STATEMENT OF WORK

FEDERAL LAW ENFORCEMENT TRAINING CENTERS

INVESTIGATIVE OPERATIONS DIVISION

GENERAL INVESTIGATIVE SKILLS BRANCH

INTERNAL AFFAIRS INVESTIGATIONS TRAINING PROGRAM

I. INTRODUCTION

The Federal Law Enforcement Training Centers (FLETC), Investigative Operations Division (IOD), offers a 4 ½-day advanced training program, the Internal Affairs Investigations Training Program (IAITP), to its more than 95 Partner Organizations to provide specialized training to Special Agents and other Law Enforcement Investigators assigned to conduct internal investigations. The IAITP is designed to provide specialized training to Special Agents and other law enforcement investigators assigned to conduct narrowly defined, sensitive and often times high profile internal affairs investigations.

II. SERVICES REQUIRED

Guest Lecturer: This program requires that the selected contractor provide a guest lecturer with subject matter expertise in federal personnel/labor relations law.

The lecturer provided shall be the same lecturer throughout the contract.

Location: The IAITP will be held at FLETC, Glynco, Georgia.

Class Size: 22 Students.

Time Period: This is a (4) four and (½) one half day training program which runs on a schedule of 8:00AM – 5:00PM, Monday through Thursday, and 8:00AM – 12:00PM on Friday.

Type of Contract: This will be a firm-fixed price contract, with a base plus three option periods.

The Period of Performance: October 1, 2022 – September 30, 2026.

III. GUEST LECTURER’S EXPERIENCE

The guest lecturer must have a Juris Doctorate degree from an accredited law school, be a licensed, active member in good standing of the bar of a state and admitted to practice before the highest court of the state of licensure. Additionally, the lecturer must be currently admitted to practice before a United States District Court and a Federal appellate court.

The guest lecturer should have extensive experience in representing federal managers, federal employees, and law enforcement officers before agencies, in criminal and administrative investigations, in hearings/trials before the Merit Systems Protection Board (MSPB), the Equal Employment Opportunity Commission (EEOC), and in U.S.

District Court, and in assisting clients in defending security clearance revocation and adverse suitability determinations (The Defense Perspective).

The guest lecturer will be representing the “defense perspective” and must have at least 10 years active hands-on experience and expertise in defending federal managers, federal employees, and law enforcement officers from a wide array of federal agencies, in criminal, civil, and administrative investigations. That experience and expertise must include serving as primary counsel on work involving client consultations; representation during investigative interviews; review and analysis of administrative and criminal charging documentation; formal and informal negotiations with agency counsel and federal prosecutors; case investigation and preparation; motion practice; defense of law enforcement officers in Bivens/§1983 actions; interaction with professional liability insurers; assisting clients in defending security clearance revocation and adverse suitability determinations; and litigation in hearings before the MSPB, the EEOC; trials in U.S. District Court; and the briefing and argument of appeals.

The guest lecturer must also have at least 10 years’ experience in developing and delivering instructional presentations on internal affairs investigations from the “defense perspective” to federal law enforcement internal affairs investigators in an understandable form, which is directly related to the conduct of those investigations. The presentations must relate to and reinforce the teaching points of various other courses within the IAITP curriculum, to include: due process in administrative investigations, investigator integrity and objectivity, disclosure of investigative reports and findings, and implications of the 4th and 5th Amendments to internal affairs investigations. The guest lecturer shall use specific cases and examples which illustrate those teaching points and focus upon the rules and best practices governing employee conduct/internal affairs investigations, the burden of proof and elements of administrative offenses, the role of agency officials and the MSPB in evaluating investigations, common mistakes made in investigations, and the impact of investigative errors on case outcomes and investigator personal liability.

IV. CANCELLATION POLICY

Due to the nature of the law enforcement training environment, the FLETC reserves the right to cancel services ten (10) or more business days prior to the start date of each training program without any compensation to the service provider. Procurement will award the contract based on all the requirements and qualifications based on this Statement of Work.

V. COSTS

The guest lecturer will travel to the FLETC, Glynco, Georgia, and deliver a 7-hour presentation for each IAITP scheduled for the fiscal year. This session is typically scheduled on Thursday 1:00PM – 5:00PM and Friday 8:00AM – 11:00PM.

All instructional costs, travel costs, lodging, and per diem are borne by the guest lecturers and must be incorporated into a flat rate fee per scheduled iteration. The lecturer must be available on the date and time of the scheduled IAITP courses. The FLETC will not reschedule programs based on unavailability of the lecturer.

The interest rate shall be the interest rate established by the Secretary of the Treasury as provided in 41 U.S.C. 7109, which is applicable to the period in which the amount becomes due, as provided in (i)(6)(v) of this clause, and then at the rate applicable for each six-month period as fixed by the Secretary until the amount is paid.

(ii) The Government may issue a demand for payment to the Contractor upon finding a debt is due under the contract.

(C) The Contractor requests a deferment of collection on a debt previously demanded by the Contracting Officer (see 32.607-2).

(iv) If a demand for payment was previously issued for the debt, the demand for payment included in the final decision shall identify the same due date as the original demand for payment.

(v) Amounts shall be due at the earliest of the following dates:

(A) The date fixed under this contract.

(B) The date of the first written demand for payment, including any demand for payment resulting from a default termination.

(vi) The interest charge shall be computed for the actual number of calendar days involved beginning on the due date and ending on-

(vii) The interest charge made under this clause may be reduced under the procedures prescribed in FAR 32.608-2 in effect on the date of this contract.

(j) Risk of loss. Unless the contract specifically provides otherwise, risk of loss or damage to the supplies provided under this contract shall remain with the Contractor until, and shall pass to the Government upon:

Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges the Contractor can demonstrate to the satisfaction of the Government using its standard record keeping system, have resulted from the termination. The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor's records. The Contractor shall not be paid for any work performed or costs incurred which reasonably could have been avoided.

In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.

(o) Warranty. The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.

(p) Limitation of liability. Except as otherwise provided by an express warranty, the Contractor will not be liable to the Government for consequential damages resulting from any defect or deficiencies in accepted items.
