About this file

This document is a Sole Source Determination and Justification for the Oregon Department of Fish and Wildlife (ODFW) to procure telemetry equipment including 100 Lotek MCFT2-3EM VHF radio tags, 100 Lotek MCFT3-EM-TA VHF radio tags with temperature and accelerometer sensors, 2 Lotek SRX1200-MD1 VHF receivers, 4 Lotek AN-4YG-150 four element Yagi antennas, and 2 coaxial cables. This equipment is required to complete a spring Chinook telemetry study on the North Umpqua River in conjunction with Oregon State University. The sole source justification cites compatibility requirements, as ODFW and Oregon State University already own Lotek VHF receivers and antennas that are only compatible with Lotek's proprietary VHF radio tags. The total estimated cost is not provided.

The related state and local contract opportunity is for ODFW to award a sole source contract for the radio tags and receivers to support the North Umpqua telemetry study. This is not a solicitation, but rather a notice of a sole source procurement pursuant to Oregon's procurement statutes. The jurisdictions included are Marion County and the City of Salem.

SOLE-SOURCE DETERMINATION & JUSTIFICATION

FOR SUPPLIES AND SERVICES

To: Contract Services

From: Greg Huchko Date: 2/2/2024

Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275 for:

Description of Goods or Services:

• Lotek MCFT2-3EM very high frequency (VHF) radio tags; quantity = 100

• Lotek MCFT3-EM-TA VHF radio tags with temperature and accelerometer sensor and logger;

quantity = 100

• Lotek SRX1200-MD1 VHF receivers; quantity = 2

• Lotek AN-4YG-150 four element Yagi antenna with 25 foot cable; quantity = 4

• 25 foot coaxial cable; quantity = 2

Reason for Need:

This request is to purchase telemetry equipment (radio tags, receiver units, antennas etc.) needed to complete a spring Chinook study on the North Umpqua River. This project is being conducted in conjunction with Oregon State University and will help the Oregon Department of Fish and Wildlife (ODFW) better manage this fishery within our plans and policies. Four additional Lotek VHF receivers and two additional Lotek antennas currently owned by ODFW and/or Oregon State University will be used in the study, and the goods listed above for purchase were selected based on compatibility with existing equipment.

Single of Multiple Purchases:

This justification is for a single purchase.

Estimated Cost:

Research Leading to Determination:

The project cooperators (ODFW and Oregon State University) own multiple Lotek brand VHF receivers that are only compatible with VHF radio tags manufactured by Lotek due to proprietary technology. In addition, ODFW has Lotek VHF radio tags from previous projects that could potentially be used in this study. Thus, due to compatibility requirements, purchasing the additional products listed above from Lotek will lead to the most efficient utilization of existing state equipment.

Analysis of Research / Findings of Fact:

Pursuant to OAR 125-247-0275(2)(a): Compatibility.

ODFW currently owns Lotek VHF receivers and Lotek antennas. To complete this project, the Agency will need to utilize the existing equipment on hand as well as procure additional equipment. The additional equipment will need to interact with the existing equipment. Based on both the letter from supplier Lotek attached and market research, the proprietary coding system contained in Lotek’s products limits their compatibility with other brands of receivers and antennas. Given this information and our current inventory of Lotek products, solely awarding this procurement to Lotek would lead to the most efficient utilization of existing goods.

Pursuant to ORS 279B.075 (2)(b): Exchange of Software or Data.

Pursuant to ORS 279B.075 (2)(c): Pilot or Experimental Project.

Pursuant to ORS 279B.075 (2)(d): Other findings that support the conclusion that Supplies and Services are available from only one source may include but are not limited to considerations of: unique design, availability, geographic location, exclusive authorized representative, cost of conversion, and warranty services.
