About this file

This is a Sole Source Justification document for the U.S. Section of the International Boundary and Water Commission (USIBWC) seeking additional rehabilitation work on the Belt Filter Press (BFP) system at the South Bay International Wastewater Treatment Plant (SBIWTP). The modification is valued at $8,582,540.88 and will be awarded to Veolia Water West Operating Services, Inc. under the existing Contract No. 191BWC24C0006, using FAR 6.302-1 authority for sole source procurement.

The proposed work includes replacement of motors, pumps, piping, electrical components, SCADA integration, and other critical infrastructure to ensure safe and continuous facility operation. Veolia is justified as the sole source contractor due to being currently on-site, fully mobilized, and technically integrated with the ongoing rehabilitation effort. Awarding to another contractor would result in significant delays, increased coordination and safety risks, and potential duplication of effort. The document notes that future acquisitions will be planned to allow for competitive procurement, and a technical analysis memorandum dated July 8, 2025, confirms Veolia's pricing is fair and reasonable.

SOLE SOURCE JUSTIFICATION

Contract Title: SBIWTP Belt Filter Press Rehabilitation Contract Number: 191BWC24C0006 Proposed Contractor: Veolia Water West Operating Services, Inc.

Estimated Value of Modification: $8,582,540.88 Authority: FAR 6.302-1 – Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

1. Description of Supplies or Services Required

The U.S. Section of the International Boundary and Water Commission (USIBWC) requires additional rehabilitation and replacement work on the Belt Filter Press (BFP) system at the South Bay International Wastewater Treatment Plant (SBIWTP). This includes replacement of motors, pumps, piping, electrical components, SCADA integration, and other critical infrastructure to ensure safe and continuous operation of the facility.

This work is in addition to the original scope awarded under Contract No. 191BWC24C0006 and is necessary to address components that were removed from the original award to remain within funding constraints.

2. Rationale for Sole Source

This justification is made under the authority of FAR 6.302-1(b)(1)(i), which permits contracting without full and open competition when there is only one responsible source, and no other supplies or services will satisfy agency requirements.

Veolia is the only responsible source capable of performing the required work without unacceptable delays or duplication of cost. Veolia is currently performing work under the existing contract and is fully mobilized on-site. The additional work is technically and logistically integrated with the ongoing rehabilitation effort.

Awarding this work to another contractor would:

• Require demobilization of Veolia and remobilization of a new contractor, resulting in significant delays.

• Introduce coordination and safety risks due to overlapping scopes and shared systems.

• Result in duplication of effort, including rework of already installed components and re-integration of SCADA systems.

Given the emergency nature of the project and the operational risks to the SBIWTP, continuity of effort is essential.

3. Market Research

Market research was not conducted for this modification because the work is a continuation of services already being performed by Veolia under the existing contract. The technical analysis memorandum dated July 8, 2025, confirms that Veolia’s pricing is fair and reasonable based on industry standards and current market conditions.

4. Actions to Increase Competition in the Future

Future acquisitions for similar work will be planned with full scope and funding alignment to allow for competitive procurement. This sole source action is limited to the current operational need and does not preclude competition for future requirements.
