About this file

This is a Sole Source Justification document for a Non-Emergent Medical Transportation (NEMT) services contract awarded under FAR 13.5 simplified acquisition procedures. The Department of Veterans Affairs, Veterans Integrated Service Networks (VISN) 22, Network Contracting Office 22, on behalf of San Diego Veterans Affairs Healthcare System (SDVAHCS) is procuring NEMT services to transport eligible veteran beneficiaries 24 hours a day, seven days a week, including holidays. The contract is firm-fixed-price with a total award value of $837,784.00 and a performance period of March 7, 2026 through July 6, 2026.

The justification for sole source award to One Life Transportation, LLC, is based on unusual and compelling urgency. A competitive solicitation (Solicitation #36C26224Q1523) previously resulted in Contract #36C26226D0044, but a protest of that award decision prevents performance on the new contract pending protest resolution. This short-term emergency bridge contract is necessary to ensure continuity of mission-critical NEMT services required by statute under 38 USC 111A. The incumbent contractor can mobilize immediately without onboarding delays that would interrupt veteran transportation services. Prior market research confirmed adequate Service-Disabled Veteran-Owned Business (SDVOSB) competition exists for these services. The contracting officer determined price reasonableness by comparing the proposed price against previous purchases, the recently competed solicitation, and an independent government estimate. Future long-term procurement is expected to be competitively solicited following resolution of the current protest.

Effective Date: 12/30/2025 Page 1 of 3 Revision: 02 Acquisition ID#: 36C262-26-AP-3714

DEPARTMENT OF VETERANS AFFAIRS

SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR

CERTAIN COMMERCIAL ITEMS IN ACCORDANCE WITH FAR 13.5

Acquisition Plan Action ID: 36C262-26-AP-3714 Contract Award Number: 36C26226P0583

1. Contracting Activity: Department of Veterans Affairs, Veterans Integrated Service

Networks (VISN) 22, Network Contracting Office (NCO) 22, on behalf of San Diego Veterans Affairs Healthcare System (SDVAHCS) Medical Center, located at 3350 La Jolla Village Dr. San Diego, CA, 92161. Purchase Request (PR): 664-26-2-186-0123.

2. Nature and/or Description of the Action Being Processed: SDVAHCS has an urgent requirement for a contractor to provide Non-Emergent Medical Transportation (NEMT) Services to eligible veteran beneficiaries twenty-four (24) hours a day, seven (7) days a week, to include holidays. This requirement is for a new, short-term, firm-fixed-price emergency bridge contract.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: Non-Emergent Medical Transportation services are required by statute under 38 USC 111A. Contract# 36C26226D0044 was competitively awarded for these services on 02/13/2026, however, a protest was filed challenging the award decision. This short-term bridge contract is needed to ensure continuity of services for 4 months pending the outcome of the protest. The period of performance is 03/07/2026 – 07/06/2026. The total award value is $837,784.00.

4. Statutory Authority Permitting Restricted Competition: FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106- 1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

(x) Unusual and Compelling Urgency

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the

Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Contract# 36C26226D0044 was competitively awarded for these services on 02/13/2026, however, a protest was filed challenging the award decision, preventing performance on the new contract pending the outcome of the protest. NEMT services are required by statute under 38 USC 111A, and this short-term bridge contract is necessary to ensure uninterrupted transportation services for eligible veterans requiring specialized medical care during transport. One Life Transportation, LLC, is a known incumbent that can mobilize immediately, without delay or onboarding, which would result in service interruption.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Due to the urgent nature of this requirement, soliciting competition is not practicable. In accordance with FAR 5.202(a)(2), the proposed action will not be synopsized. These services were previously solicited under Solicitation#

36C26224Q1523 and competitively awarded under Contract# 36C26226D0044, however, due to a protest of the award decision, a short-term, emergency bridge contract is needed to ensure continuity of these mission critical services that are required by statute.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The CO determined price reasonableness by comparing the proposed price with prices found reasonable on previous purchases, the recently competed solicitation, and the independent government estimate (IGE).

8. Description of the Market Research Conducted and the Results, or a Statement of the

Reasons Market Research Was Not Conducted: Market research was recently conducted for a new base plus four option year contract for these services. The market research included a sources sought notice, verifying Certified Veteran firms through the Dynamic Small Business Search (DSBS) site at https://search.certifications.sba.gov, reviewing similar contracts at different Department of Veterans Affairs locations, reviewing SAM.gov, as well as contacting knowledgeable individuals in Government and industry regarding market capabilities to meet the requirements. The market research revealed that there is adequate SDVOSB competition for these services; a competitive solicitation was subsequently issued under Solicitation# 36C26224Q1523. Due to the urgent nature of this requirement, additional market research was not conducted.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: These services are mission critical, required by statute, and SDVAHCS does not have the operational capacity to independently provide them. Due to the urgent nature of this requirement, and due to the protest, there isn’t enough time to competitively solicit this short-term bridge contract.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: One Life Transportation, LLC.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: These services are typically competitively solicited as a base plus four option year contract. A long-term contract is expected to be finalized following the outcome of the protest.

12. Requirements Certification: I certify that the requirement outlined in this justification is a

Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
