NOTICE OF INTENT TO SOLE SOURCE

U.S. Fish and Wildlife Service (FWS), is issuing this Notice of Intent (NOI) to inform industry contractors of the Government’s intent to execute a Sole Source Award under FAR Part 13 – Simplified Acquisition Procedures (SAP), specifically FAR Subpart 13.5 – Simplified Procedures for Certain Commercial Items.

The intended Contractor is Tulelake Irrigation District located at 2717 Havlina RD Tulelake, California 96134-0000.

U.S. FWS Lower Klamath Basin National Wildlife Refuge requires pumping 4,000-6,000 acre feet of water from the Sump 1A to Sump 1B using existing pumping infrastructure. The volume of water available is difficult to predict due to agricultural usage and diversion, evapotranspiration, etc. Further operation and maintenance costs to TID canals, lift pumps, headgates, water control structures, ditches, and other water conveyance infrastructure may be incurred as part of this operation as water needs to be conveyed to Sump 1B via this infrastructure. These potential costs also fall within this scope of work. Tule Lake Irrigation district is the sole operator of this facility. Further, this conveyance and pumping infrastructure is the only way to convey this water from Sump 1A to Sump 1B. All materials and labor will be provided by the TID.

This procurement is being conducted using commercial item procedures pursuant to FAR Part 12 and FAR Part 13, specifically FAR Subpart 13.106-1(b)(1)(i) allowing the Contracting Officer (CO) to solicit from one source.

This notice of intent is neither a formal solicitation nor a request for competitive proposals. No solicitation document is available and telephone requests will not be honored. No award will be made on the basis of unsolicited quotations or offers received in response to this notice. Any response to this notice must show clear, compelling and convincing evidence that competition will be advantageous to the Government. The intent of this synopsis is for informational purposes only. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. A determination by the Government not to compete this action is solely within the discretion of the Government.

Acquisitions Operations

There are no other capable sources available.

The Refuge does not have portable pumps of the capacity need to move this volume of water. Further, the water would still need to be conveyed via TID canals and head gates, which are not owned by the Refuge.

All of the pumping and conveyance infrastructure (pumps, canals, head gates, water control structures) are owned and operated by Tulelake Irrigation District, with no other options available to move this water and ensure survival of this listed species. Because all of the pumping and conveyance infrastructure is owned and operated by Tulelake Irrigation District, there are no other options to move 4,000-6,000 acre feet of water between the sumps.

Sump 1A provides habitat for a host of waterbirds and two species of federally endangered suckers. The historic drought that is taking place in the Klamath Basin along with agricultural diversions has dropped water levels in Sump 1A to the point were these fish are facing threats to their survival. To prevent these populations from being completely wiped out, these fish are be captured and translocated to Sump 1B which is adjacent to Sump 1A.

Pumping is needed to drawdown the sump to facilitate fish capture and increase the depth in Sump 1B.

Short of a private entity purchasing land and constructing conveyance canals and pumping plants, there is no other way to move water between the sumps. There is no feasible way to overcome barriers to competition.
