized to provide Law Enforcement Services within Sandoval County.
3. Description of the Supplies/Services Required to Meet the Agency's Needs:
The Contractor is required to provide all labor, supplies, equipment, and other essential requirements to perform law enforcement patrols. The objectives of this requirement are to provide a welcoming and safe recreational environment for visitors, contractors, and employees; to ensure that the US Army Corps of Engineers (USACE) has law enforcement agents to enforce all laws and regulations to the maximum extent warranted by law and to properly address criminal activity. The objectives will be accomplished by maintaining visible presence through patrol activity, by notifying Corps personnel of incidents, and reporting on activities. The period of performance for the base and three option years is approximately 50 days each year. The estimated total dollar value (including options) of this procurement is $70,000.00.
4. Statutory Authority Cited:
In accordance with 10 U.S.C. 2304(c)(1), FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Reason for Authority Cited:
The Sandoval County Sheriff’s Department is the only responsible entity authorized to provide law enforcement services within Sandoval County.
6. Effort to Obtain Competition:
Unable to obtain competition because the Sandoval County Sheriff’s Department is the only entity willing and authorized to provide law enforcement services within Sandoval County.
7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable:
The Sandoval County Sheriff’s Department has provided law enforcement services to USACE on previous acquisitions and has been found to be fair and reasonable as compared to law enforcement services provided to USACE by other local authorities throughout New Mexico. Therefore, a determination of a fair and reasonable price will be based on FAR 13.106-3(ii) Comparison of the proposed price with prices found reasonable on previous purchase and FAR 13.106-3(vi) Comparison to an independent Government estimate.
8. A Description of the Market Research Conducted and Results:
Since law enforcement is a governmental activity and requires authority with a local jurisdiction, there are no other entities that are capable and able to satisfy agency needs.
9. Other Facts:

10. A listing of sources, if any that expressed, in writing, an interest in the acquisition:
None
11. A Statement of the actions, if any, the agency may take to remove or overcome any barriers to completion before and subsequent acquisition for the supplies or services required:
If entities other than the local authorities are given authority and jurisdiction to provide law enforcement services within Sandoval County, then those entities will be solicited for future acquisitions.
