6. Authority:
FAR 13.106-1(b)(1)(i) - - For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name, or industrial mobilization).
7. Reason(s) for Authority Cited:
This procurement is for the renewal of licenses for maintenance services and coverage of a single server. The services are also for managing the West Point Health Service Area (WPHSA) internal homepage platform. This is considered a sole source to SQBox Solutions because – based on market research and to the best of MICC West Point’s knowledge – their on-line maintenance licenses are proprietary. SQBox Solutions owns the trademark for the server that West Point uses for their intranet platform. As such, SQBox Solutions does not allow nor train third-parties to access or service their trademarked equipment. Furthermore, allowing non-authorized third parties to access or service the intranet would void the warranty that is on the equipment (server). The server and digital platform are currently covered under another maintenance license contract for the past 3 years. The following contract was processed as a prior sole-source purchase in accordance with FAR 13.106-1(b)(1):
W911SD20P0001
(Base + 2 Option Yrs. = $9,270.00)
The award was found to be fair and reasonable because the overall total of $9,270.00 (3 years at $3,090.00 / year) is under the Federal Government’s micro-purchase threshold for supplies. The vendor’s current offer of $10,731.00 for another 3 years ($3,577.00 / year) is also well below the micro-purchase threshold for supplies (when purchased per year). The difference is a slight increase of $487.00 per year for West Point compared to the normal yearly increase rate for other customers at $584.40 per year. The end result is a yearly 20% discount for West Point, making this requirement a bargain to purchase and well within the best interest of the Federal Government.
8. Actions to Increase Competition:
An Intent to Sole Source / Sources Sought Notice was posted on Sam.gov from 08/19/22 thru 08/22/22 (Notice# W911SD22R8712). No responses were received except from the original suggested source.
9. Market Research:
Extensive market research was performed by searching the internet for viable sellers of this particular item.
Market Research was also performed by reviewing previous files with the same or similar requirements to check for other potential sources as well as speaking with the end-user. However, no other sources were found except for the original suggested source (see Section 8 above).
10. Procurement History:
Previous Purchase Order(s) or Contract(s): Yes No
If "Yes", provide:
Purchase order or contract number: W911SD20P0001
Was action competed? Yes No
-3-
If action was not competed, state the cited authority and summarize rationale:
FAR 13.106-1(b)(1)(i) - - “Only one responsible source” is based on the company being the sole developer and provider of the product / service and is therefore the only source capable of satisfying the Government’s requirement.
11. Fair and Reasonable Price Determination:
Determination will be made by reviewing compared costs of prior purchases, similar subscriptions, public price list, offered discounts, knowledge of industry standards, or sales to other customers (see Section 7 above).
12. A Statement of Action(s) to remove or overcome barriers to competition in the future:
The Federal Government will continue to solicit businesses until it finds one that meets our requirements -or-has the ability to adjust its product(s) / service(s) to meet our requirements without the conflicts, issues, or adjustment restrictions as described in Section 7 above.
13. Contracting Officer’s Approval:
I hereby certify that this justification is accurate and complete to the best of my knowledge and belief.
