About this file

This is a Justification and Approval (J&A) document for Other Than Full and Open Competition issued by the Department of Veterans Affairs, Veterans Health Administration (VHA) Program Contracting Activity Central (PCAC).

The document authorizes a sole-source, Firm-Fixed-Price contract award to Above Group Inc., a verified Service-Disabled Veteran-Owned Small Business (SDVOSB) located in Melbourne, Florida, to provide an independent third-party fire protection and life safety code review for project #589-021 (Construct Warehouse Addition and Reduce Warehouse Footprint Minor design) at the Kansas City VA Medical Center. The contract requires qualified Fire Protection Engineers to conduct the review in compliance with VHA Directive 7712. The estimated contract value is $7,439.69 with a performance period of 21 calendar days from Notice of Award, with an anticipated award date of mid-March 2026. The statutory authority for this sole-source award is 38 U.S.C. §8127(c), the Veterans First Contracting Program, implemented under VAAR clause 819.7007 for service-disabled veteran-owned small businesses. Market research identified 83 verified SDVOSBs under NAICS 541330 in Missouri as potential sources. The J&A was posted to GPE within 14 days after award in accordance with FAR Subpart 5.301, and the contracting officer determined the anticipated cost to be fair and reasonable based on comparison with Above Group Inc.'s current PCAC A-E MATOC rates and historical pricing for similar services at the Kansas City VAMC.

This justification is in support of a new, single award, Firm-Fixed-Price (FFP) contract for an Architectural-Engineering (A-E) firm to provide an independent third-party fire protection and life safety code review for project # 589-021 Construct Warehouse Addition and Reduce Warehouse Footprint Minor design at the Kansas City VA Medical Center (VAMC). This intendent review is required by Veteran Health Administration (VHA) Directive 7712 Fire Protection Code Reviews of Delegated Construction Projects. The review must be performed by qualified Fire Protection Engineers (FPEs) who meet the qualifications and experience requirements outlined in Section IV, Qualifications. The contractor shall provide all personnel, equipment, supplies, facilities, tools, materials, supervision, and other items necessary to meet the requirements. The period of performance is 21 calendar days from Notice of Award.

The base award amount was $1,085,015. However, the design portion of the SOW did not include an independent third-party fire protection and life safety code review.

The anticipated award date for this new requirement is mid-March 2026. The estimated cost of the independent third-party fire protection and life safety code review is $7,439.69.

This requirement is for Architect-Engineering related services associated with an independent third-party fire protection and life safety code review. Above Group Inc. has extensive experience performing the required services for this procurement.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed possible (including whether a notice was or will be publicized as required by RFO Part 5 and, if not, which exception under RFO Rul 5 applies):

An SBA Small Business Search query indicated there are 83 verified SDVOSBs under NAICS 541330 within the state of Missouri, that could potentially submit on this project. Due to the low dollar value of this procurement, a notice of intent so sole source was not required to be posted on SAM.gov.

This Justification and Approval (J&A) document will be posted within 14 days after award in accordance with FAR Subpart 6.301. The award synopsis will be posted to GPE in accordance with FAR Subpart 5.301.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

The market price for the fire protection engineer will be compared with the rates from Above Group Inc.’s current PCAC A-E MATOC as well as a comparison of past pricing for fire protection services at the Kansas City VAMC. The contracting officer will make fair and reasonable determination prior to award.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

Market research techniques used to identify potential sources for this requirement include an SBA Small Business Search query of the state of Missouri and a review of the PCAC A-E MATOC holders. A sole source award to Above Group Inc. is in the government’s best interest to successfully complete the independent third-party fire protection and life safety code review.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

N/A

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

There is interest amongst the PCAC A-E MATOC holders in this project.
