FDO/ MICC Control No.

SOLE SOURCE JUSTIFICATION

(Simplified Acquisition Procedures under FAR Part 13 Not Exceeding $250K)

1. Agency/Contracting Activity: Mission Installation Contracting Command- Ft. Riley

(MICC-RLY)

2. Description of Action:

Nature: New Requirement Follow-On Requirement Mod to Existing Purchase Order/Contract Number

Pricing: Firm-Fixed Price Time and Materials

Funds: OMA Other Funds:_________

3. Description of Supplies/Services:

a. The total estimated dollar value of the proposed action is $11,309.16

b. Request upgrade of existing (critical) software in support of the access control system located at the Office of the Staff Judge Advocate (OSJA), 216 Custer Ave, Fort Riley, Kansas. The software upgrade is vital to the overall security of the building, soldiers, civilians, and customers. Without the upgrade, there is high risk that the system will not function and the interruption or lack of operation will severely jeopardize the safety, security, and mission of the OSJA, to include, areas declared as sensitive that contain sensitive information. This contract will be awarded based on an approved sole source justification due to restrictions of the proprietary information and software used by the vendor. It is important to maintain the same Contractor that provided previous equipment for compatibility and warranty/maintenance purposes. To change to a new provider would require all new equipment which would be too costly to the Government. It is in the best interest of the Government to approve this requirement to have continuity of services, save funds and mitigate mission failure. Johnson Control is the only authorized vendor in this district that can provide maintenance, repair, or parts for the (C*CURE) system currently in place at the OSJA. Note that this is a software upgrade ONLY. The current C*Cure system is not on the network.

4. Authority:

Action using Simplified Acquisition Procedures

FAR 13.106-1(b) (1): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g.

urgency, exclusive licensing agreements, brand name, or industrial mobilization.)

5. Reason for Authority Cited:

(a) Services can only be provided from the original source as this is a follow-on requirement for the continued provision of highly specialized services.

(b) Award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.

(c) Services/Supplies are needed immediately to satisfy mission requirements.

6. Actions to Increase Competition:

It is important to maintain the same Contractor that provided previous equipment for compatibility and warranty/maintenance purpose. To change to a new provider would require all new equipment and net-worthiness certificates which would be too costly to the Government. It is in the best interest of the Government to approve this requirement to ensure the safety of the

OSJA.

7. Market Research:

Market research determined that the delivery of similar equipment is available through GSA Advantage. SimplexGrinnell is a GSA schedule holder. However, the service needed for the current system is not available from any other vendor. It is important to maintain the same Contractor that provided previous equipment for compatibility and warranty/maintenance purpose.

8. Procurement History:

Previous Purchase Orders(s) or Contract(s): Yes No

Purchase order or contract number: W911RX-15-F-0067 Was action competed? Yes No If action was not competed, state the cited authority, summarize rationale: 10 USC 2304(c)(1) or 41 USC 253 (c )(1); FAR 6.302-1: Only one responsible source and no other supplies or services will satisfy agency requirements.

9. Additional information to support the justification: This contract will be awarded based on an approved sole source justification due to restrictions of the proprietary information and software utilized by the vendor. Establishment of the importance of utilizing the same Contractor due to the equipment compatibility and warranty/maintenance purpose.

10. Technical/Requirements Certification: I certify that the supporting data under my cognizance which is included in the abbreviated J&A is accurate and complete to the best of my knowledge and belief.
