About this file

This is a Use of a Single Source Below the Simplified Acquisition Threshold (SAT) document for the United States Air Force, specifically the Air Force Sustainment Center (AFSC/PZA). The document details the remanufacture of an E-3 Electro-Mechanical Actuator (NSN: 4810-01-649-2702RK, PN: EM488-1) with an estimated contract cost of $621,650.70. Electromech Technologies LLC (CAGE: 54395), the Original Equipment Manufacturer (OEM), is the sole source due to the complexity of the item and possession of critical technical data and support equipment. Market research was conducted using various databases, and a source sought synopsis was posted on SAM.gov from 21 March to 04 April 2023, with no vendors expressing interest. The contract will be an Indefinite Delivery/Indefinite Quantity (IDIQ) with a minimum of 3 and maximum of 11 units, and the government has attempted to obtain data rights from the OEM, which were declined. The contracting officer has determined, in accordance with FAR 13.106-1(b)(1), that only a single source is reasonably available.

Section C: Rationale for Soliciting from a Single Source or Brand Name

The complexity and criticality of this item requires that the source of remanufacture be an approved source possessing the data, experience, skills, and equipment necessary to restore this item to a like-new condition. Electromech Technologies LLC, Commercial and Government Entity (CAGE) code 54395, is the Original Equipment Manufacturer (OEM) and is the only known source possessing the necessary technical data and support equipment required to remanufacture this Electro-Mechanical Actuator. The Government currently does not possess the complete technical data rights of all the required data. The Government has established Qualification Requirements (QRs) for this item.

Perspective sources must meet these requirements prior to being identified as an approved source. This item requires engineering source approval in order to maintain the item's quality and technical baseline. It is not possible to draft adequate specifications for the remanufacture for a competitive solicitation. Electromech Technologies LLC, the OEM, is the only source that has met the defined QRs at this time, and thus has been listed as the only approved source.

Section D: Efforts to Obtain Competition

Market Research was conducted using standard contract repair screening processes. Additionally, market research techniques including Internet websites and databases (including Google.com, Thomas Register, Haystack, FedBizOpps, DSBS, SAM, and FPDS) were queried for potential sources. Other sources manufacture similar items but none have show interest in submitting a Source Approval Request (SAR). As of 24 Jan 2024 no SAR packages have been submitted to the Tinker Small Business Office.

Known approved sources have been annotated on the current CRSAW and are as follows:

Electromech Technologies LLC CAGE: 54395

A source sought synopsis (SSS) was posted on SAM.gov 21 March 2023 and closed 04 April 2023 and was opened for 14 days. No vendors indicated interested in the acquisition.

On 30 Jan 2024, the 423rd SCMS reached out in email to OEM and sole owner of data rights, Electromech Technologies LLC CAGE 54395, requesting the OEM to either provide or sell the data rights to the United States Air Force. On 31 Jan 2024 Electromech Technologies LLC CAGE 54395 declined the request.

Government defined pre-award qualification requirements of potential sources have been identified and apply to this item. Although potential sources will be required to obtain the necessary data independently or otherwise provide proof demonstrating capability via the SAR process. All SAR package submissions submitted prior to contract award will be evaluated in accordance with established processes to ensure the highest level of competition possible. To this date, no SAR packages have submitted.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

Every effort will be continually made in the future to solicit additional sources for the remanufacture of the E-3 Electro- Mechanical Actuator. OC-ALC Engineering continues to utilize resources and manpower to remove barriers that prevent full and open competition.

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
