1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):
The Consultant shall conduct archeological testing and monitoring during an eight-week program of restoration and improvement of 30 miles of portage trails and paths – a project critical improvement of health and safety for visitor access to recreation on the Penobscot River within Katahdin Woods and Waters National Monument (KAWW).
These resources are the ancestral remains for the Penobscot Nation of Indians as recognized by the Presidential Proclamation establishing the park unit and they are the primary tribal partners for this work under the National Historic Preservation Act.
Estimated Value: Fieldwork - $19,400; Artifact cataloging, curation, and reporting - $5,000; Total:
$24,400.00.
2. Sole Source Justification rationale (Check one and explain below):
__X____ Only one responsible source.
______ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.
______ Other _____________________________________________________
Explain: The proposed work for archeological research, field work, monitoring, laboratory analysis, and reporting associated with the archeological compliance needs during the portage trails restoration and improvement project within KAWW (PMIS 258066), is associated with health and safety efforts to improve safe access for visitors recreating on the Penobscot River. The Penobscot River is a prominent feature within KAWW, and is a popular resource visitor use for recreation, including paddling in canoes.
Sections of the river are potentially dangerous to navigate, and require visitors take out and portage their canoes around these sections. Existing portages and trails are currently overgrown, worn, and poorly marked. This project will restore and improve 30 miles of portages and trails to improve visitor awareness and use of these portages and ensure their health and safety when they on the river.
Archeological compliance activities are required during the performance of the work described above.
The portage trail rehabilitation is being conducted by a team of Indigenous youth, and the archeological compliance work is intended to occur concurrently with the trail restoration in order to offer the crew an opportunity for the transfer of proprietary tribal knowledge concerning the resources within KAWW.
Proprietary cultural knowledge the Penobscot Nation possess is also needed to appropriately interpret the results of the archeological compliance work.
KAWW is proposing to secure the services of the Penobscot Indian Nation Office of Cultural & Historic Preservation to conduct the required archeological services. The Penobscot Nation is located within Maine, near KAWW, and can provide these services during this period. Most importantly, the Penobscot Nation are in sole possession of the required proprietary cultural knowledge about the archeological resources in the project area, which is vital for the successful performance of this work. This proprietary knowledge would not be available to any other potential service provider in or outside of the State of Maine – making the Penobscot the only potential service provider who could accomplish the full scope of this project.
The existing portage trails have likely existed for at least hundreds of years. The trails have been and continue to be used by the Penobscot Indian Nation who have occupied the land comprising KAWW for at least 12 thousand years. The trails have cultural significance to the Penobscot Nation, and have been identified as potentially being sensitive for the presence of subsurface archeological resources. The resources under evaluation and investigation are the remains of 10,000 years of Penobscot Indian homeland as recognized in the Presidential Proclamation that established the Park. The Penobscot Indian Nation is considered, by NPS Policy, under the National Historic Preservation and the Indian Self- Determination and Education Acts, expert in the interpretation, curation, recovery and evaluation of resources germane to their cultural history.
The Penobscot Indian Nation Office of Cultural & Historic Preservation (PINOCHP) include staff comprised of Native American archeological professionals who have a direct cultural and historical interest in KAWW and its resources, as well as vital proprietary cultural knowledge that is not available to any persons outside the tribe itself.
The PINOCHP have the required skills and qualifications to provide the services associated with the portage trail restoration and improvement project. NPS have confirmed the PINOCHP are ready and available to conduct the work during the COVID-19 pandemic. More importantly, acquiring the services of the directly affiliated Tribal stakeholders to conduct this work is the most appropriate choice as doing so fosters ongoing cultural practices among the Penobscot Indian Nation and a group of Tribal youth, and provides an understanding and appreciation for their rich cultural heritage among park visitors. Engaging the services of PINOCHP also meets the Secretary of the Interior’s Priority 1: Create a Conservation Stewardship Legacy Second Only to Teddy Roosevelt, by improving visitor access to recreation opportunities within KAWW; and Priority 2: Ensuring Sovereignty Means Something, by using the services of a directly affiliated Tribal nation to conduct the work, and improve access to and appreciation of their cultural heritage.
3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received, or anyone expressed interest:
Market research was conducted to ensure that no other company would be able to provide the necessary insight or knowledge needed to complete the entire scope of work.
4. If this is a determination for sole source, the contracting officer certifies:
a. Only one source is available, or urgent and compelling circumstances exist.
b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
