About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the rental of a boat slip to support the Federal Bureau of Investigation's (FBI) Underwater Search and Evidence Response Team (USERT) in Miami, Florida.
The FBI requires the rental of a secure boat slip that can accommodate a 34-foot boat, provide shore power, fresh water connection, 24-hour video monitoring, and direct access to the Atlantic Ocean. The sole-source vendor identified is Harbour Towne SMI OPCO, LLC, which has provided these services to the Miami USERT for the past 11 years. The anticipated value of the 1-year contract, including options, is $31,680. The J&A cites the unique location and capabilities of the vendor as the justification for the sole-source award. A market survey was conducted, but no other vendors were found that could meet the FBI's requirements. The FBI will continue to review the market annually to identify potential competition for future requirements.

2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
The Underwater Search and Evidence Response Team (USERT), Miami Division, requires the rental of a secure boat slip that allows for the storage of a 34 foot boat in the Dania Beach, FL area.

3. A description of the supplies or services required to meet the agency’s needs.
The requirement for a boat slip includes: have a depth of four feet or greater during low tide;
provide shore power (electricity) that can be connected to the boats electrical system; provide a fresh water connection; be secure and have controlled entry to the boat slips; have a fuel station on location; have a boat ramp on location for deploying Miami USERTs Rigid Hull Inflatable Boat. The location must offer 24 hour video monitoring. The vendor shall be signed up in SAM.GOV, 52 miles or less on google maps from 505 S. Flagler Drive, West Palm Beach, FL 33401, less then 28 miles from 2030 SW 145 Ave. Miramar, FL 33027, and less then 111 miles from 505 S. 2nd St. Fort Pierce, FL 34950.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
The Miami USERT requires the rental of a boat slip in the Dania, FL area which is located close to the Miami office. Miami USERT has utilized Harbour Towne SMI OPCO, LLC. for the past 11 years because they offer water depth of four feet or greater during low tide, have shore power (electricity) that can be connected to the boat’s electrical system, have a fresh water connection, have secure and controlled entry to the boat slips with 24 hour video monitoring, have a fuel station on location and a boat ramp on location for deploying other Miami vessels.
Locating the boat in the Dania, FL area will continue to allow the boat to be ready to deploy in a timely manner. The marina must be able to accommodate a 34 foot boat and must have immediate access to the Atlantic Ocean without having to go under any bridges. With the mast up on the boat, it will not clear bridges, and, in certain areas around Florida, the USERT would be forced to wait for draw bridges to be raised. This would greatly impede response times. In addition, moving the boat further south would cause issues due to heavy traffic conditions during certain times of the day.Additionally, Harbour Towne SMI OPCO, LLC. meets the requirements below.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
USERT performed a market survey on the internet and in person in the Dania, FL area to identify vendors that could meet the requirements of the USERT
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated cost of this requirement is $31,680.00.
8. A description of the market research conducted and the results.
USERT performed a market survey on the internet and in person in the Dania, FL area to identify vendors that could meet the requirements of the USERT. Here are the results:
1) Harbour Towne Marina is where the Miami USERT’s 34 foot boat is currently kept. This marina meets all of the technical requirements.
2) Royal Palm Marina. Does not currently have any slips available.
3) Cozy Cove Marina. Does not currently have any slips available.
9. Any other facts supporting the use of other than full and open competition.
The Miami USERT requires the rental of a boat slip 52 miles or less on google maps from 505 S.
Flagler Drive, West Palm Beach, FL 33401, less then 28 miles from 2030 SW 145 Ave.
Miramar, FL 33027, and less then 111 miles from 505 S. 2nd St. Fort Pierce, FL 34950.
. Locating the boat in the Dania, FL area will allow the boat to be ready to deploy in evidence recovery missions in a timely manner. The marina must be able to accommodate a 34 foot boat and must have easy access to the Atlantic Ocean without having to go under any bridges. With the mast up on the boat, it will not clear bridges, and, in certain areas around Florida, the USERT would be forced to wait for draw bridges to be raised. This would greatly impede response times. Towing a boat of this size is possible but not easy in heavily congested areas. Keeping the boat in a wet slip at a marina the Dania, FL area allows the boat to be ready to deploy at any time. In addition, moving the boat further south would cause issues due to heavy traffic conditions during certain times of the day.
