About this file
This document is a Brand Name Justification for an Exception to Fair Opportunity from the Department of the Interior's Interior Business Center for the Bureau of Trust Funds Administration (BTFA). The procurement is a Firm-Fixed-Price (FFP) acquisition utilizing NASA Solutions for Enterprise-Wide Procurement (SEWP) V to purchase specialized hardware for the American Indian Records Repository (AIRR) Digital Center for Excellence program. The specific equipment includes five Fujitsu FI-7700 Document Scanners and individual items such as a Bookeye 5 v1 book scanner, VersaScan map scanners, and multiple secure media destruction devices from SEM, all of which are included in the National Security Agency's Evaluated Products Lists (EPLs).
The procurement has a 60-calendar day performance period, and the acquisition strategy involves a Lowest Price Technically Acceptable (LPTA) approach. Market research was conducted via a Request for Information (RFI) on NASA SEWP, which confirmed small businesses could provide the required services. The contracting officer noted they are not aware of any Indian-owned Small Business Economic Enterprise (ISBEE) companies capable of completing the requirement, and a Buy Indian Act Deviation will be completed. The hardware is intended to ensure secure and compliant disposition of electronic media, meet trust litigation requirements, and support proper identification, documentation, and destruction of records.

BRAND NAME JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
AUTHORITY: FAR 16.505(a)(4)(i)
140D0425Q0772
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Brand Name Justification for an Exception to Fair Opportunity.”
This document is a Brand Name Justification for an Exception to Fair Opportunity for the Department of the Interior, Interior Business Center, Acquisition Services Directorate, Division 5, Branch II, on behalf of the Bureau of Trust Funds Administration (BTFA).
2. Nature and/or description of the action being approved.
This new procurement will be Firm-Fixed-Price (FFP) under Federal Acquisition Regulation (FAR) 12-Commercial and FAR 16.505 utilizing National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
This is a FFP new requirement for hardware for the American Indian Records Repository (AIRR) Digital Center for Excellence (DCE) program to help Bureau of Trust Funds Administration (BTFA) to ensure the secure and compliant disposition of electronic media (e.g., CDs, DVDs, flashdrives, external hard drives) in accordance with federal records management policies, including proper identification, documentation, and destruction or transfer of records, to prevent data loss or unauthorized access, in addition to meeting trust litigation requirements by procuring the necessary equipment to respond. Five Fujitsu FI-7700 Document Scanners are to be purchased as well as one each of the following hardware:
--Bookeye 5 v1 book scanner --VersaScan VS3650 Map Scanner --VersaScan VS4870 Map Scanner Large Scale --SEM 0101 hard drive crusher SSD kit --SEM 600 EMP1000-HS Degaussers --SEM Model 0315 HDD shredder --SEM Model 200 Office Disintegrator
The specific brand names for each item are included above. These specific branded items are included in the National Security Agency/Central Security Service (NSA) Evaluated Products Lists (EPLs).
The anticipated period of performance is 60 calendar days following receipt of award, and the Independent Government Estimate (IGE) is for this requirement.
4. Identification of the exception to fair opportunity (see 16.505(a)(4)(i)) and the supporting rationale, including a demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the exception cited. If the contracting officer uses the logical follow-on exception, the rationale shall describe why the relationship between the initial order and the follow-on is logical (e.g., in terms of scope, period of performance, or value).
FAR 16.505(a)(4)(i) – The Contracting Officer (CO) must justify restricting consideration to an item peculiar to one manufacturer (e.g., a particular brand-name, product, or a feature of a product that is peculiar to one manufacturer).
These specific branded items are included in the NSA EPLs which BTFA follows for their items.
5. A determination by the contracting officer that the anticipated cost to the
Government will be fair and reasonable.
IAW FAR 16.505(b)(7)(iii), the CO must include a justification for using Lowest Price Technically Acceptable (LPTA). The award decision will be based on LPTA. FAR part 15 does not apply. As such, no further LPTA justification is required. However, LPTA is appropriate because the requirements are well defined, the risk of unsuccessful contract performance is minimal; and there is no value, need, or willingness to pay for higher performance or quality.
Evaluation Factors include Technical Acceptability and Price. The technical evaluation will be pass/fail if the offeror is technically acceptable, or not. The Government will evaluate to ensure the quotes meet the salient characteristics identified in the Solicitation. Price reasonableness will be performed
6. Any other facts supporting the justification.
Market Research was conducted. The CO released a Request for Information (RFI) via NASA SEWP on 8/26/2025 to confirm if there were any companies able to provide the required services and responses were received – all from Small Businesses.
The CO and BTFA are not aware of any Indian-owned Small Business Economic Enterprise (ISBEE) companies that will be able to complete this requirement and Market Research did not locate any companies either. A Buy Indian Act Deviation will be completed and signed, and a copy saved in the file.
