Section SF 1449 - CONTINUATION SHEET

NOTICE TO OFFEROR

This Solicitation is a sole source requirement for direct replacement stern ramp parts to Trident Maritime Systems.

1. It is anticipated that this solicitation will result in an award of a FIRM, FIXED-PRICE SUPPLY type contract.

2. NOTICE TO ALL OFFERORS: The Government anticipates awarding a firm, fixed price contract in response to quotes/proposals received to this solicitation. As a result, the contract's pricing will not be subject to any adjustment on the basis of the contractor's increased costs due to COVID-19 and/or inflationary causes experienced during contract performance. A firm, fixed price contract places the maximum risk and full responsibility for all costs and resulting profit or loss on the contractor, offerors are advised to consider these risks when pricing their quotes/proposals.

3. See block 8 on page 1 of the solicitation for the closing date and time.

4. SINGLE AWARD FOR ALL ITEMS: Due to the interrelationship of supplies and/or services to be provided hereunder, the Government reserves the right to make a single award to the quoter whose quote is considered in the best interest of the government, price and other factors considered. Therefore, quoters who quote less than the entire effort specified herein may be determined to be unacceptable.

5. “EXCEPTIONS: All quoters MUST note all exceptions from the solicitation’s terms conditions, specifications, and/or the statement of work / performance work statement, if any.

It will be assumed that any quote without mention of any exceptions will take no exception from all specifications, terms and conditions, clauses, or provisions within the solicitation.”

6. The work contemplated in this contract is on the following critical safety items #15 -Mission Equipment (Vehicle Ramps; Cargo Cranes; Cargo Hold Water Tight Doors and Ramps) (structural, electronics and hydraulic control systems; not hydraulic components and hoses, and other common components). Per COMSCINST 4490.1C, MSC N7, the Design Control Activity, has determined that only qualified sources may produce and service these critical safety items. Only authorized field service technicians have access to necessary technical data and have the expertise to identify and provide direct replacement parts for existing equipment, which must be compatible in terms of form, fit, and function with existing equipment or configurations. This ensures equipment reliability. Improperly installed or deficient parts could cause system failure and loss of the affected system or equipment while at sea. The identified contractor has been qualified by MSC to work on this system as shown on https://www.msc.usff.navy.mil/Business- Opportunities/Contracts/Qualification-for-Items-Critical-to-Shipboard-Safety-on-MSC-Vessels/.

7. Submission of invoices will be via WAWF; see Clause 252.232-7006.
