About this file

This document is a Sole Source/Brand Name Justification for acquiring a Meltog shredder and compactor system (SH4240-01RN) from the sole source Meltog LTD. The system is intended for use on board US Navy submarines to shred and compact solid waste. The justification explains that the Meltog system is the only one identified that meets the Navy's requirements for a compact, low-noise shredder-compactor unit suitable for the submarine environment, and that it is currently used in the UK Royal Navy fleet. The estimated total price for the procurement, which is for RTDE testing at Carderock, is provided. The justification cites Meltog's proprietary design and the lack of other vendors with a similar proven product as the basis for the sole source determination under the Simplified Acquisition Threshold.

The related federal contract opportunity is for the requirement of a Shredder/compactor, Heat sealer, Corrugated boxes, Box lids, and associated documentation, to be procured by the Naval Sea Systems Command. The minimum specifications for these items are to be provided.

NSWCCD Sole Source/Brand Name Justification Under SAT Rev 3 Template Effective February 2023

MEMORANDUM FOR FILE

FROM:

CODE: 633

TO: Code 02 SUBJECT: Sole Source/Brand Name Justification / Limited Source Justification for Use of Other than Full &

Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. FAR 8.405-6(b)(1) states Brand name specifications shall not be used unless the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.

3. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

4. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.

II. DESCRIPTION OF ITEM OR SERVICE (include manufacture/sole source name and address) Meltog shredder and compactor system (SH4240-01RN) from sole source Meltog LTD. The system shreds solid waste and then compacts it into sealed, stackable waste “logs”. The system is intended for the trash room space onboard a submarine. SSNX program since the trash will not be allowed to discharge waste at sea. Therefore, this unit is a potential solution for compliance to the new solid waste management requirements onboard the upcoming US Navy class SSNX submarines. Meltog system is currently used in UK Royal Navy fleet, and has been in use for the last 15 years. US Navy has new requirements for SSNX submarine class, which requires onboard stowage of all solid waste during missions (except food waste), and processing equipment must be low noise. Procurement is for RTDE testing at Carderock.

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

Code 633’s technology identification and assessment process has been an ongoing years long process looking at what is available in industry with regards to Solid Waste processing equipment. To date, there has been no other vendor or unit identified that is tested, ready for manufacture, and that meets the submarine environmental requirements.

A. BRAND NAME:

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment

Manufacturer (OEM).

3. Other Reasons:

B. SOLE SOURCE (select all that apply) Meltog system has been in use in the UK Navy submarine fleet for the last 10-15 years, and used in a similar space and layout as our current US submarine class ships. The system is low noise (just under 70dB), and designed for the solid waste mixture that is common on US Navy ships. The current US Navy fleet only has a compactor and does not have a shredder system or feature to further reduce volume of the processed solid waste.

The Meltog unit has a combined shredder and compactor in one unit and size is comparable to the US Submarine compactor. This feature is essential to the Government’s requirements. Code 633’s market research and TIAP process over the years have not identified another shredder compactor. Market research has determined vendors with separate systems (ie separate shredder and separate compactor units), but not in a single unit and in such a small and compact form, fit and function, with a proven record for supporting submarine environment. The meltog item cost is favorable as well and less than the estimated costs of the two separate main functions on their own.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, Meltog’s design is proprietary. The system has been environmentally tested for UK Navy use, which has similar, if not the same requirements, as the US Navy environmental requirements (shock, vibration, noise, emi, etc).

Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

Meltog Shredder is only available from the Meltog LTD.

1. SSNX FY24/FY25 funding provided at this last minute August 10th, 2024. Program requirement to procure units and to be expended end of DEC 31, 2024.

2. Technically, Meltog shredder system is the only system identified with a shredder system onboard a military submarine. This feature would be an advancement to our US Navy submarine solid waste management capabilities.

C. LIMITED SOURCE (FAR 8.405-6):

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, Manufacturer (OEM).

IV. CERTIFICATIONS & APPROVALS

A. Technical/Requirements Certification: I certify that the facts and representation under my cognizance, which are included in this justification, are complete and accurate to the best of my knowledge and belief.

First Line Supervisor Signature Name / Title / Phone Date

B. Certification/Approval per FAR 13.501: Upon the basis of the above justification, I hereby approve the solicitation of the proposed procurement(s) described herein using other than full and open competition, pursuant to the authority of 10 U.S.C. 3204(c).
