MEMORANDUM FOR RECORD

SUBJECT: Sole Source Solicitation/Contract #SP3300-21-P-0045 REFERENCE: FAR 11.105, DFARS/ PGI 211.105 or FAR 13.106(b)(1)(i)

1. Identification of the Agency and Contracting Activity DLA Distribution, DLA Distribution J7 BLDG 430 Mifflin Ave New Cumberland PA 17070

2. Describe the contract action, to include the dollar value and the type of limited justification.

This is a Sole Source action to be awarded as a Firm-Fixed Price contract to Fleet Equipment LLC (CAGE 44DND3) DLA Distribution Anniston, Alabama has a requirement for a Contractor to provide a 40 Ton capacity with removable gooseneck trailer in accordance with the Statement of Work. The estimated ceiling price for these services is $25,980.00. The contract will be for an estimated period of performance of one (1) year beginning on 01 November 2020 through October 31, 2021.

3. Description of the Supplies/Services

DLA Distribution Anniston (DDAA) request the rental a low boy trailer for one year in support DDAA Stryker mission. The rental trailer needs the following specifications: DLA Distribution Anniston, Alabama. DDAA employees will transport over 75 Stryker’s and 150 M113 family of vehicles from customer's location to DDAA's preservation storage fields. Each vehicle will be loaded, transported, unloaded, and back to pick up next vehicle. The process will take approximately 2.5 hours per vehicle.

a. Trailer be a minimum of at least 40 Ton capacity with a removable gooseneck.

b. Minimum 25-29' length X I 02" width with outriggers to extend the width of the trailer.

c. Trailer must have three rear axles.

4. Justification Rationale for Use of Sole Source

The current contract expired on 30 June 2020. DDAA is in the process of securing a follow-on is being sought through securing a long term solution and is working with DDC equipment to purchase a low boy trailer for the fiscal year 2021.

The period of performance of the sole source continuation contract is only for the anticipated amount of time to allow for the completion of the competitive procurement package being developed.

As a result, an award of a contract to Fleet Equipment LLC enables seamless mission support by the incumbent contractor while the follow-on contract procurement package is being developed. Any other alternative would create unacceptable delays in performing these services for DLA and potentially compromise mission support. The disruption of services through a competitive procurement would create substantial costs to the Government. Therefore, full and open competition is not feasible for the continuation contract.

5. Market Research and Interested Sources A search conducted in the System for Award revealed zero SBA vendors in the Anniston area, who could lease the low boy trailer. Additional market research was conducted via the World-Wide Web, revealed Fleet Equipment LLC as the only vendor with the low boy trailer needed to fulfill this requirement. The prices previously submitted by Fleet Equipment LLC during the length of the expiring contract to be competitive with similar types of low boy trailer rentals as advertised commercially. The market research indicates the rates and prices for this period and corresponding extension are competitive. Also, the continuation contract will be awarded at the expiring contract’s current prices. Therefore, the Contracting Officer determined the current pricing for the lease of the low boy trailer to be fair and reasonable.

6. Determination The expired contract SP3300-20-P-0486 was solicited as an oral quote, unlike the follow-on contract that will be advertised on the Government Point of Entry, the www.beta.sam.gov website. The oral solicitation for the expired contract received one quote, award to another source for this continuation contract would result in a substantial duplication of cost to the Government that is not expected to be recovered through competition in addition to creating unacceptable delays in fulfilling the agency’s requirements.

Therefore, Fleet Equipment LLC is the Only One Responsible Source known that will satisfy Agency requirements for continued services.

7. Other Supporting Facts N/A

8. Fair and Reasonable Issuing a sole source continuation contract to Fleet Equipment, LLC is the most advantageous method of fulfilling the Government’s need for uninterrupted DDAA Stryker mission. The proposed prices for the one

(1) year requirement has remained steady since the award of the previous contract awarded in May 2020.

There has been no substantive change in the requirement for this type of service. The resulting continuation contract will be awarded at the same unit price quoted as that of the expiring contract.

The Contract Specialist performed an informal price analysis by comparing the current contract leasing pricing via the RentalYard.com website. The Specialist found a comparable monthly rental rates for similar characteristics with an advertised rate of $2,950.00. The Contractor is proposing $2,165.00 Therefore, in comparison to advertised commercial pricing, an overall monthly savings of 36% decrease in pricing for the period of performance of the continuation contract is competitive under current market conditions and is fair and reasonable for the services to be provided.
