I. Agency and Contracting Activity.

The 386th Expeditionary Communications Squadron (ECS) is the customer and the 386 the Expeditionary Contracting Squadron (ECONS) is the procuring activity.

II. Nature and/or description of the action being approved.

Sole Source Request for Base-wide ISDN E-1 PRI Telephone Services.

III. Description of supplies/services required to meet agency needs (including the estimated value).

The services required are for E-1 Commercial Phone Service Operation and Maintenance to include local and international telecommunication capabilities, specifically the addition of international dialing.

IV. Statutory authority permitting other than full and open competition.

6.302-1 – 10 USC 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

V. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires use of the authority cited above (applicability of authority).

The current infrastructure in-place is tailored specifically for Qualitynet, the existing telecommunications company.

Additionally, Qualitynet has already acquired permission from the appropriate local telecommunications authorities to reserve the current 300 phone number dedicated series of 442-XXXX. Contract award to any other source would require the incumbent contractor to receive permission from the local telecommunication authorities for the reservation of a brand new 300 phone number dedicated series as well as configuration of new infrastructure. Therefore, this service is determined to be available from only one source; as award to any other vendor would cause an unacceptable delay or substantial injury to the Government's communication capabilities.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under

FAR 5.202 applies.

On 7 October 2020, A sources sought was sent to various local vendors to verify whether this service could be fulfilled by other sources. All interested vendors were required to provide capability statements and past performance relevant to this acquisition, if applicable. On 15 October 2020, the only contractor who expressed interest in writing was the current contractor, Qualitynet.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Government has procured similar services throughout the Area of Responsibility (AOR) in the past.

FA5702-19-F-0001, and FA5703-19-C-0005 are the most recent ISDN Telephone service contracts. There are various factor variances (such as inflation, the amount of channels purchased, local and international calling capabilities) between the aforementioned acquisitions can be attributed to requirement specificity, but both are for IDSN services. Due to the similarities between these acquisitions, price comparison of these previous acquisitions will be used to determine the price fairness and reasonableness of this this acquisition.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

On 18 Oct 2020, a search of BetaSAM.gov was conducted to reference other contracts that have been executed though out the Department of Defense (DOD). Through this search, it was discovered that the Defense Information Systems

Agency (DISA) provides Enterprise Acquisition Services (EAS) for purchasing telecommunications and IT products and services from the worldwide commercial sector to meet DoD and authorized non-defense mission partner needs. On 7 October 2020, a sources sought was sent to various local vendors to verify whether this service could be fulfilled by other local sources. All interested vendors were required to provide capability statements and past performance relevant to this acquisition, if applicable. Resultantly, the only contractor who expressed interest in writing was the current contractor, Qualitynet. Based on market research no other vendor is capable of providing ISDN E-1 Phone Services without the possibility of degradation or possible outage of the Government's communication capabilities, therefore this project must be a solicited on a sole source basis to Qualitynet.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

Contract Award to a new service provider would require permission from the local telecommunication authorities for the reservation of a brand new 300 phone number dedicated series as well as configuration of new infrastructure without a lapse in service. If solicited on a full and open basis, each interested party would have to construct an implementation plan demonstrating how they would provide these services without hindering the Government's communication capabilities to even be considered for award. This would prevent the base from mission failure while also satisfying competition requirements.

X. List of any sources that expressed, in writing, an interest in the acquisition.

The only contractor who expressed interest in writing was the current contractor, Qualitynet.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

386 ECONS will continue probe the local market for opportunities to satisfy this requirement when possible.

XII. Certification by the Contracting Officer.

As evidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.

XIII. Certification by the technical/requirements personnel.

As evidenced by my (our) signature(s) above, I (we) certify that any supporting data contained herein, which is my (our) responsibility, is both accurate and complete.
