About this file

This is a Justification Review Document for a Firm Fixed Price (FFP) contract under FAR Part 13 simplified procedures for commercial items. The Joint Interagency Task Force-South (JIATFS) seeks to procure ESPY HF/DF Monopole Antenna Array, team SENTINEL HF/DF Sensor, maintenance, and partial installation services from ESPY Corporation (CAGE: 1MZ72, located at 13033 Trautwein Rd, Austin TX 78737-9364) on a sole-source basis. The contract period runs from March 29, 2026 through March 28, 2031, with a base year (March 29, 2026 through March 28, 2027) and four optional years. The estimated total contract value is redacted but includes all four option years. The contracting activity is the 410th Contracting Support Brigade/Regional Contracting Office in Miami, with funding provided through Operations and Maintenance Army (OMA) appropriations.

The justification cites Title 41 U.S.C. §1901(e)(2) as authority for sole-source procurement, asserting that ESPY Corporation equipment is proprietary and used by multiple DoD and non-DoD agencies for drug trafficking interdiction operations. JIATFS requires the ESPY system to complete a networked enterprise system, provide technical refresh for existing equipment in operation since 2010 that no longer meets security requirements, and support continuity of operations. ESPY Corporation is identified as the only available source capable of providing deployment, configuration, integration, technical support, and knowledge transfer due to exclusive access to proprietary intellectual property. No viable alternatives exist, and market research identified no other sources expressing interest. The previous contract (W912PX20C0003) was awarded to ESPY Corps LLC on September 28, 2020 for performance through September 27, 2026 plus a six-month extension, also on a sole-source basis under FAR 6.302-1. Fair and reasonable pricing was determined using previous pricing from the prior contract action.

a. Background: The Joint Interagency Task Force South (JIATFS) is a federal organization charged with the identification of drug traffickers, illicit narcotics, and their means of transport and is also required to dispatch time sensitive information to other federal agencies that interdict narcotics into the United States. The sensitive nature of this effort requires robust and flexible and responsive operational equipment to ensure mission success. The teamSENTINEL system employed at JIATFS is a primary line of equipment used in meeting the DASD-CN and US Southern Command and JIATFS Detection and Monitoring mission.

1) This product is required to support continuity of operations deployment, as part of critical tactical support to JIATFS and SOUTHCOM. Data is not only used by JIATFS but used by multiple intelligence agencies as well.

2) ESPY Corporation is the only available source to provide ESPY systems and project support to include deployment, configuration, integration, technical support and knowledge transfer to the Government.

3) The proposed contractor is uniquely qualified to provide this equipment and subsequent technical upgrades as the required system is proprietary to ESPY Corp.

b. Alternatives: None.

7. Impact if not approved: Without administrative support, Tactical Support Group

(TSG) will not be able to complete a networked enterprise system of systems and complete technical refresh. The equipment refresh is also critical, since the existing equipment has been operating since 2010 and can no longer meet security requirements. Continuity of Operation facilities will not allow the existing equipment in their operational spaces due to the noise created. The timeframe required for another company to develop this technology is prohibitive and would not support program requirements.

8. Efforts to Obtain Competition: Since performance of these services requires access to ESPY Corporation proprietary intellectual property and only ESPY Corporation employees have the necessary access, this requirement will be solicited as sole source. Failure to obtain these services will prevent TSG from meeting mission requirements.

9. Effective competition: As this requirement includes proprietary intellectual property, this requirement was not competed.

10. Subcontracting competition: Not Applicable.

11. Actions to Increase Competition: No action can be taken to increase competition because no other equipment can satisfy the interoperability and functional/operational requirements. The equipment remains the proprietary ESPY Corp. Under these circumstances,
