Section B: Description of the Supplies/Services Required

Tyndall AFB has an uncompleted paint booth that needs cleaning due to debris (salt, water, and, sand) incurred from the effects of Hurricane Micheal (10 October 2018). In addition, components will need to be field tested after cleaning to ensure that the system is in a pre-storm condition.

Section C: Justification for Soliciting from a Single Source or Brand Name

On 15 September 2015, Tyndall AFB awarded a Task order to Industria Paschen Group JV (IPJV) to install and commission a paint booth. The final progress report received before Hurricane Micheal (1 October 2018 - 7 October 2018) established a 98.4 completion percentage. Prior to the aftermath of the storm, IPJV was testing the machine for final inspection. During the test electrical components caused damage to the paint booth. On 10 October 2018 Hurricane Micheal devastated Tyndall AFB. As a result of the storm, IPJV claimed that damage in the form of debris was preventing the paint booth from being fully operable.

The government's intent is to sole source the cleaning and testing of this system to verify that the paint booth has reverted to pre-storm condition. It is crucial that IPJV carries out this requirement to prevent any future blame and litigation. Limiting competition to IPJV will ensure security and mitigate risk to the maximum extent practicable.

Section D: Efforts to Obtain Competition

Obtaining competition was bypassed for this requirement in an effort to mitigate future risks incurred on the contractor. It is reasonably predictable that competing this requirement would lead to IPJV placing blame on any potential awardee.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

Future acquisitions will conduct market research to attempt to establish purchases that do not preclude certain vendors from being able to provide any type of requirement. This is a unique circumstance and is a one-time buy for the cleaning and testing of a paint booth related to one particular vendor (IPJV).

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
