DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action I D: 36C247-24-AP-2319

1. Contracting Activity: Department of Veterans Affairs, VISN 07, Tuscaloosa, AL VAMC Medical Center

Acq Plan ID: 36C247-24-AP-2319, B1 FLooring

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Replace flooring due to major flooding incident that impacted 4 floors in Building 1. We anticipate this estimated repair to cost $50,000.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

VAAR 806.302-570(b) states, "Sole source awards below the simplified acquisition threshold. (Citation: 41 U.S.C.

3304(a)(5), as authorized by 38 U.S.C. 8127(b)). A contracting officer [CO] may award a contract under the authority in this paragraph (b) to a VIP verified SDVOSB first, then VOSB if no SDVOSBs can fulfill the need, for an amount less than the simplified acquisition threshold, using procedures other than full and open competition.(38 U.S.C. 8127)". Additionally, due to occupational safety and welfare of patients and staff alike these items are of an urgent nature. The service line would like to execute the service as quickly as possible install appropriate flooring into above referenced spaces. The CO's authority to sole source this requirement under 806.302-570(b) will allow for a more efficient acquisition, thus reducing administrative costs and more swiftly addressing the potentially dangerous issues on site. The proposed contract will be awarded to a contractor, Zegler LLC, a Service Disabled Veteran Owned Small Business (SDVOSB) who is familiar with the location and has successfully completed similar work at a fair and reasonable price on the same location (see #4 below).

4. Description of market research conducted and results or statement why it was not conducted:

Market research revealed numerous SDVOSB firms capable of completing the requirement. A recently completed project was awarded (see contract 36C24723P1275) at the same Tuscaloosa facility, with a similar Independent Government Estimate (IGE) amount, and which was for floor replacement. The IGE for this project was created with updated sq. ft. pricing and labor costing.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b) and VAAR 806.302-570(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
