The salient physical, functional, or performance characteristics that “equal” products must meet are specified in the solicitation.

(b) To be considered for award, offers of “equal” products, including “equal” products of the brand name manufacturer, must--

(1) Meet the salient physical, functional, or performance characteristic specified in this solicitation;

(2) Clearly identify the item by--

(i) Brand name, if any; and

(ii) Make or model number;

(3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and

(4) Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications.

(c) The Contracting Officer will evaluate “equal” products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer.

(d) Unless the offeror clearly indicates in its offer that the product being offered is an “equal” product, the offeror shall provide the brand name product referenced in the solicitation.

(End of provision)

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2018)

ADDENDUM TO FAR 52.212-1, INSTRUCTIONS TO OFFERRS—COMMERCIAL ITEMS:

Paragraph (c) is changed to read: Period for acceptance of offers. The Offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(End of Addendum)

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

ADDENDUM TO FAR 52.212-2, BASIS OF AWARD:

A. General Information:

1. The basis of award will utilize Best Value Trade Off criteria procedures. This is a competitive Best Value Trade Off requirement. The Government intends to award a single contract. The Government’s most important factor for this Best Value requirement is technical compliance with the salient characteristics of the purchase description as described in this solicitation. If the government technical evaluator determines that an offeror’s product exceeds the technical specifications described in the purchase description for this solicitation, the Government is willing to pay a higher price (not to exceed 5%) for the technically superior product. The 5% margin shall be determined by evaluating cost of the lowest price technically acceptable offer and adding 5% to the cost of the lowest price technically acceptable offer. If the price of the technically superior product is within 5% of the cost of the lowest price technically acceptable offer, award shall be made to the technically superior product. If the contractor’s proposal once reviewed is technically equal with another contractor’s proposal, price will become the determining factor for award. Contractors must have an acceptable past performance.

2. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, and technical requirements.

3. The Government intends to make award without discussions, unless the Contracting Officer determines that discussions are necessary. Offerors should provide their most favorable prices in their initial offers.

B. Non-Price Evaluation Factor:

1. Factor 1 – Technical:

(a) Subfactor 1 Technical compliance with the salient characteristics as described in this this solicitation: The offeror shall provide all detailed information possible for the Government POC to evaluate their proposal against the requirement in the purchase description.

(b) Subfactor 2 Past Performance: The offeror shall provide three (3) references for the Government POC to evaluate. The past performance evaluation is an assessment of the offeror’s probability of meeting the past performance solicitation requirements. This assessment is based on the offeror’s record of relevant and recent past performance information that pertain to the products outlined in the solicitation requirements. Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation require will be consider relevant. Contract Performance occurred within the past three years from the date proposals are due is consider recent. Past performance will be rated on an “acceptable” or “unacceptable” basis using the rating in Table below.

Past performance will be initially evaluated to determine whether the offeror’s present / past performance is recent, and relevant or not relevant to the effort to be acquired.

The criteria to establish what is recent and relevant shall be unique to each Best Value Trade Off source selection.

Therefore, the solicitation shall establish the criteria for recency and relevancy in relation to the specific requirement being procured. In establishing what is relevant for the acquisition, consideration should be given to what aspects of an offeror’s contract performance history would give the most confidence that the offeror will satisfy the requirements of the contract that is contemplated to be awarded as a result of the evaluation of proposals in the current procurement.

Second, the past performance evaluation will determine how well the offeror performed on the prior contracts.

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”

Past Performance Table for Acceptable /Unacceptable Rating Method

Acceptable - Based on the offeror’s relevant and recent performance record of at least three (3) references, the Government has a reasonable expectation that the offeror will successfully perform the required effort. Alternatively offeror’s performance record is unknown and therefore neutral.

Unacceptable - Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

C. Price Evaluation Factor: Offerors shall complete the pricing for each Contract Line Item Number (CLIN).

D. Proposals will be evaluated initially independently of the price to determine the Offerors’ ability to meet the Government’s requirement set forth in the solicitation. The Government may make a final rating determination based on the proposal as submitted without requesting any further information. For all proposals determined to be Technically Acceptable, the offer providing the lowest price will receive the contract award, however, the Government is willing to pay a higher price (not to exceed 5%) for a technically superior product. The 5% margin shall be determined by evaluating the cost of the lowest price technically acceptable offer and adding 5% to the cost of the lowest price technically acceptable offer. If the price of the technically superior product is within 5% of the cost of the lowest price technically acceptable offer, award shall be made to the technically superior product.

1. Offerors’ technical proposals will receive an overall rating based on the following:

(a) Technically Acceptable: Offeror meets all requirements or technical specifications or has submitted all documentation requested in any technical evaluation criteria and all documentation meets the standard set forth in the solicitation.

(b) Technically Unacceptable: Offeror fails to meet all requirements or technical specifications or has failed to comply in submitting requested documentation in any technical evaluation criteria or the submitted documentation fails to meet the standard set forth in the solicitation.

(End of Addendum)
