SOLE SOURCE JUSTIFICATION
For purchases made under ACQUISITION REGULATION PART 12, ACQUISITION OF COMMERCIAL ITEMS AND PART 13, SIMPLIFIED ACQUISITION PROCEDURES Name and Location of the organization making the purchase:

Describe supplies and/or services being procured:
•Transmetric's Traffic server 8 database and web portal is software that integrates the analytic approaches recommended by the American Association of State Highway Transportation Officials (AASHTO) and recreational quality assurance/quality control of recreational traffic data into a single package, providing a program which generates traffic related statistics, monthly and annual reporting and will display traffic data on the internet.

“(b) Soliciting from a single source:
(1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency*, exclusive licensing agreements, brand name or industrial mobilization). “
· Transmetric's Traffic server 8 database Package has all the elements that were identified as a need by end users as well as a comprehensive traffic monitoring process. The software is currently the only software commercially available that offers the required quality assurance/quality control capabilities required for the project. The software is currently one of the approved software packages within FHWA and has already gone through the Investment Review Board process.
