Sole Source Justification Summary

This is a Sole Source Justification (SSJ) document for a firm fixed price task order issued by the Department of Homeland Security, U.S. Secret Service (USSS), Office of Procurement. The USSS intends to award a sole source task order to LDV, Inc. (UEI: MXMZKAUNUSG3, located at 180 Industrial Drive, Burlington, WI 53105-2307) for the purchase and build-out of three mobile command units (MCUs). The contract is awarded under GSA Multiple Award Schedule, Transportation and Logistics Services - Motor Vehicles (non-Combat) category, SIN 3361V, GSA contract #47QMCA21D000F. The total estimated dollar amount is $3,544,675.00 with a firm fixed price arrangement and no optional periods. Delivery is required no later than 150 calendar days from the date of award.

The justification for the sole source award is based on FAR 8.4, GSAM/R 538.7104-3(b)(iii), citing that the order should be issued on a sole source basis as a logical follow-on to an FSS order already issued on a competitive basis. A previous acquisition of these same units was competed among small businesses under GSA RFQ #1748667/USSS RFQ 70US0925Q70092225, with LDV, Inc. selected as the awardee under Delivery Order #70US0925F2GSA2160. The MCUs will support interagency coordination, communication, and command and control during USSS protective operations for major pre-planned events and crisis responses. The urgency stems from increased operational tempo, upcoming National Special Security Events (NSSE) beginning June 2026, and complex critical incidents requiring these management tools. LDV, Inc. currently possesses in-stock shell vehicles that meet USSS requirements and can customize them to meet specification standards. The SSJ was signed by Contracting Officer YUKIM on December 17, 2025, and approved by Level Above Contracting Officer CDGARCIA and Procuring Activity Advocate for Competition EVPAGAL on December 18-19, 2025.

Sole Source Justification

1. Agency and Contracting Activity.

The Department of Homeland Security, U.S. Secret Service (USSS), Office of Procurement (PRO), proposes to award a task order on behalf of Technical Security Division, pursuant to FAR 8.4, GSAM/R 538.7104-3(b) (FAR Class Deviation 25-20) and HSAM 3008.401-71.

2. Nature and/or description of the action being approved.

USSS intends to award a firm fixed price sole source task order for Mobile Command Units (MCU) to the following contractor:

Contractor: LDV, INC.

Unique Entity Identifier (UEI): MXMZKAUNUSG3 Contractor Address: 180 Industrial Drive, Burlington, WI 53105-2307 GSA Multiple Award Schedule Category: Transportation and Logistics Services - Motor Vehicles (non-Combat)

SIN: 3361V

GSA contract# 47QMCA21D000F

Delivery will be no later than 150 calendar days from the date of award.

Total estimated dollar amount is $3,544,675.00. No optional periods proposed.

3. Description of Supplies/Services.

The United States Secret Service requires the purchase and build out of three (3) vehicles to become mobile command units used to support interagency coordination, communication, and command and control during USSS protective operations.

4. Statutory Exception/ Authority and Supporting Rationale.

This acquisition is conducted under the authority of Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

Pursuant to FAR 8.4, GSAM/R 538.7104-3(b) (FAR Class Deviation 25-20). the circumstance that justifies limiting sources to fewer than those required by FAR 8.4, GSAM/R 538. 7103 (FAR Class Deviation 25-20) is:

D FAR 8.4, GSAM/R 538.7104-3(b)(i) (FAR Class Deviation 25-20) The need is of such unusual urgency that following the procedures would result in unacceptable delays in fulfilling that need.

SSJ No: FY26-15 Page 1 of3

11.7.2025 v.2.0

D FAR 8.4, GSAM/R 538.7104-3(b)(ii) (FAR Class Deviation 25-20) Only one source is capable of providing the products, services, or solution required at the level of quality required because the products, services, or solutions are unique or highly specialized.

IZI FAR 8.4, GSAM/R 538.7104-3(b){iii) (FAR Class Deviation 25-20) The order should be issued on a sole source basis in the interest of economy and efficiency because it is a logical follow-on to an FSS order already issued on a competitive basis.

□ FAR 8.4, GSAM/R 538.7104-3(b)(iv) (FAR Class Deviation 25-20) It is necessary to place the order with a particular FSS contractor to satisfy a minimum guarantee established in the FSS

BPA.

D FAR 8.4, GSAM/R 538.7104-3(b)(v) (FAR Class Deviation 25-20) A law expressly authorizes or requires that the purchase be made from a specified source.

Rationale (see GSAM/R 538.7104-3{b)(l)):

These MCUs will be utilized during major pre-planned events and crisis responses and are essential to enhancing security and interoperability of protective sites and areas protected by 18 U.S.C. § 1752. There is an urgency to increase, upgrade or replace existing MCU platforms due to the increased operational tempo, upcoming National Special Security Events (NSSE), and the risk of complex critical incidents that require management tools such as these. A previous acquisition of these same units was competed amongst Small Businesses on the Transportation and Logistics Services - Motor Vehicles (non-Combat) GSA Multiple Award Schedule category under GSA RFQ # 1748667 / USSS RFQ 70US0925Q70092225. LDV, Inc. was the awardee to this solicitation under Delivery Order# 70US0925F2GSA2160. As such, a logical follow-on is appropriate to invoke under these circumstances. LDV, Inc is currently in possession of in-stock shell vehicles that meet USSS's basic requirements and are able to upgrade and customize vehicles to meet requirement standards. With NSSEs beginning June 2026, USSS needs to rapidly acquire the same units from LDV, Inc.

5. Contracting Officer Certification

Pursuant to HSAM 3008.401-7l(b)(l), I certify that the Sole Source Justification is accurate and complete to the best of my knowledge and belief.
