If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Payment request means a bill, voucher, invoice, or request for contract financing payment with associated supporting documentation. The payment request must comply with the requirements identified in FAR

32.905(b), “Content of Invoices” and the applicable Payment clause included in this contract.

(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests electronically using the Department of Treasury Invoice Processing Platform (IPP) or successor system. Information regarding IPP, including IPP Customer Support contact information, is available at www.ipp.gov or any successor site.

(c) The Contractor may submit payment requests using other than IPP only when the Contracting Officer authorizes alternate procedures in writing in accordance with HHS procedures.

(d) If alternate payment procedures are authorized, the Contractor shall include a copy of the Contracting Officer’s written authorization with each payment request.

(a) Definitions.

Contracting Officer means a person with the authority to enter into, administer, and/or terminate contracts and make related determination and findings.

Ratification means the act of approving an unauthorized commitment by an official who has the authority to do so.

Unauthorized Commitment (UAC) means an agreement that is not binding solely because the Government representative who made it lacked the authority to enter into that agreement on behalf of the Government.

(b) Policy.

The Government is not bound by agreements with, or contractual commitments made to, prospective contractors by individuals who do not have delegated contracting authority. Unauthorized commitments do not follow the appropriate process for the expenditure of Government funds. Consequently, the

Government may not be able to ratify certain actions, putting a contractor at risk for taking direction from a

Federal official other than the contracting officer (see FAR 1.602-1) Government employees responsible for unauthorized commitments are subject to disciplinary action. Contractors perform at their own risk when accepting direction from unauthorized officials. Failure to follow statutory and regulatory processes for the expenditure of Government funds is a very serious matter.

(c) Procedure.

Any agreement, modification, or change to a contractual agreement made by a government personnel who lack authority will be deemed an unauthorized commitment. The Government is not liable to the

Contractor or under the terms of the contract, financially or otherwise – unless the unauthorized commitment successfully passes the ratification process.

The ratification process does not have any lead time, nor does the Government make any promise that an unauthorized commitment will be ratified and, therefore, the Contractor would be paid. The Contractor proceeds at its own risk if any of the terms of the contract are altered, changed, or modified without the written concurrence by a Contracting Officer.

Attachment A – Statement of Work

1. INTRODUCTION:

1.1. Kayenta Health Center (KHC) is located north of Arizona State Highway 160 at milepost 364.3, and the health care facility is located within the Kayenta Health Center campus. The KHC has five 600kw backup emergency generator with a Digital Master Control system (DMC) and five Automatic Transfer Switch (ATS). The project requires professional electrical and technical service to conduct on-site generator preventive maintenance (PM), load banking and Automatic Transfer Switch (ATS) operational inspection service.

2. BACKGROUND

2.1. The Kayenta Health Center (KHC) requires professional knowledge in Electrical Generating System Association. KHC provides comprehensive inpatient care, ambulatory care, dental care, preventive and community health services, and environmental health services for the community.

2.2. General: This performance-based work statement describes the requirements for conducting an on-site generator PM, load banking and ATS operational inspection services. The on-site generator PM services shall be provided in accordance with National Fire Protection Association (NFPA) 110(2016) and by a Power Technician certified by the Electrical Generator Systems Technician Certification Program as administered by the Electrical Generating Systems Association (EGSA).

2.3. Objective: For the provision of on-site generator PM, load banking and ATS operational inspection services, Kayenta Health Center facility to ensure that the emergency back-up generators are operating efficiently, safely and maintained to ensure operability when required for back- up services. Oil, coolant sampling on all engines and fuel sampling for all diesel engines.

3. PERFORMANCE DESCRIPTION:

3.1. Performance Based Statement of Work (PBSW): The Contractor shall provide all management, supervision, personnel, equipment, transportation, materials/supplies, minor parts and tools necessary to perform all on-site generator PM, load banking and ATS inspections and testing as warranted to meet code and per manufacturer’s requirements and recommendations for Kayenta Health Center. Contractor shall provide services in accordance with NFPA99 (2012) Healthcare Facilities Code, Chapter 6 Electrical systems (covers the performance, maintenance, and testing of electrical systems (both normal and essential) in health care facilities). The completed product must have fully functional system and reliable system.

3.2. The Contractor shall notify the Facility Representatives within a week after receipt of contract. Contractor shall notify Facility Representative in two weeks advance of actual PM.

3.3. This is a full-service contract to provide one (1) scheduled preventive maintenance services for generators and the operational inspections for automatic transfer switches (ATS). And, this contract also requires the Contractor to provide a two (2) hour load bank test. No minor repairs are included in this contract. Generators/ATS are required to be serviced within a year from previous service to meet the requirements of NPFA 110(2016) Services shall be provided as follows:

a) Preventive Maintenance (PM) shall be performed at listed below.

Cooling system:

Radiator/Heat Exchanger – visual inspection for leaks, damage and debris.

Coolant – visual inspection for correct levels and coolant condition. Check coolant concentration and temperature protection.

Hoses and connections – Visual of all hoses for deterioration.

Fan Belts – inspect for wear or deterioration. Check tension and adjust as necessary

Jacket water heater – inspect for proper operation.

Water pump – visual and operational inspection for leaks or unusual noises.

Fuel System:

Fuel tank – visually inspect fuel tank and level. Test day tank pump for proper operation.

Draw fuel sample and provide report; testing shall be per ASTM D975.

Water Trap/separator – drain water from fuel tank or water separator.

Fuel lines and connections – inspect for leaks.

Starting System:

Batteries – inspect for damage or leakage.

Batteries – specific gravity – check electrolyte level and specific gravity.

Battery charger – inspect for proper operation and deteriorated wiring.

Lube oil system:

Change engine oil & filter; draw oil sample and provide resultant report;

Visually inspect unit for leaks Air induction and exhaust system:

Inspect air filters as necessary; inspect for proper operation. Reset indicator. Note if needs replacement

Air inlet system – inspect piping and air filter housing

Turbo charger – inspect for oil leaks or exhaust leakage and unusual noises.

Exhaust manifold – inspect for leaks.

Operate engine/generator at no load and:

Check and record engine oil pressure, temperature values, check and record generator voltage for proper operation.

b) Automatic transfer switch (ATS) operational services shall be provided and ATS listing shall consist of:

Review of previous service records on ATS.

Perform visual inspection of all wiring; inspect condition of main auxiliary contact and visually Inspect relay finger contacts.

Visually Check all cables and/or control wire connections, all control circuit wiring terminals and check lug connection and mounting insulator bolts.

Clean and inspect and all voltage and frequency sensitive protective relays.

Clean interior of enclosure and remove accumulated dust/dirt.

Coordinate with the Facility Representative to obtain permission to conduct a transfer test with ATS test switch.

Consult with facility manager/electrical tech.
