About this file

This is a Sole Source Determination document for a Purchase Order issued by the Department of Homeland Security's Customs and Border Protection (CBP) Office of Acquisition.

The document authorizes a sole source award to Reworld Lake II, Inc. for certified narcotic incineration services valued at $40,452.30. The service involved the destruction of 37.37 tons of illicit and illegal drugs, goods, and substances intercepted by the CBP Miami Field Office. The procurement was conducted under FAR 12.102(a) based on urgent and compelling circumstances rather than lack of available sources. The rationale cited CBP's Seized Asset Management and Enforcement Procedure Handbook (SAMEPH), Chapter 7, which establishes internal policy requiring destruction of controlled substances at approved facilities within specified timeframes. The pricing analysis determined fair and reasonableness through comparison with a Blanket Purchase Agreement (BPA 70B03C23A00000040), finding the proposed rate of $882.84 per ton reasonable given the contracted rate of $831.60 per ton and considering the urgent, short-notice circumstances that required expedited vendor performance. Technical/Requirements Personnel Certification and Contracting Officer Certification/Approval were required to validate the determination.

March 2026

Explanation of the rationale cited:

The CBP Seized Asset Management and Enforcement Procedure Handbook (SAMEPH), Chapter 7 provides internal policy on destruction to include timeframes, destruction facilities, controlled substances and security. There was an operational need to execute the high-risk destruction at an approved facility.

5. The anticipated price will be determined fair and reasonable based on one or more of the price analysis techniques described below. (Check one and provide short explanation or description of action taken):

_________ Market Research.

_________ Comparison of the proposed price with prices found reasonable on previous purchases.

_________ Current price List.

_________ Comparison with similar items in a related industry.

_________ Comparison to IGCE.

_________ Contracting Officer’s personal knowledge.

____X_____ Other. Explain:

The two invoices show a total of $40,452.30 at a cost of $882.84 per ton (inclusive ot the environmental fee), which is similar to the contracted price. The contracted price for BPA 70B03C23A00000040 is $756.00 per ton plus a 10% Environmental fee for a total of $831.60 per ton. Thus, this ~6% price premium is reasonable, especially considering the urgent and short notice manner in which the vendor was able to perform.
