C - Description/Specifications
Performance Work Statement (PWS)
Legal Advocacy Training Program
PART 1 General Information
1.1. Description of Services/Introduction:
The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and non-personal services necessary to perform specified training as defined in this Performance Work Statement, except as Specified in section C-3 as government furnished property and services at various locations. The contractor shall perform to the standards in this contract.
1.2. Background:
DOL is an Executive Branch agency of the Federal Government primarily responsible for fostering and promoting the welfare of job seekers, wage earners and retirees of the United States. The Department’s mission includes improving working conditions, advancing opportunities for profitable employment, protecting retirement and health care benefits, helping employers find workers, strengthening free collective bargaining and tracking changes in employment, prices and other national economic measurements. In carrying out this mission, the Department administers and enforces more than 180 Federal labor laws, including those that guarantee workers’ rights to safe and healthful working conditions, a minimum hourly wage and overtime pay, freedom from employment discrimination, unemployment insurance and other income support. These mandates, and the regulations that implement them, cover many workplace activities for about 10 million employers and 125 million workers.
SOL provides legal advice and litigation services to the Secretary of Labor, thereby fostering and promoting the welfare of the Nation’s job seekers, wage earners and retirees. SOL helps to ensure that the Nation’s labor laws are enforced, with appropriate emphasis on the Secretary’s priority initiatives, by defending the actions taken by the Secretary and the program agencies of the Department. SOL represents the Secretary and DOL program agencies and entities in all necessary litigation, including enforcement actions, defensive litigation, and alternative dispute resolution activities; assists in the development of regulations, standards, and legislation; and provides legal opinions and advice. Finally, SOL monitors program agency activities and provides legal advice to ensure that DOL employees and program agencies comply with applicable laws and regulations.
SOL is an office of approximately 500 attorneys nationwide. Both in the national office and in the regions, numerous SOL attorneys and support staff are involved in litigation.
1.3. Objectives:
The Contractor shall provide, in accordance with the requirements specified herein, all resources necessary to provide the following legal advocacy training program (Training Program):
• The development of a mock case file suitable for use in trial advocacy programs that cover a full range of advocacy skills specifically developed for or by DOL attorneys based on typical DOL litigation.
• Development and presentation of comprehensive legal advocacy training programs (Trial Advocacy, Appellate Advocacy, Persuasive Writing, Deposition Skills, etc.) that involve interactive seminars and learn-by-doing sessions using training materials specifically developed for/or by SOL attorneys based on typical DOL litigation. Programs cover a full range of trial advocacy skills, including pre-trial preparation such as case analysis, investigations, written discovery, taking and defending depositions, and motions practice; in courtroom presentation, including opening statements, direct/cross examination of lay and expert witnesses, handling documentary evidence, making and meeting evidentiary objections, and closing arguments; other advocacy skills such as writing persuasive motions and briefs and preparing and conducting settlement negotiations/mediation and/or alternative dispute resolution; and handling appeals, including appellate brief writing and oral argument.
• Development and presentation of coaching and mentoring programs that teach supervisory and senior attorney techniques and methods for effectively instructing, critiquing, and providing constructive feedback to attorneys regarding all phases of advocacy skills.
• Development and presentation of training programs that instruct legal professionals, in an interactive way, on the effective use of technology (trial software, etc.) as an integral part of trial advocacy, including pre-trial work such as the taking of depositions and preparation of witnesses, and presentation of evidence in judicial proceedings.
1.4. Scope:
The Department of Labor is seeking a Contractor to deliver a Legal Advocacy Training Program for the Office of the Solicitor (SOL) that consists of legal training, products and related services in support of SOL’s mission nation-wide. Given the scope of SOL’s responsibilities in providing legal services to DOL, the training covered will be broad and will include, but not be limited, the full range of trial advocacy and advocacy related training involving all phases of litigation (from pre-trial work through appeals, negotiations training and training in writing skills). It will include the development of a mock case file that will be used and modified for all training as appropriate. The Contractor shall provide products, services, and any equipment/materials required to successfully perform and deliver the work defined in this SOW and as authorized and required in the specific Task Order(s) issued under the contract for the delivery of a specific training event. The Contractor may be asked to provide different types of trainings, within the scope of this SOW, to cover the various offices and locations. For example, the contractor may be asked to provide training to individual offices on specified topics or to provide training via VTC/Webex/Teams/Zoom to different offices.
The Contractor will facilitate and implement the Training Program to be presented for SOL legal staff that will focus on developing the trial and advocacy skills necessary for effective presentation. The Training Program will provide sufficient material for participating SOL attorneys to represent either plaintiff or defendant without a pre-decided outcome.
The Contractor shall provide SOL with one hard copy of the Course Materials – Mock Case File and selected reference book -- per participant in advance of each training.
The Contractor shall arrange for the selection of a communications specialist to attend a training course as requested by SOL.
The Contractor shall provide an on-site administrator for every live in-person training course at no additional cost to SOL.

The Contractor shall provide an on-site administrator for each of the negotiation training that will occur in each of the regions and the one negotiation training in the National Office. The Contractor will coordinate with each office before and during the course to ensure that the event runs smoothly providing technological, logistical and other support and troubleshooting services.

Per TFM Vol 1, part 4A, Chapter 200: Section 2055—Electronic Invoicing, Invoice Processing Platform (IPP)
Federal entities should consider using electronic systems and processes to streamline and improve efficiencies in government invoicing. IPP’s modular design allows federal entities to implement functionality in phases, according to their business needs. Federal entities use IPP to send electronic purchase orders to vendors, to receive electronic invoices from vendors, and for invoice routing and approval workflow. IPP uploads payment remittance information from Treasury and non-Treasury disbursed federal entities, allowing federal entities and their suppliers to view and download payment information.
A. The following instructions apply to Invoices submitted through IPP.Gov or the DOL Quickpay email system:
