About this file
This document is a justification for using other than full and open competition to award a sole source contract for trash collection services. The US Embassy in Kampala, Uganda requires trash collection from its offices and residences in various areas around the city. Kampala Capital City Authority has contracted with Homeklin Uganda Limited as the sole authorized vendor for waste collection in those zones. As such, the Embassy must use Homeklin in accordance with local regulations. Homeklin has provided satisfactory service to the Embassy under the previous contract over the last five years. Therefore, the justification recommends awarding a new sole source contract to Homeklin for an estimated $355,000 to continue necessary trash collection from Embassy properties in Kampala.

SENSITIVE BUT UNCLASSIFIED
JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. I recommend that US Embassy Kampala use other than full and open competition for the acquisition of Trash collection Services for Residences, Chancery and GSO
Warehouse in areas of Nsambya, Makindye, Muyenga, Kisugu, Kololo, Bugolobi, Mbuya and Naguru with Homeklin Uganda Limited.
The estimated cost is $355,000.
2. Nature and/or description of the action being approved Trash Collection from Office and residences
3. A description of the supplies or services required to meet the agency's needs
(including the estimated value).
Kampala Capital City Authority (KCCA) contracted firms to collect trash and garbage in different zones of the city. Because of this contract the US Embassy Kampala is required to work with the approved trash/garbage collector with solid waste/trash disposal regulations for the Authority.
4. An identification of the statutory authority permitting other than full and open competition.
41 U.S.C. 253 (c) (1) Only one responsible source and no other services will satisfy agency requirements.
5 A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).
• Homeklin Uganda Limited is the Vendor authorized by KCCA to provide solid waste/trash collection services in areas where the US Embassy Kampala has offices and residences.
• Homeklin Uganda has been offering trash collection services for the US Embassy office and residences for a period of five years and has rendered quality services without major complaints.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a CBD notice was or will be publicized, as required by FAR 5.2, and if not, which exception under
FAR 5.202 applies (e.g., blanket waiver provided in 95 State 152197).
SENSITIVE BUT UNCLASSIFIED
No solicitation was done because Homeklin Uganda Limited is the Vendor authorized by
KCCA to provide solid waste/trash collection services in areas where the US Embassy has offices and residences.
7. A determination by the Contracting Officer that the anticipated cost to the
Government will be fair and reasonable.
While solicitation was not completed due to Uganda Government regulations and policies, the
US Embassy negotiated reduced prices as per previous contract and rates deemed fair and reasonable.
8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.
A market survey was not required since we are limited to only specific contractors within the city limits; the only area of concern and the same vendors are providing similar services to the neighboring occupants under similar terms with exception of the 30-day credit requirement for the US Government contracts.
9. Any other facts supporting the use of other than full and open competition.
Homeklin has been proving services in the previous contract satisfactorily even during the difficult period of the COVID 19 pandemic.
10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition.
N/A
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
N/A
