PURPOSE

The contractor shall provide Operator Certification Training Services to the following Indian Health Service program:

Environmental Health Support Center (EHSC) Office of Environmental Health and Engineering (OEHE) Albuquerque Area Indian Health Service 4101 Indian School Rd NE Ste 225 Albuquerque, New Mexico 87110

Acquisition will be for a 12-month base year and four 12-month option periods for renewal.

DESCRIPTION OF SERVICES/SUPPLIES

The contractor shall be in accordance with all Federal, State, Local, Tribal and IHS regulations and shall be made with minimal divergence from the schedule established and with minimum disturbance and maximum protection of government personnel, property and general public.

Task 1: Operator Certification Program Management [Price Schedule Items 0001-0005, 1001-1005, 2001-2005, 3001-3005, and 4001-4005]

1.1 General Information and Contractor Qualifications

The purpose of the proposed requirement is to fund tribal operator certification services from an EPA authorized vendor. The Safe Drinking Water Act requires operators of certain public drinking water systems to hold certification approved by the agency which regulates the system. Furthermore, certification is required before a tribal water system can receive infrastructure funding from the US EPA under the Drinking Water State Revolving Fund Tribal Set-Aside program.

Operator certification is a scoring factor in the IHS Sanitation Deficiency System that impacts funding provided to tribes. Tribal operator certification promotes and enhances public health and safety by ensuring that tribal drinking water and wastewater operators have the knowledge and skills necessary to provide safe, adequate, and sustainable drinking water and sanitation services to tribal communities. The end goal is to increase the percentage of certifications held by tribal utility operators.

The Contractor shall be an EPA approved water certification program provider and maintain current authorization from the EPA to directly issue tribal water operator certification at levels 1-4 for distribution and treatment.

Contractor qualifications shall include:

Operator Certification Program Management

• EPA authorization to (1) operate a water operator certification program and/or (2) issue operator certifications to tribal operators

• A minimum of 5 years’ experience in running an operator certification program

• Established operator certifications for water operator (levels 1-4 distribution and treatment plus federal regulations), sewer operator (levels 1-4 collection and treatment plus federal regulations), and utility management

• An established database tracking certification status and applications for new certifications, renewals, and reciprocity

• An established operator certification lookup website page to allow the general public to search for their utility operators

• Capacity to process 700 new operator certifications annually in addition to reciprocity and renewal requests.

The initial contract targets 125 applications per year; however, additional work may be added to the contract depending on Contractor performance and funding.

• Ability to provide reports detailing the number of applications received per year broken out by new applications, reciprocity, and renewals for the past five years.

Certification Prep Training

• A minimum of 5 years’ experience in providing training and support to tribal utility departments or small rural communities. Tribal experience is preferable.

• Trainers with a minimum of 5 years’ experience with water and/or wastewater operations. Trainers with operator certifications equal to or greater than the training level being taught is preferred.

• Trainers with a minimum of 5 years’ education and experience teaching adults. Familiarity with ATLAS learning styles preferred.

• Experience working with grants and/or contracts with Federal agencies. Indian Health Service and/or Environmental Protection Agency experience is preferred.

• Capability to provide demographic statistics including tribal affiliation, EPA region, and IHS Area affiliations of certification applicants and training course attendees.

1.2 Manage Operator Certification Program

Review and process tribal operator certification applications for new, renewal, or reciprocal certifications for water (Levels I-IV for distribution and treatment), wastewater (Level I-IV for collection and treatment), utility management, federal regulation, and others as developed by Association of Boards of Certification (ABC) and the Inter-Tribal Council of Arizona (ITCA) using industry standards (based on psychometric analyses for exam development and in partnership with the EPA.) Contractor should contact ABC and ITCA to develop agreements to utilize their certification exams. Note that this may involve additional fees that should be included in the cost of the program management line items.

For applicants not attending certification training courses sponsored through Contractor, schedule and proctor ABC and ITCA exams either in person or via an electronic testing system such as computer based testing (CBT). Provide all services funded by this contract at no charge to operators of tribal water and/or wastewater systems.

1.2.1 Operator Certification Informational Website and Support Provide a 508 compliant website for the public to access operator certification exam applications, study guides for each certification level available, and other resources including training calendar, training synopsis, and available operator summits/workshops. Webpage should include contact information for questions and be available for access 24 hours a day, 7 days a week, and 365 days a year with the exception of standard network maintenance. Website should not be down more than 4 days per contract period of performance unless otherwise approved by the contracting officer and/or contracting officer representative.

Provide support and guidance to applicants to assist them in getting through the application process. Work with applicants to ensure that all paperwork is filled out correctly and required documentation is submitted. Attempt to engage unresponsive applicants at least two times before archiving or closing their file.

1.2.2 Operator Certification Database/Files

Maintain a secure database for tribal operators obtaining certification to include, at a minimum, operator name, address, date certified, level of certification achieved, and certification status.

Maintain files (electronic and/or hardcopy) of all operator certification applicants. Files shall include, at a minimum, application documents, training certificates, and relevant correspondence. Summary data reports from the database (e.g., total number of application requests received, demographics of applicants, number of applicants receiving certifications with EPA regional demographic filters/sorts) for the entire contract period of performance shall be provided to the government upon request.

1.2.3 Annual Operator Workgroup Meeting

Coordinate a minimum of one tribal operator workgroup meeting or summit per contract year in a location that is accessible to the majority of the participants. Coordination shall include notifications/advertising, procurement of venue, meeting agenda, meeting objectives, and consultant/speaker fees and arrangements. Provide IHS a document summarizing the meeting outcomes and attendee evaluations within 30 calendar days of event completion.

1.2.4 Annual Program Advisory Committee Meeting

Coordinate one annual program advisory committee meeting per contract year in a location that is accessible to the majority of participants. Coordination shall include notifications/advertising, procurement of venue, meeting agenda, meeting objectives, and consultant/speaker fees and arrangements. Provide IHS a document summarizing the meeting outcomes within 30 calendar days of event completion.

1.2.5 Contract Coordinator and Communication Protocols

Provide a contract coordinator/Project Manager to serve as the contact person between the Contractor and the IHS.

The contract coordinator shall be available for a two-hour monthly coordination call with the primary and/or alternate COR and other tribal or federal stakeholders to discuss upcoming events, successes, and challenges with the items identified in the contract. Additional coordination calls may occur as required to facilitate trainings or other project management issues.

The Contractor shall acknowledge receipt of e-mail or phone requests from the COR or designee within two working days and provide timeframe for official response if request cannot be addressed immediately.

If the contract coordinator is not available for a time period exceeding 10 business days, designate an alternate contact and provide contact information to the COR a minimum of five calendar days in advance.

1.2.6 Reporting Requirements

Submit a report to the COR documenting the following operator certification program management activities with each invoice containing operator certification charges:

1. Number of applications received broken out by new, renewal, and reciprocal

2. Number of operators certified broken out by new, renewal, and reciprocal

3. Demographic information for each application and certification including, but not limited to:

a. Operator name

b. Tribal Employer affiliation

c. IHS Area affiliation

d. EPA Region affiliation

e. Employer address

f. Certification level requested or achieved

1.3 Method and Measurement of Payment

Payment for items 0001 – 0005, 1001 – 1005, 2001 – 2005, 3001 – 3005, and 4001 - 4005 will be as follows:

Basis of Payment: Includes all work described in part 1.2 above. Includes all labor, materials, equipment and incidentals required to complete the work. Items ending in 01 will be used for the first 125 water specific operator certification applications received; items ending in 02 will be used for all additional water operator certification applications; items ending in 03 will be used for the first 25 sewer specific operator certification applications received; items ending in 04 will be used for all additional sewer operator certification applications received; items ending 05 will be used for all other certification applications (e.g., utility management).

Example: Contract with options awarded to support 160 water operator certification applications, 30 sewer operator certification applications, 50 lagoon operator certification, and 50 utility management certification applications:

Note that lagoon operator certifications would fall under the wastewater operator certification line items as it is specific to sewer.

End SOW Task 1

Task 2: Operator Certification Trainings [Items 0006-0020, 1006-1020, 2006-2020, 3006-3020, and 4006-4020]

2.1 General Information

The Contractor shall furnish all labor including experienced instructor(s), materials, equipment, supplies (including COVID-19 prevention supplies), venue, and incidentals necessary to provide operator certification trainings for up to 30 operators per training.

The target audience for the trainings is tribal utility operators. Utilize various learning methodologies to establish an appropriate learning environment for adult learners based on ATLAS learning styles including engagers, problem solvers, and navigators (http://www.conti-creations.com/atlas.htm.) Assume all learning styles will be present and assume an 8th grade education level for training attendees.

All trainers shall have at least 5 years’ experience in the industry (water and/or wastewater depending on the training), maintain a certification level equal to or higher than the course they are instructing or be identified as a subject matter expert (e.g., registered professional engineer), and be well versed in adult education best practices with prior experience teaching adults. Instructors with experience teaching Native American utility operators is preferred. Provide current resumes of course instructors to the COR at the beginning of the contract and as new instructors are identified. Provide all trainings and certification exams funded by this contract at no charge to operators of tribal water and/or wastewater systems.

Training venues shall conform to CDC and OPM COVID-19 prevention recommendations and have enough spacing to accommodate 6-foot separation between attendees (if local or federal guidelines require.) Additional training space restrictions may be imposed as additional best practices are identified. If guidelines result in significant cost increases, the government or Contractor and Government may negotiate an adjustment in line item costs, a reduction in the number of training seats, and/or change from blended or in-person trainings to 100% virtual.

2.1.1 Course Scheduling

The COR shall send the Contractor a request for classes via email that includes the course title, location, format (blended, virtual, in-person), and proposed dates as needs are identified throughout the contract period of performance.

The Contractor shall provide notification of availability or propose alternate dates to the COR within two weeks (or alternate timeframe as approved by the COR).

It is anticipated that the government will be ordering an estimated 5-15 trainings per year with the potential for additional trainings as more funding partners become involved in this contract.

2.1.2.1 Certification Preparation Training Courses

Provide training courses to prepare operators to take the following nationally available Association of Boards of Certification (ABC) certification exams and Inter-tribal Council of Arizona (ITCA) developed certification exams or maintain their certification credentials:

• water distribution and treatment levels 1-4 including federal regulations (ABC/ITCA), minimum 48 training hours

• wastewater collection and treatment levels 1-4 including federal regulations (ABC/ITCA), minimum 48 training hours

• utility management (ITCA), minimum 48 training hours

• lagoon operation (currently in development by ITCA), minimum 36 training hours

• federal regulations certification prep – water or sewer (ITCA), minimum 36 training hours

• federal regulations workshops – water or sewer (ITCA), minimum 8 training hours

• operator math, minimum 24 training hours

• safe drinking water act topics, minimum 24 training hours

Course duration minimums are defined in the list above. The training course may exceed the minimum duration requirement at no additional expense to the contract. With concurrence from the COR, training courses may also be modularized such that while the minimum required number of instruction hours are offered, students may elect to take any combination of the available modules.

Course content should align with some (for specialized classes) or all (for certification preparation classes) ABC and ITCA published Need to Know Criteria (available at http://www.abccert.org/testing_services/need_to_know_criteria.asp and www.itcaonline.com (pending)) and include a list of learning outcomes for each lesson/module.

Each course offered shall include the opportunity for attendees to take certification exams (operator and federal regulation) at the conclusion of the training course. Contractor will need to enter into agreements with ABC and ITCA to determine the exam execution requirements and exam access fees.

2.1.2.2 Utility Tune-Up

Utility Tune-Ups shall consist of a minimum one-day in-person workshop for all utility stakeholders including, but not limited to, tribal leadership, administrators, utility board members, utility staff, billing departments. The purpose of the workshop is to identify program strengths and weakness in order to improve utility operations.

The workshop shall, at a minimum, include:

- Content aligned with effective utility management concepts identified by a multi-agency task force lead by the

US EPA and USDA in 2007.(https://www.watereum.org/)

- Anonymous survey of stakeholders to obtain feedback on their perception of technical, managerial, and financial aspects of their utility operations based on the ten attributes of effective utility management (https://www.watereum.org/wp-content/uploads/2017/04/Effective-Utility-Management-A-Primer-for-Water-and-Wastewater-Utilities.pdf)

- Analysis of stakeholder responses

- Discussions and recommendations for focal areas within the ten attributes

Provide a minimum of eight hours of additional technical support to aid the utility in the development of an improvement plan based on the results of the workshop. Additional hours may be provided at the Vendor’s discretion at no additional cost to the contract.

2.1.3 Course Format

Courses shall be either Blended, In-Person, or Virtual. The format of the course will be identified in the course scheduling request and in the task order.

Blended trainings shall consist of a combination of approximately five 3 to 4 hour virtual training sessions and a 4.5 day in-person training for a minimum of 48 training hours unless otherwise approved by the COR.

In-person trainings shall consist of a full day or multiple consecutive day(s) depending on the training course duration.

Unless otherwise approved, classroom sessions shall start at 8:00 am local time and end by 5:00 pm with a 60 minute lunch break plus morning and afternoon breaks based on the attention level of the attendees. The instructor shall be available for questions a minimum of 30 minutes after the end of each class day. Variations beyond incidental occurrences to this are subject to approval by the COR.

Virtual trainings shall consist of sessions no longer than 4 hours per day and include breaks totaling no more than 30 minutes per day for a minimum of the equivalent hours for blended or in-person courses unless otherwise approved by the COR. Virtual sessions shall start no earlier than 8 am Pacific Time and end by 2 pm Pacific Time. Sessions shall occur on alternating days (e.g., Tuesdays/Thursdays or Mondays/Wednesdays/Fridays) to allow operators to balance utility operational needs with training. Variations may be approved by the COR if requested.

2.1.4 Classroom Venue/Locations

Training location to be selected based on training need and funding source requests and may be located anywhere in the continental United States. The Contractor shall provide the training venue and training platform at no additional cost to the contract.

Blended Classes: Refer to paragraphs below for each applicable component of the blended learning format.

In-Person Classes: The venue shall be large enough to comfortably accommodate a minimum of 40 people (including participants, trainers, and support staff, and government observers.) Training rooms shall have adequate lighting, temperature control, and sound levels. Unless otherwise approved by the COR, training facilities shall be located within walking distance of lodging and restaurants.

Virtual Classes: Provide all training participants access to a web based training platform such as Go To Meeting, WebEX, Adobe Connect, Zoom, or other equivalent platform that allows access for up to 40 users to connect concurrently over the internet. The Contractor shall be able to be on live video and share their desktop for viewing as well as change presenters to allow others to share their desktop. The platform shall also include the ability to provide written comments (AKA chats) and share files. The Contractor shall provide a toll free conference phone number for the session audio. Audio via microphone only will not be accepted as many users do not have access to microphones at their workstation.

2.1.5 Pre-Course Review Form

Using the form provided by the COR, for every training course (including the utility tune-up), document each lesson/module with unit/module name, duration (in minutes), content description and/or purpose, learning outcomes, SF-1449 continued, page 10 of 33 instructional materials used, method used along with the learning styles that are accommodated with this method, assessment method and performance criteria, and applicable notes.

Provide documentation for each course to the COR for approval within four weeks of the beginning of each contract year. If modifications are made to the course during the contract year, provide copies of the revised Pre-Course Review Form to the COR within two week of completion. The government will review the submitted documentation, and if required, provide a written request for revisions within 14 days of receipt. Final revised documentation shall be provided within 14 days of requested revisions.

2.1.6 Training Agendas, Outcomes, and Evaluations

Provide training agendas detailing module titles and times, course objectives, and evaluation forms to the COR for each training course ordered for the contract. Outcome should comply with the Bloom’s Taxonomy of Learning Model and address the Certification Need to Know Criteria.

Provide a copy of each course’s agenda to the COR for approval within four weeks of the beginning of each contract year. The government will review the submitted documentation, and if required, provide a written request for revisions within 14 days of receipt. Final revised documentation shall be provided within 14 days of requested revisions.

2.1.7 Equipment

Provide all equipment including, but not limited to, training platform, demonstration equipment, computers, projectors, screens, microphones, writing utensils, highlighters, and note paper required to execute the training course.

2.1.8 Reference Materials

Provide book bound, spiral bound, or three ring binder reference manuals for attendee of the training session to include exercises to be completed during the course and reference material for future use. The reference manual shall be provided to attendees at the start of each course.

If requested, provide the COR a copy of the training course materials for review.

For In-Person Trainings: If reference manuals are more than 2-inches thick or otherwise untenable for a student to pack home, provide shipping of manuals to each attendee’s work location at the end of each training course for delivery within 7 business days.

For Virtual Trainings: Ship training materials to participants approximately one week prior to the start of the course to ensure that attendees have the manuals for the first session.

For Blended Trainings: If the first session of the class is in person, refer to In-Person instructions above. Otherwise refer to Virtual Training requirements in this paragraph

2.1.9 Registration

Registration shall be completed utilizing an electronic based system that can produce rosters that include names and contact information.

If the Contractor does not have an existing system, they shall utilize the EHSC training website to enroll each IHS sponsored course attendee. Attendees should be registered at least 15 days in advance of the training; however, for virtual trainings, if there are unoccupied seats, the EHSC will continue to accept registrations up to the day of the training.

The EHSC will provide the contractor with a copy of the EHSC course roster approximately 5 days prior to the start of the training course.

2.1.10 Training Certificates

Provide training certificates to each attendee and a copy of the training certificate to the EHSC training coordinator within 14 calendar days of the completion of the training course. Certificates to include, at a minimum, the course name and date, the sponsor name (e.g., the training consult organization), and a signature from an authorized individual certifying the attendee’s participation in the course. Contractor shall use 100% postconsumer fiber paper products. Certificates shall also include continuing education units (CEUS), professional development hours (PDH), or contact hours if attainable and applicable.

2.1.11 Training Class Evaluation and Closeout Documentation

Provide class evaluations to each training attendee to fill out at the completion of the course. Submit copies of the original course evaluations and a scoring summary/average with summarized comments for each class to the EHSC Training Coordinator as part of the closeout documentation package. Substantial student complaints or concerns regarding the course content, method or instructor shall be addressed immediately by both the contractor and IHS.

Unacceptable aspects of any training session as measured by at least two subject matter categories receiving an average score of less than 2.5 on a 5 point scale may be subject to a reduction in pay under 52.212-4 (a) Inspection: or if repeated failure to improve, 52.212-4 (m) Termination for Cause.

Definitions:

2.1.2.1 Substantial – Average student evaluation scores for any given line item less than 2.75 out of a point scale of 1-5 with 5 being the highest score.

2.1.2.2 Unacceptable - Average student evaluation scores for any given line item less than 2.0 out of a point scale of 1-5 with 5 being the highest score.

Provide training closeout documentation including the filled out sign-in sheet, individual evaluation responses with an evaluation summary, and course attendee demographics (including attendee name, Tribal affiliation, EPA region affiliation, and IHS affiliation) to the COR. Closeout documentation shall be submitted within 14 calendar days of the completion date of the training or with the invoice, whichever is sooner.

2.1.12 Operator Exams Associated with Training Events

In-person testing sessions for both the operator certification exam and federal regulatory exam shall be made available during the training week for all in-person courses (includes blended and in-person trainings) sponsored through this contract. Provide exam booklets, proctor(s), and exam processing to attendees that have registered to take a national operator certification exam and/or a federal regulatory exam (for water and wastewater courses). All testing procedures shall be in accordance with ABC and ITCA testing requirements.

2.1.13 Non-Student Classroom Observers

Non-student classroom observers: Each session (with the exception of the exam itself) may have one or more IHS or other federal agency non-student observers with technical background in the subject matter that may provide incidental input or assistance but will not materially interfere with conduction of the course or alter the terms and conditions of the contract. The CO, COR or a designated inspector may observe a session at any time.

2.1.14 Instructor/Class Facilitator Travel

Travel costs, including transportation, lodging, subsistence, and incidental expenses incurred by the contractor's personnel or consultants while in a travel status in connection with the performance of services required by this contract shall be considered as part of the unit cost for each class. The parties recognize that it may be necessary to cancel or

Where rescheduling or cancellation was due to unforeseeable cause(s) beyond the control and without fault or negligence of the Contractor, penalties imposed by airlines or other travel related services shall be treated as allowable reimbursable costs under this contract.

It is the sole responsibility of the Contractor to collect and pay for all New Mexico State Gross Receipt Taxes for business/work performed in the State of New Mexico, regardless of county the business/service/work was performed. As

SF-1449 continued, page 18 of 33 an independent Contractor; billing and collecting for the federal, state and other local city/county taxes is the burden of the Contractor, this includes the New Mexico Gross Receipt Taxes (NMGRT) for services provided in any county of the State of New Mexico. The Contractor's price/cost for services under this contract should include all applicable taxes for Internal Revenue Service (IRS), State of New Mexico Taxation and Revenue agency and/or other revenue agencies. The Indian Health Service will not withhold taxes nor will it issue a W-2 to the contractor.

EVALUATION FACTORS:

To be considered for award of a contract under this solicitation, the offeror must comply with the following criteria. Failure to provide evidence of the following shall automatically disqualify an offeror from further consideration. The following responsibility factors will be used as a basis for the technical evaluation of offeror’s quotes. The contractor shall meet the technical requirements, possess the required experience and provide Point of Contacts for any government contracts and DUNS number for the following:

1. Technical Approach

a. The offeror’s quote will be evaluated on how the offeror describes, in sufficient detail, the offeror’s technical capability and approach to meeting the specified requirements as outlined in the SOW. This includes the offeror’s demonstrated ability to provide appropriate staffing levels, supervision, communication, past experience providing similar services in size and scope to those contemplated here, and the firm’s credentials and qualifications. This also includes draft training course agendas, outcomes, instructional materials used, and assessment methods for the requisite trainings as well as resumes for the key personnel assigned to the project containing information on the requisite knowledge, education, skills, background, work experience, and specific professional or technical accomplishments to be evaluated. Merely repeating the contract requirements and stating that they will be accomplished, without discussing how the offeror will accomplish them, is not acceptable.

2. Past Performance

a. A minimum of 3 past performance surveys will need to be included with your quote to fulfill this requirement from past jobs in likeness and scope.

3. Price

RELATIVE IMPORTANCE OF EVALUATION CRITERIA

Factors 1-2, when combined, are significantly more important than price. The award will be made on a best-value basis;

both price and other factors considered. The Source Selection Team will evaluate the technical aspects; the contracting officer will evaluate the pricing.

CONTRACT OFFICER REPRESENTATIVE (COR)

Shari Windt, 505-256-6805, is hereby designated as Contract Officer’s Representative for this service. The Contract Officer Representative responsibilities will be to coordinate with the contractor the technical aspects of this service and the review of performance hereunder. The Contract Officer’s Representative does not have the authority to change or alter the order amount, terms and conditions.

The Contract Officer’s Representative responsibilities include ensuring contractor accountability, monitoring the contractor's technical progress- including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirements, interpreting the statement of work, performing technical evaluations as required, performing technical inspection and acceptance required, assisting the contractor in the resolution of technical problems encountered during performance and receiving and processing invoices for payment.
