JUSTIFICATION FOR SOLE SOURCE PROCUREMENT (OPEN
MARKET OR GSA) UNDER $250,000
Sole source acquisitions may be used on a limited basis and only when the Contracting Officer’s Representative (COR)/Program Official has provided sufficient justification and the Contracting Officer has determined that the circumstances warrant such action. The content for a justification must contain detailed facts and rationale to justify the sole source acquisition. Soliciting from a single source must be done in accordance with FAR 13.106-1(b) or 8.405-6. At a minimum, the following information must be included:

Rev. 5/15/17
D. Justification:
1. The justification for this non-competitive action is:
☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”
☐ Urgency ☒ Exclusive licensing agreements/Proprietary data ☐ Brand name required ☐ Industrial mobilization ☒ Other (e.g., compatibility, space issues, continuity, compatibility, etc.)
The National Council for Prescribing Drug Program (NCPDP) HCIdea data is crucial for filling the research gaps in the Applied Research and Evaluation and Integration Team as well as potentially being used for clinical guideline dissemination efforts.
HCIdea includes prescriber data that accurately identifies healthcare providers who can write prescriptions. HCIdea prescriber data goes beyond physician listings for medical doctors and doctors of osteopathic medicine; it also includes naturopaths, dentists, nurse practitioners, physician assistants, optometrists, podiatrists and others authorized to prescribe. HCIdea contains accurate data on more than 2 million prescribers for these data variables: address with multiple practice locations, prescriber identifiers (NPI and UPIN), prescriber DEA, MAT wavier status, multiple state license numbers & renewal dates, birth date, gender, telephone, taxonomy, and specialty.
☐ In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”
☐ Urgency ☐ Only One Source ☐ Logical Follow Up ☐ Brand name required
2. Other facts supporting sole source procurement:
a. What can this product/service do that other products/services cannot do?
The NCPDP’s HCIdea data provides the most recent and most accurate information on prescribers in the U.S. by leveraging more than 2,000 different data sources. It will allow us to link all the prescriber information such as demographics, specialty, Rev. 5/15/17 location, and DATA waiver status to our opioid and benzodiazepines prescribing data. It will allow us to study dentists, nurse practitioners, and physician assistants in addition to MDs. HCIdea also contains Type I (individual) and Type II* (practicing locations) prescribers which will allow us to study clustering of prescribers as well as affiliation of nurse practitioners and physician assistants.
b. What other products/services were considered and why did they not meet the need?
Our specific need: we need a data source that contains as much information as possible on all prescribers in the U.S. Information we need includes prescriber demographics, prescriber specialties, prescriber identifiers (NPI & UPIN), prescriber DEA number, prescriber DATA waiver status (prescribing medicine for treating opioid use disorder), prescriber location, etc.
We considered AMA Physician Masterfile and IQVIA Prescriber Profile Data. AMA Physician Masterfile does not meet the need because: 1) it does not include dentists, nurse practitioners, and physician assistants who are one major type of prescribers we try to study; 2) it does not include all demographic characteristics; 3) it does not include DEA number and prescriber DATA waiver status. IQVIA Prescriber Profile does not meet the need because: 1) it does not include all demographic characteristics; 2) it does not include prescriber DATA waiver status; 3) it has limited prescriber identifier information; 4) its prescriber specialty information is not complete.
3. Program Office efforts to seek potential offerors:
The program assessed the availability of other data sources (see write up under #2b) and determined that the National Council for Prescription Drug Programs HCIDea data set is most compatible with programs research needs.
