JUSTIFICATION FOR SOLE SOURCE PROCUREMENT (OPEN
MARKET OR GSA) UNDER $250,000
Sole source acquisitions may be used on a limited basis and only when the Contracting Officer’s Representative (COR)/Program Official has provided sufficient justification and the Contracting Officer has determined that the circumstances warrant such action. The content for a justification must contain detailed facts and rationale to justify the sole source acquisition. Soliciting from a single source must be done in accordance with FAR 13.106-1(b) or 8.405-6. At a minimum, the following information must be included:
Identification of Program Office, Contracting Activity, and Proposed Requirement, Justification and Program Office Certification:
A. Program Office:
Centers for Disease Control and Prevention
DDNID/NCIP/DOP/HSRB
4770 Buford Highway Atlanta, GA 30341 Chamblee Campus, Bldg., 106, 8th Floor
B. Contracting Activity:
Centers for Disease Control and Prevention Office of Financial Resources Acquisition Branch Assistance Branch 4 Atlanta, GA 30341
C. Identification of Requirement:
1. Nature of Action to be Approved by Contracting Officer: Optum Labs Data Access
a. Sole source acquisition of:
Insurance claims data and electronic medical record (EMR) data at Optum Labs. Optum Labs is an open, collaborative research and innovation center founded in 2013 as a partnership between Optum and Mayo Clinic with its core linked data assets in the OptumLabs Data Warehouse (OLDW). The database contains de-identified, longitudinal health information on enrollees and patients, representing a diverse mixture of ages, ethnicities and geographical regions across the United States. The claims data in OLDW includes medical and pharmacy claims, laboratory results and enrollment records for commercial and Medicare Advantage enrollees. The EMR-derived data includes a subset of EMR data that has been normalized and standardized into a single database.
b. Procurement Request (PR) Number (if available): 0HCUHGC3-2020-45076
2. Proposed Vendor and Estimated Procurement Amount (if available):
a. Proposed Vendor: OPTUM Labs One Main Street, 10th Floor Cambridge, MA 02142 POC: Alia Rawji, PMP Alia.Rawji@optum.com
(617) 475-2479 mailto:Alia.Rawji@optum.com
Rev. 5/15/17
b. Estimated Procurement Amount: $ Is the requirement on GSA Schedule? ☐ Yes ☒ No
D. Justification:
1. The justification for this non-competitive action is: (NOTE: Must select only ONE of the listed justifications for other than full and open competition and fully support the justification in the following paragraphs. Please delete this note prior to submitting the justification.)
☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”
☐ Urgency ☒ Exclusive licensing agreements/Proprietary data ☐ Brand name required ☐ Industrial mobilization ☒ Other (e.g., compatibility, space issues, continuity, compatibility, etc.)
Optum Labs data is the only data that Division of Overdose Prevention (DOP) can use for the proposed project for following reasons:
• Optum Labs data is the only large proprietary claims data that has a time lag smaller than 6 months.
• Optum Labs data is the only large proprietary claims data that covers both commercially insured and Medicare population which is essential for the proposed project.
• Optum Labs data is the only large proprietary claims data that offers linkable electronic medical records (EMR) data for part of its insured population and allows users to link EMR to insurance claims data. This linkage is essential for analysts at DOP to study objectives of this project.
• Optum Labs allows users to access all data products through a secure and user-friendly virtual environment. This full access to the data is crucial for analysts at DOP to study research objectives of this project.
☐ In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”
☐ Urgency
☐ Only One Source ☐ Logical Follow Up ☐ Brand name required
2. Other facts supporting sole source procurement:
a. What can this product/service do that other products/services cannot do?
In addition to the justifications listed above, one other need from DOP that other similar data products cannot meet is the continuity and compatibility that Optum Labs data offers. DOP used Optum Labs data in 2019 to study the first objective of this project. This one-year data access was given to DOP as a gift from Robert Wood Johnson Foundation. In order to finish other objectives of this project that are designed as extensions to the first objective, DOP needs access to Optum Labs data.
Access to the same data is essential for DOP to keep continuity of the project and maintain compatibility of results across study objectives
b. What other products/services were considered and why did they not meet the need?
DOP considered other similar claims data product, for instance the IBM MarketScan Database. MarketScan Database cannot meet this project’s specific needs due to the following reasons: 1) MarketScan Database available to CDC has about 13-14 months of time lag; 2) MarketScan Database does not provide geographic identifier, for instance, region or state; 3) MarketScan Database does not provide prescriber ID and provider specialty; 4) MarketScan Database does not provide EMR data that allows DOP analysts to conduct patient level linkage with insurance claims data; 5) MarketScan Database does not provide the continuity and compatibility that DOP needs across study objectives of this project.
3. Program Office efforts to seek potential offerors:
Other data sources that the program considered but determined not meeting needs of the project’s objectives: 1) IBM MarketScan Database. This data does not meet project needs because of its longer time lag and its lack of complete provider ID and specialty in the data. In addition, MarketScan Database does not provide access to the actual EMR data. Instead, it only allows inquires of their EMR data which does not meet our needs. 2) CMS Chronic Data Warehouse Claims Database. This data does not meet project needs because it does not have commercially insured population which is required by this project. In addition, it does not have EMR data that could be linked to claims. 3) Health Care Cost Institute Claims Database. This data does not meet project needs because of its longer time lag (2 years). In addition, it does not provide EMR data that can be linked to its claims data.
