About this file
This document is a Sole Source Determination and Justification issued by the Oregon Military Department (OMD) for the procurement of hazardous tree removal services at the Camp Withycombe East-Munitions Response Site. The OMD is awarding a sole source contract to AECOM to update the Safe Work Plan, conduct an arborist inspection, perform hazardous tree trimming and removal, and prepare a post-2021 winter storm tree documentation memo. This action is necessary due to the presence of unexploded munitions and explosives at the site, which requires the work to be conducted in accordance with the Military Munitions Response Program (MMRP) and the Comprehensive Environmental, Response Compensation and Liability Act (CERCLA). All work inside the East-MRS must be coordinated through AECOM, who is the contractor in control of the site under contract with the National Guard Bureau through the US Army Corps of Engineers.
The total estimated value of the sole source contract is $60,000. The OMD has determined that AECOM is the only qualified provider capable of safely removing the hazardous trees in compliance with the applicable MMRP, CERCLA, US Army Corps of Engineers, and National Guard Bureau health and safety requirements. An Affected Person may protest the sole source determination pursuant to Oregon Administrative Rule 125-247-0710.

FOR SUPPLIES AND SERVICES
To: Designated Procurement Officer
Oregon Military Department
From: Environmental Branch

Date: 3/25/2022
Re: Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon
Administrative Rule (OAR) 125-247-0275
1. Authority to enter into a Sole-Source Contract: OAR 125-246-0170(2)(c)(H)
2. Estimated Total Value of Contract: $60,000
3. Subject of Contract: Tree Removal at Camp Withycombe, 15300 SE Minuteman Way, Clackamas, Oregon 97015
4. Background:
The Camp Withycombe East-Munitions Response Site (“East-MRS”) contains unexploded munitions and explosives. The winter storms in 2021 damaged the perimeter fence and the forested interior. The perimeter fence was repaired and downed trees that blocked access and inspection routes were removed under an emergency declaration in 2021. Storm damaged trees are still present in the East-MRS that present a Life Health Safety Risk as the trees are at risk for collapse or falling inside the East-MRS and/or onto neighboring residential properties. Oregon
Military Department is awarding a sole source contract to AECOM to update the Safe Work
Plan, conduct an arborist inspection, perform hazardous tree trimming and removal, and prepare a post 2021 winter storm tree documentation memo.
5. Findings:
A. Market Research Overall Finding.
All work inside the East-MRS must be performed in accordance with the Military Munitions
Response Program (“MMRP”) and the Comprehensive Environmental, Response Compensation and Liability Act (“CERCLA”). The US Army Corps of Engineers (“USACE”) and National
Guard Bureau (“NGB”) awarded a contract to AECOM for munitions response at the East-
MRS, and all work performed in the East-MRS must be coordinated through AECOM.
B. Findings of Fact pursuant to ORS 279B.075 (2)(d):
The storm damaged trees require a qualified arborist capable of safely removing tall hazard trees in accordance with applicable MMRP, CERCLA, USACE, NGB and AECOM health and safety requirements. All access into and any work performed inside the East-MRS must be conducted through AECOM as they are the contractor in control of the site and under contract with NGB through USACE.
