1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
Assist with moving a dead humpback whale on Great Kills Beach and bury on site. Anticipated cost is approximately $10,000.
2. Sole Source Justification rationale (Check one and explain below):
______ Only one responsible source.
_____X_ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.
______ Other _____________________________________________________
Explain: A whale was reported on the beach at 1200 on Friday September 17. The Park contacted the Atlantic Marine Conservation Society Hampton Bays, NY 11946 to seek out advice on how to proceed.
They strongly suggested a necropsy be performed as soon possible and to have the whale either buried (suggested) or removed from site. Removal was not an option as NYC Sanitation would not take a 40-ton whale at their site. NPS Resources allowed the animal to be disposed of onsite following NOAA guidelines. The Park does not possess the heavy equipment necessary to move or bury an animal of this size. Three contractors were called and only Crisdel was able to be on site overnight and staff the equipment for transport of the animal and burying the animal. The quick handling and removal were necessary to ensure public health and safety.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received, or anyone expressed interest:
Multiple contractors were contacted; however, only Crisdel Group was able to mobilize and have equipment across the bridge and have staff available for immediate response.
4. If this is a determination for sole source, the contracting officer certifies:
a. Only one source is available, or urgent and compelling circumstances exist.
Last updated 6/2/2016
b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
