i. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, “Streamlined Procedures for Evaluation and Solicitation for Commercial Items,” as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested, and a written solicitation document will not be issued.

ii. This solicitation, 89303020REI000050, is a Request for Proposals (RFP).

iii. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020-04, Effective 15 January 2020.

iv. This solicitation is unrestricted for full and open competition. The associated North American Industrial Classification System (NAICS) code for this procurement is 541511 - Custom Computer Programming Services $30.00.

v. Submit a proposal per Attachment 1 Statement of Work (SOW), RFP Term and Conditions.

vi. The Department of Energy (DOE), Energy Information Administration (EIA) located in Washington, DC is seeking to migrate the current EMM database and code to AIMMS which will facilitate ease of model development and improved sustainability, per Attachment 1, SOW.

vii. Delivery terms are FOB destination. The contractor shall deliver all line items to the place of performance listed below.

Place of Performance

Address: 1000 Independence Avenue Washington D.C, 20585

This task order base period will be six months from the date of award. There are three option periods. All option period will be for twelve months each.

viii. Offerors that fail to furnish required representation or technical information as required by Federal Acquisition Regulation provisions 52.212-1 or reject the terms and conditions of this solicitation shall be excluded from consideration.

ix. 52.212-2 -- Evaluation -- Commercial Items (Oct 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award shall be made to the offeror whose proposal offers the best value to the government. In determining the “Best Value,” the Government is more concerned with obtaining a superior technical proposal than making an award at the lowest evaluated cost.

However, the Government will not make an award at a cost premium it considers disproportionate to the benefits associated with the superiority of one technical proposal over another. The Government will assess whether the strengths and weaknesses between or among competing technical proposals indicate superiority from the standpoint of: (1) what the difference might mean in terms of anticipated performance; and (2) what the evaluated cost to the Government would be to take advantage of the difference. Award will be made to the offeror who proposes the “Best Value” as determined by the procedures outlined in the SOW.

The following factors shall be used to evaluate offers:

(i) technical capability of the proposal offered to meet the Government requirement;

(ii) Experience/Past Performance;

(iii) price;

The Government will evaluate the reasonableness of the proposed cost/price using one or more of the cost/price analysis techniques defined in FAR 15.404. In evaluating reasonableness, the Government will determine if the Offeror’s proposed costs, in nature and amount, do not exceed those which would be incurred by a prudent company in the conduct of competitive business. The Government will evaluate the completeness of each Offeror’s cost proposal by assessing whether the Offeror provides the required cost data in sufficient detail to fully support the offer and permit the Government to evaluate the proposal thoroughly.

If utilized, a past performance evaluation will be conducted. The Government intends to utilize the Government Wide Past Performance Information Retrieval System (PPIRS) for past performance evaluations as a basis for anticipating successful/unsuccessful performance on this required effort. To be considered acceptable for past performance, a search of the PPIRS must reveal no negative past performance information for the recent and relevant records. In the event there are no recent and/or relevant PPIRS records, the quoter may submit information on recent and relevant subcontracts and/or commercial contracts. If no recent and relevant contracts are available in PPIRS or submitted by the offeror, the quoter’s past performance record shall be considered “unknown.” In the context of acceptable or unacceptable, “unknown” past performance shall be considered “acceptable.” To be considered recent, the effort must either still be in progress or have been completed within the previous three (3) years from date of this draft award notice. To be considered relevant the record should be similar in terms of complexity, scope, and magnitude. “Scope” is defined as experience in areas defined in the WS. “Magnitude” is defined as the measure of similarity of the volume, dollar value, and/or duration of work actually performed under the quoter’s submitted contracts to the PWS. At the quoter’s discretion, additional past performance information may be submitted with the quote as a supplement to PPIRS. If furnished, this submission will be evaluated in accordance with the procedures described above.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

x. The Offerors to include a completed copy of the provision at FAR clause 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer.

xi. FAR 52.212-4 Contract Terms and Conditions—Commercial Items (Oct 2018) is applicable, per Terms and Conditions.

xii. FAR 52.212-5 Contract Terms and Conditions Required To Implement Statutes or Executive Orders—Commercial Items (Jan 2020) is applicable, per Terms and Conditions.

xiii. Additional contract requirements, terms, and conditions can be found in Attachment 1, " Statement Work of Statement (SOW)" and Terms and Conditions.”

xiv. The Defense Priorities and Allocations System (DPAS) are not applicable to this requirement.

xv. Submission shall be received not later than 12 P.M., June 8, 2020. All offerors shall submit offers via FEDCONNECT. All offers shall be labeled “89303020REI000050 migrate the current EMM database and code to AIMMS”. No other methods of transmission will be accepted. 14. DOE-H-2033 ALTERNATIVE DISPUTE RESOLUTION (OCT 2014)

(a) The DOE and the Contractor both recognize that methods for fair and efficient resolution of contractual issues in controversy by mutual agreement are essential to the successful and timely completion of contract requirements. Accordingly, DOE and the Contractor shall use their best efforts to informally resolve any contractual issue in controversy by mutual agreement. Issues of controversy may include a dispute, claim, question, or other disagreement. The parties agree to negotiate with each other in good faith, recognizing their mutual interests, and attempt to reach a just and equitable solution satisfactory to both parties.

(d) ADR procedures may be used at any time that the Contracting Officer has the authority to resolve the issue in controversy. If a claim has been submitted by the Contractor, ADR procedures may be applied to all or a portion of the claim. If ADR procedures are used subsequent to issuance of a Contracting Officer’s final decision under the clause at FAR 52.233-1, Disputes, their use does not alter any of the time limitations or procedural requirements for filing an appeal of the Contracting Officer’s final decision and does not constitute reconsideration of the final decision.

(e) If the Contracting Officer rejects the Contractor’s request for ADR proceedings, the Contracting Officer shall provide the Contractor with a written explanation of the specific reasons the ADR process is not appropriate for the resolution of the dispute. Section I - Contract Clauses

18. 52.212-4 Contract Terms and Conditions-Commercial Items (Oct 2018)

(a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post-acceptance rights-

(1) Within a reasonable time after the defect was discovered or should have been discovered; and

(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

(b) Assignment. The Contractor or its assignee may assign its rights to receive payment due as a result of performance of this contract to a bank, trust company, or other financing institution, including any Federal lending agency in accordance with the Assignment of Claims Act (31 U.S.C. 3727). However, when a third party makes payment (e.g., use of the Governmentwide commercial purchase card), the Contractor may not assign its rights to receive payment under this contract.

(c) Changes. Changes in the terms and conditions of this contract may be made only by written agreement of the parties.

(e) Definitions. The clause at FAR 52.202-1, Definitions, is incorporated herein by reference.

(f) Excusable delays. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.
