About this file
This document is a Sole Source Justification for a Purchase Order under FAR Part 13. The requirement is to provide 18 hotel rooms, catered lunches, and dinner meals in support of the Tradewinds 25 Initial Planning Conference in Trinidad and Tobago from November 3-9, 2024. The total estimated value is unknown.
The justification cites FAR 13.106-1(b)(1) as the authority, indicating only one source is reasonably available. Market research determined that the Hyatt Regency in Port of Spain is the only hotel that meets the requirements, has the necessary Food and Water Risk Assessment conducted by SOUTHCOM, and is registered in SAM.gov. No other local hotels were able to complete SAM.gov registration in time. The anticipated costs are determined to be fair and reasonable.

4. Authority Cited: FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reason for Authority Cited: There is only one provider that can deliver the necessary services at the required quality level due to the uniqueness and specialization of the supplies or services and is SAM.gov registered. Market research indicated that Hyatt Regency – Port of Spain, which has a current Food and Water Risk Assessment (FWRA) conducted by SOUTHCOM, in addition to host the Initial Planning Conference participants, is able to supply the 18 hotel rooms, in addition to the 18 contracted lunch meals and the dinner meal at the hotel restaurant while maintaining rates that align with the Meals and Incidental Expense rates set by the U.S. GSA.

6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to an exception at 5.202 (13) The proposed contract action- (i) Is for an amount not expected to exceed the simplified acquisition threshold;
(ii) Will be made through a means that provides access to the notice of proposed contract action through the GPE; and
(iii) Permits the public to respond to the solicitation electronically;
7. Efforts to Obtain Competition: Several hotels approved by the Embassy, which were evaluated to possess a SOUTHCOM approved FWRA, received the necessary requirements for this initiative. However, only the Hyatt Regency has an active SAM.gov registration, the necessary services to meet requirements and the availability during the period of performance.
8. Actions to Increase Competition: Multiple attempts were made to register other local hotels in SAM.gov, however, none were able to complete the registration within the sufficient time to consider for contract award.
9. Market Research: Based on the requirement taking place Outside Continental United States (OCONUS), this requirement will not be set-aside for small business since small business goals do not apply OCONUS IAW FAR 19.000(b). Market Research illustrates the service falls within the commercial items definition as it is a service customarily used by the public and has been sold, leased, or licensed to the general public. Other agencies are not applicable to fulfill the requirement since they are not able to meet the room requirements or provide the required lunch and dinner meals to the conference participants. Market research revealed that no other existing hotels could provide all the requirements needed in support of the contract requirement.
