The Government has determined that the proposed pricing is fair and reasonable. NSWCCD has no plans to compete future contracts for these supplies/services, but will assess feasibility if another potential source emerges.
The related federal contract opportunity is a Special Notice for the procurement of the Model N40 Neutron Irradiator, to be awarded on a sole source basis to HDI under FAR 6.302-1(a)(2)(ii). Interested parties may submit capability statements by 5/31/24, but this is not a request for competitive proposals. The Government will consider responses solely to determine if a competitive procurement is feasible.

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Carderock Division (NSWCCD), Contracting & Acquisitions Department (Code 02).
2. Description of the Action Being Approved This is a sole source action to be awarded without providing for full and open competition. Award of a firm fixed price contract on a sole source basis for the acquisition of a Model N40 Neutron Irradiator and the integration with the Model G10 Gamma Irradiator and installation services in support of NAVSEA 09RD RADIAC Program to Hopewell Designs, Incorporated (HDI). Authority to act under this CJ&A expires 30 May 2025.
This justification document is in accordance with FAR 13.501 (a).
3. Description of Supplies/Services The Model N40 Neutron Irradiator, exclusively manufactured by HDI, provides a panoramic radiation field ideal for testing and calibrating radiation detection instruments and dosimetry equipment. This capability is currently lacking at NSWCCD’s, Code 631 radiation range (Building 157). NSWCCD is planning to acquire a Model G10 Gamma Irradiator that can be integrated with the Model N40 Neutron Irradiator system. The period of performance will start at time of award and include 1 option year for the required delivery, installation and calibration of the Model N40 Irradiator no later than 30 September 2025.
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. §2304(c)(1), “The property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency.” (FAR 13.106-1(b)(2))
5. Rationale Justifying Use of Cited Statutory Authority NSWCCD Code 631 currently operates three automated open-air irradiators – models GC60, BC30 and X80 -- manufactured by HDI. These three irradiators are all tied to the same safety system, which includes Emergency Off (EMO) buttons, door interlocks, irradiator switches and audible/visual alarms. The HDI Model G10 Series gamma beam irradiators and N40 Series neutron irradiators are systems designed to calibrate hand-held portable radiation survey instruments and dosimetry.
The G10 and N40 Series irradiators are registered with the U.S. Nuclear Regulatory Commission, and each has been assigned a registration certificate: NR-1138-D-101-S and NR-1138-D-106-S, respectively. Both the G10 and N40 Irradiators will be integrated to the current safety system and will be sharing the linear positioning system. Only HDI can integrate the G10 and N40 to the current safety system. A single linear positioning system will be shared and integrated for both the G10 and N40 irradiator systems. No other irradiator manufacturer or service provider is authorized to make changes to HDI irradiator systems or integrate other irradiator systems with the G10 and N40 Series irradiators.
6. Description of Efforts Made to Solicit Offers from as Many Sources as Practicable Code 631 conducted market research and identified that there are only two companies which can provide open air irradiator systems for calibrating and testing radiation detectors or dosimetry equipment. The two original equipment manufacturers are JL Shepherd, Inc. (JLS) and HDI. This was confirmed via the market research performed through attendance to RADIAC Industry Day at NSWCCD on June 14,2023, attendance to the Health Physics Society (HPS) Annual Meeting from July 23 to 27, 2023 and reviewing HDI’s product catalogs and commercial website. In addition, per the Navy’s Radiological Affairs Support Office (RASO), only HDI can perform the services of integrating the Model N40 Neutron Irradiator to the Radiation Range’s established safety system. All of the irradiators operating at NSWCCD’s radiation range are operating under the OEM’s (HDI) safety system. JLS is not allowed per Navy Regulations and the local Radiation Safety Office to change/modify or add irradiators to the current safety system. HDI maintains all the irradiators that are currently in operation at the radiation range. They have the expertise to integrate the G10 and N40 irradiators to the installed safety system.
Pursuant to FAR 13.501 (a) (iii), the Government will make this justification available on the Government Point of Entry (SAM.gov).
7. Determination of Fair and Reasonable Costs In accordance with FAR 13.106-3, the Procuring Contracting Officier (PCO) shall ensure that all services provided under the anticipated contract are procured at a fair and reasonable price. The contractor will submit a formal price offerwith sufficient information to support the accuracy and reliability of the estimate. The PCO shall determine that the proposed offer represents the best value (as defined in FAR 2.101) to meet the Government’s needs.
8. Actions to Remove Barriers to Competition For the reasons set forth in Paragraph 5, NSWCCD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWCCD will assess whether competition for future requirements is feasible.
