About this file

This is a Justification for Single Source Award issued by the Department of Veterans Affairs for an emergency construction project. The contract will be administered by Network Contracting Office 7 on behalf of VISN 7, Birmingham, AL VA Medical Center, with Purchase Request number 521-26-2-5125-0033 and Acquisition Plan Action ID 36C247-26-AP-2134.

The project involves replacing the main line oxygen piping system at the Birmingham VA Medical Center to restore the integrity of the medical oxygen distribution network that serves the entire patient care facility. The estimated contract value is approximately $82,000. The sole source award will be made to MGI INC, a specialized construction contractor already on-site for a separate medical gas project. MGI INC possesses all required certifications, technical expertise specific to this work, and facility knowledge necessary to address the problem. The VA justifies the single source award under three authorities: RFO 6.103-2 (Unusual and Compelling Urgency), RFO 6.103-5 (Authorized by Statute), and VAAR 819.7008 (Sole source awards to verified Service Disabled Veteran Owned Small Businesses), as MGI INC holds SDVOSB certification. Market research identified numerous qualified vendors in the United States and Alabama under NAICS 238220, but the urgent nature of the requirement and MGI INC's ability to mobilize quickly with existing facility knowledge precluded competitive solicitation. No public announcement was made pursuant to RFO 5.101(b)(2) exemption. The VA notes that future non-emergent construction projects will pursue full and open competition.

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards

Acquisition Plan Action ID: 36C247-26-AP-2134

1. Contracting Activity

Administration of the proposed contract will be completed by Network contracting Office (NCO) 7 on behalf of the Department of Veterans Affairs, VISN 7, Birmingham, AL VA Medical Center. The Purchase Request number is 521-26-2-5125-0033.

2. Brief Description of Supplies/ Services required and the intended use/Estimated

Amount.

The project, Replace Main Line Oxygen Piping (Emergency), will restore the integrity of the medical oxygen system. This system supplies medical oxygen to the hospital's entire patient care network. Without these repairs, the hospital is at risk of a loss of life should the main oxygen line become compromised. The estimated cost to the Government for this emergency project is approximately $82,000.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used.

This emergency order will use a specialized construction contractor, MGI. INC, who is already on-site for a separate medical gas project. MGI INC. has all required certifications and knowledge of the problem to include the understanding of the environment in which the problem exists. Given the urgency of repairs needed, the expertise of MGI INC in regard to the type of work needed, and the availability of MGI INC to speedily complete these repairs, the Government justifies the use of MGI INC. for a sole source contract through use of RFO 6.103-2, Unusual and Compelling urgency.

MGI INC is also a certified Service Disabled Veteran Owned Small Business (SDVOSB).

In addition to RFO 6.103-2, the VA justifies this proposed sole source to MGI INC. by using RFO 6.103-5, Authorized by statute, and VAAR 819.7008, Sole source awards to verified service-diasbled veteran-owned small businesses. No further justification is needed.

Note: No announcement was made for this requirement given the exemption at RFO 5.101(b)(2). Also, future requirements of a non-emergent nature may allow for full and open competition, and it is the Government’s intent to remove barriers to competition for future construction-related projects.

4. Description of market research conducted and results or statement why it was not conducted.

Market research was conducted and found numerous vendors in the United States and Alabama, SDVOSBs included, who were potentially capable of completing the required work under NAICS 238220. However, it is highly unlikely that any of these firms would have the ability to mobilize for work as quickly as MGI INC, and it is unlikely that the firms would also have the expertise and knowledge of the facility that MGI INC has.

Additionally, due to the urgent nature of this requirement, the VA is incapable of reaching out to other potentially qualified firms to compete the requirement.

5. Contracting Officer's Certification

A record of the negotiations and the Contracting Officer’s (CO’s) conclusion that the price is fair and reasonable will be kept in the contract files. I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
