This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with FAR part 13.5 and additional information included in this notice. The Bureau of Reclamation intends to award a Firm Fixed Price Purchase Order in response to this solicitation. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued. This requirement is being set aside 100% for Small Businesses. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-02 as of 03/16/2023.

Performance Work Statement
PART 1 - GENERAL
1.01 OVERVIEW
The Technical Service Center’s (TSC) Hydraulic Investigations and Laboratory Services group apply hydraulic modeling, analysis, and field-testing expertise to solve a variety of water resources, hydraulics, and fluid mechanics problems. Large, scaled models of stilling basins, gates and valves, spillway and spillway erosion models, etc, are constructed to assist and analyze real time situations. Water to run the models is recirculated through a 240,000-gallon sump and is continuously treated with ozone to disinfect the recirculated water. The current system is over 30 years old and has exceeded its 20-year design life. Over the past 13 years periodic maintenance has been keeping the existing equipment operational. Recently, the company that manufactured the original equipment and provided the replacement parts for both degraded and consumed components closed its doors. No alternative source was provided to source replacement parts or consumables. The existing system is currently operating at half capacity and is unable to be repaired.
The existing system in comprised of 1 ozone generation station with 24 UV ozone tubes that feed four water discharge locations and 4 air sparger locations in the laboratory sump. The system also includes two sand filters (can stay), two variable speed pool pumps (can stay), six air pumps (can stay), and the associated PVC piping to deliver the air and water ozone to the laboratory sump. All the equipment is housed in a 10-ft x 20-ft space. The ozone generation is a small subset of this and should fit within a 4-ft x 5-ft x 7-ft (l x w x h) space.
The Purchase Request is for a replacement for the existing ozone system. Any components that can be re-used (filters and pumps) are encouraged where possible.
1.02 SUMMARY
A. Replace existing Ultraviolet (UV) type ozone generation system with two (2) corona discharge type ozone generation units. Design basis has a total water volume of 240,000 gallons and a circulation rate of 200 gpm (Dual 100 gpm filtration loops). Each filtration loop will have independent ozone injection production and injection skid mounted equipment. Each ozone system will monitor water ORP (oxidation reduction potential) and control ozone to a desired operator setpoint.
B. Ozone design requires a 0.42 mg/L to each 100 gpm filtration loop flow. Each ozone injection system shall have dissolution tank, off gas collection and off gas destruction of ozone prior to sending the flow back to the filtration line. No bubbles shall be recirculated or directed back to the process.
C. Contractor shall remove and dispose off-site existing UV equipment, replace with new ozone equipment
(two skids) and integrate into existing PVC plumbing configuration. Provide each ozone unit with integrated isolation valves.
D. Contractor is responsible for full electrical integration from Connect power to existing breaker panel in compliance with local and federal codes as required.
E. Submit technical information, build, test, deliver, install, and provide written warranty for the equipment of at least once year from acceptance.
F. Ozone gas generator shall have off-gas destruct device, ambient ozone monitoring, safety equipment, and other related equipment as specified herein.
G. Install one Ambient Ozone Monitor external of the ozone generators at the ozone injectors/contactors. Provide a remote alarm panel for visual indication of an ozone fault occurrence along with signage indicating ozone leak detected.
H. All equipment shall be in conformance with all local, state and federal codes, statutes and ordinances, including required Underwriter Laboratory (U.L.) approval.
I. A virtual site visit prior to quote submission is recommended although not required to confirm any questions or design verification of existing and desired new ozone equipment. A virtual site visit will be coordinated through Microsoft Teams. Email ebradford@usbr.gov to request an invitation to the Teams virtual site visit.
The virtual site visit will be scheduled for Tuesday, June 6, 2023, at 1:00pm MT.
J. All equipment shall be new and not reused equipment.
1.02 QUALITY ASSURANCE
A. Manufacturer's Qualifications: The manufacturer shall have at least 20-years of experience in the manufacturer, testing, and successful installations of ozone gas generators.
1.03 DELIVERABLES
A. Manufacturer’s product information and data including capacities, flow rates, name of sub-component manufacturers and model numbers and dimensional drawings of packaged equipment. Dimensional drawings shall include accurate scale drawings of the equipment being supplied with detailing of locations of the components, all major dimensions including overall width, length, height, bolt hole locations for mounting, electrical connections, total weight and nozzle sizes and connections.
B. A complete summary of electrical current draws. Provide complete schematics, complete description of operation, control schematics including coordination with other electrical control devices.
C. List of connection terminations for all interlocks and electronic inputs and outputs (I/O).
D. List of typical maintenance parts and supplies for the ozone generator with price schedule.
E. Provide one complete set of maintenance parts and supplies for each generator.
F. Commissioning test report verifying ozone output in grams per hour and weight percent of installed equipment.
G. Description of startup procedures.
H. Before installation, contractor shall submit layout of equipment for review and coordination of the site conditions including all connections to existing structure and building systems.
I. 3-year dielectric warranty
1.04 GUARANTEE & WARRANTY
A. The supplier shall guarantee all equipment to be free from defects in manufacturing, workmanship or materials, and shall repair or replace defective equipment within 1-year from date of delivery.
B. The dielectrics shall have a non-prorated 100% warranty for 3-years for failure of any dielectric, for any reason other than breakage by mischievous physical tampering, the supplier shall deliver new dielectrics to the Owner within 24 hours.
1.05 FACTORY START-UP ASSISTANCE AND TRAINING
A. Start-Up & Training Seminar:
1. Startup Assistance: Supplier shall provide a minimum of two working days, of factory trained technician to assist in the installation and start-up, and to inspect, calibrate and start-up the equipment.
2. Training: Manufacturer's factory personnel to give complete formal seminar on the fundamentals, routine operation, standard maintenance, and rebuilding instruction demonstrations for the ozone generator. This seminar shall be separate of the Technical Start-Up assistance. Include educational material, demonstration of actual components and visual aids.
PART 2 - PRODUCTS
2.01 PACKAGED EQUIPMENT
A. The ozone equipment offering will be a fully integrated, pre-plumbed pre-wired ozone package.
All electrical shall be UL listed at the manufacturing facility prior to shipment.
B. Plumbing shall be PVC Schedule 80. Flange inlet/outlet with Van Stone type connections.
C. Water pump shall be 304 Stainless steel with TEFC High Efficiency Motor. Pump shall be designed for ozone gas flow and appropriate gas to liquid ratio.
D. Injector shall be Mazzei type. Pressure gauges shall be front panel mount, liquid filled and stainless steel. There shall be installed pre and post of the injector.
E. Contact Tank shall be 85 gallons minimum with a four (4) year warranty on ozone residuals up to
4 mg/L. Tank shall include internal distribution of the two-phase flow and allow a top port off gas valve.
F. A degas relief valve shall be included.
G. A backpressure valve shall be integrated downstream of the contact tank to ensure ozone transfer of gas into solution.
H. The ORP analyzer shall be included.
I. Off gas demister and ozone destruct must be integrated into a skid design
J. To prevent water from entering back to the ozone generator from the process water system a backflow prevention device shall be included.
K. Complete single point power connection with individual circuit breakers, overloads, pump motor starter, relays, shall be integrated into a UL listed package.
L. The ozone system shall include a low-voltage sources to power the interlock and ORP circuits. For instance, 24VDC low-voltage power supply for powering of remote ORP analyzers and ambient ozone field monitors.
M. All the equipment shall be furnished as a package from a single source. Manufacturer shall “pre-package” all equipment to the maximum extent allowed by access restrictions. Factory mount subassemblies on skids to minimize the number of field interconnections. Provide leveling feet to allow for floor slope of ¼-inch per foot.
N. “Standard 250 for Enclosures for Electrical Equipment” shall be used as a guide for fabrication of the ozone generator cabinets: National Electric Manufacturers Association, 2101 L Street, N.W., Suite 300, Washington, DC, 20037.
O. Ozone Supplier shall be a UL listed 508A control shop and offer all equipment with factory UL signage prior to shipment.
P. The entire ozone gas supply line and interconnecting piping is to be supplied and installed by the
Contractor.
2.02 OZONE GENERATORS
A. Air-cooled ozone generators consisting of one or more independent modulating corona discharge ozone production modules. The prepackaged skid shall contain transformer(s) for power conversion, if required.
B. The ozone generator shall be a corona discharge type of capable of running on oxygen or air.
No ozone generators that cannot run only on oxygen feed are allowed.
C. The ozone generator and air preparation equipment will be installed in a climate-controlled environment with the following operating parameters:
• Min / Max temperature: 20°F to 95°F continuous, 0° to 100° periodically (a few hours only)
• Humidity: 0 - 90% relative humidity, non-condensing environment
• Line voltage: +/- 10% rated input
D. All components used within the ozone generators shall be constructed of ozone resistant materials. No degradation of materials including tubing, fittings, O-rings or wiring shall occur for a minimum of five years. The ozone generators shall consist of one or more independent reaction chamber(s). Each cathode within the reaction chamber shall be constructed of 316L stainless steel with Teflon end caps.
E. The ozone generators shall all have Teflon internal feed gas and ozone delivery lines. All internal fittings shall be made of Kynar or stainless steel and shall be of the ferrule type. The external ozone delivery line shall be Teflon with Kynar or stainless steel fittings.
F. All materials used in the installation of the ozone generators, related piping, tubing, check valves, diffuser, injector manifold and related components shall be constructed of ozone resistant materials. All piping, fittings, valves, gaskets, seals and other component parts that come into contact either with ozone feed gas or with ozone enriched water shall be constructed of ozone resistant materials.
G. All components used in the construction of the ozone generator shall be UL, ETL, CSA or NSF approved if possible. All materials, piping, tubing, fittings and related components to the installation of the ozone generator shall equally carry the UL, ETL, CSA or NSF approved label if possible.
H. Output Adjustment: Adjustment shall produce a scaled ozone output from 1% to 100% of rated capacity.
1. Adjustable ozone output by adjustment of a potentiometer when in Manual mode.
2. In Auto Mode, the unit shall receive 4-20 mA external signal from an ORP sensor and control ozone output using integral PID logic-based PLC (external of ozone generator). A Control Box Assembly (CBA) type device is required for ORP measurement and PID control to the ozone generator.
I. Provide indicator status for: “Power On”, “Ozone On”, “Ozone Production Output” and “Fault Indication.”
Q. No Vacuum Condition. If the injector pumps are off there will be no ozone made per generator.
A vacuum switch shall be integrated into the ozone generator.
2.03 CONTROLS AND I/O
A. Each ozone generator shall receive an analog signal from the ORP Analyzer device. This measured signal shall be processed by a PID controller built into the control box assembly (CBA).
A Hand/Off/Auto switch shall be in the ORP control box and allow:
1. When in the Hand (local) position, the ozone output shall be adjusted manually with no overriding automation.
2. When in the Off position, the generator shall remain off from either manual or automatic inputs.
3. When in the Auto (remote) position, the mode the generator shall run using all automated functions from installed PIDs including automatic modulation of ozone output based on ORP sensing and PID controls programming.
4. Indication of Ambient Ozone Alarm condition.
5. Indication of ORP inputs.
6. Indication of percent ozone production.
7. Indication of shutdown of ozone on high ORP of other Soft shutdown condition.
8. Status of ozone injection pump.
B. External Interlocks: The following connection terminals supporting external interlocks shall be built into the ozone generator cabinet.
1. External Ambient Ozone Monitor. The “External” Ambient Ozone Monitor shall be installed at the area near the ozone injectors/contactors. Supplier shall include termination at ozone generator for dry contact interlock wiring. Upon closed contact switch on either the internal integrated ambient ozone monitor or the “external” ambient monitor, the controller at the ozone generator shall signal a Soft Shut Down to occur. System will be latched and require manual reset. Interlock with the “External Warning Alarm” described below.
2. External Warning Alarm. Supplier shall include termination at ozone generator for connection wiring to activate the External Warning Alarm.
3. ORP Control: Supplier shall provide termination on each ozone generator for wiring termination. Receive 4-20 mA signal from the ORP sensor into a common CBA (control box assembly) then with a PID controller provide operator input and then an analog output to each of the ozone generators.
4. High ORP Ozone Cutoff: Supplier shall provide termination on ozone generator for wiring termination. ORP input from a dry contact wiring for ozone cutoff on high ORP. Receive a digital signal from pool return ORP sensor. Use for turning off ozone production on high ORP and include operator adjustable setpoint with controls logic.
5. Injector Pump Status. Each ozone generator shall have a vacuum switch to verify pump operation. If the pump is off, no vacuum will be detected and the ozone generator(s) shall be off.
6. Oxygen Concentrator, oxygen purity. The ozone supplier shall provide a portable oxygen analyzer in order to do monthly oxygen purity checks. If the purity is low corrective maintenance must be performed.
2.04 BACKFLOW PREVENTION
A. Supply one ozone and saltwater corrosion resistant check valve with each generator at the inlet to an active backflow prevention device described below. Check valves shall be manufactured of all titanium, Type 316 stainless steel, all Teflon, or PVDF body with Teflon seat and seals.
B. Supply an active backflow prevention device consisting of a capacitive type switch and normally closed solenoid valve responding to a water sensing probe, or other mechanical/electronic device designed to positively prevent backflow of water into the generator. The products and waste effluents shall be in conformance of all Federal, State or local authorities having jurisdiction over the Project.
1. System shall be designed to operate 24 hr/day, 7 days/week in the ozone gas line between the ozone generator and the ozone injection point. The backflow device shall be manufactured in accordance with UL 508 and the shipped unit shall include UL labeling.
2. Provide an automatic mechanism to shut down and or purge the ozone generator if liquid backs up inside the ozone gas line between the gas injection point and the ozone generator. A capacitive proximity sensor shall continually monitor status of any liquid detection through a FEP clear ozone resistant tube. In the event of liquid detection a switch shall activate an electric actuated ball valve for stoppage of gas flow.
3. The backflow device shall be capable of sustaining an operating pressure of 15 psi and vacuum of 26” Hg.
4. The gas outlet connection shall incorporate a normally closed solenoid valve with Viton or Teflon seats.
5. Both a check valve and an active backflow prevention device are required for each ozone generator.
2.05 AIR PREPARATION EQUIPMENT
A. Air Compressors: Oil-Free Teflon diaphragm WOB-L type air compressors. Designed for “tankless” installations, continuous 24-hour duty, and capable of zero-air flow operation without damage or reduced operational life. Shall incorporate independent vibration isolation from the mounting base.
B. Oxygen Concentrator: Oxygen concentration device using pressure swing absorption technology.
Designed for continuous 24-hour duty. Minimum purity of oxygen produced shall be no less than necessary for ozone generator’s requirements to produce the specified ozone. Shall be piped internally and externally with copper piping and brass or stainless steel fittings; plastic piping components are not allowed. Pressure purge valves shall be equipped with muffler to limit maximum sound level to less than 76 dB.
C. External sound levels shall be less than 56 dB.
D. Post air preparation filtration shall include a 5 micron nominal particulate filtration device with a replaceable filter element.
2.06 Ozone Injection Contact Equipment
A. Ozone gas shall be introduced into a side-stream steady state water flow. The contact system shall consist of a venturi injector, pre and post injector pressure gauges, a contact/degas mixing tank, an integral gas relief device and check valves (main process line and post degas).
B. Materials shall be suitable for ozone gas and salt-water exposure: Teflon®, PVDF, PVC, CPVC, and stainless steel.
C. Inlet and outlet fitting size: 1 – 1/2” PVC water plumbing. True-Union fittings included internal to the skid design and pre/post skid for isolation
D. Water pump shall be 304 stainless steel with high efficiency TEFC motor.
E. Auto level control valve shall release air from the separator (Degas) tank, passing little to no water.
F. Ozone Off Gas and Demister device will be collected and drawn from the ozone injection tank/degas device to the passive type ozone destruct device.
G. The off-gas decomposer shall be designed to destroy all residual ozone gas from the noted locations.
The contact process shall be assumed to be zero-percent efficient in reducing the applied ozone gas.
Equip with U.L. certified electrical power disconnect switch.
H. De-mister: Constructed of ozone and saltwater spray resistant materials (Type 316 grade stainless steel or non-metallic construction); capable of removing foam and water particles damaging to the catalytic elements. Empty-bed velocity shall not exceed 34 ft. per second. Include drain trap where installed remote of ozone contactor. Manufactured by the ozone equipment supplier.
I. Heater: Resistance-type, constructed of Type 316 stainless steel and controlled by an integrated circuit controller to provide the minimum low temperature required by catalytic unit.
J. Catalytic Canister: Shall be sized for destruct of 100% of the applied ozone. The unit shall not be "optimized" to operate at a temperature higher than 100°F maximum
K. The destruct unit shall be provided with a water trap/demister assembly to remove condensate from the off gas and ensure moisture getting into the catalyst canister.
L. Materials: Housing shall be constructed of Type 316 stainless steel.
2.07 EXTERNAL WARNING DEVICES
A. Locations:
1. Mounted in visible location prior to entering the ozone equipment area.
B. Supply a remotely mountable warning device which includes the following, at minimum:
one flashing lamp (one blue-ozone leak), horn (ozone leak, with acknowledgment button), and warning plaque all contained in a NEMA 4X enclosure. Plaque shall have permanent contrasting lettering reading:
WARNING: OZONE GAS, A STRONG TOXIC OXIDANT
MAY BE PRESENT WHEN LAMP AND HORN ARE ACTIVATED
A Supply lamp, horn and plaque suitable for wall mounting.
2.08 SUPPORT BASE
A. The ozone equipment supplier shall provide the ozone generator, and associated equipment, on a common support base or equipment skid. The support base shall be stainless steel.
2.09 MATERIALS OF CONSTRUCTION
A. Where materials and items are not specifically stated herein, the highest grade of ozone resistant materials shall be used: Teflon plastic (TEFC or GorTex), Type 316 stainless steel, or FRP finished with polyethylene.
PART 3 - EXECUTION
3.01 INSTALLATION - CONTRACTOR'S RESPONSIBILITY
A. General: Install all the equipment in accordance with Manufacturer's recommendations.
B. Make all required piping, tubing and gas connections.
C. Make all electrical connections or coordinate with an electrician for completion of this. All electrical connections to the building systems must be coordinated with the COR prior to work commencing.
D. Contractor shall make wiring connections for all external interlocks.
1. For all low-voltage wiring, provide Belden 9802, 2 conductor, 20 AWG, with PP insulation; or equal. Applies to wiring for dry-contacts and 24 VDC loop power wiring
2. Install wiring from the external Ambient Ozone Monitor, located at the injectors, to terminal on one of the ozone generators.
3. Install wiring to the External Warning Alarm from both ozone generators, for activation when ambient ozone is detected.
4. Install 4-20 mA wiring from each pool supply ORP sensor, to terminals on each ozone generator. Two locations, for modulation of ozone production.
5. If not pre-wired from factory, install wiring from oxygen purity sensors to ozone generators.
E. Schedule Start-Up and Training Seminar, between ozone equipment supplier and the COR.
F. Contractor shall test system and make adjustments to leave system fully operational.
PART 4 - DELIVERY
4.01 DELIVERY ADDRESS

As prescribed in section 1401.670-1, insert the following clause:
Authorities and Delegations (SEP 2011)
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum.
The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

Payment requests must be submitted electronically through the U.S. Department of the Treasury’s Internet Payment Platform System (IPP). The IPP website address is: https://www.ipp.gov.
“Payment requests” means any request for contract financing payment or invoicing payment by the Contractor. To constitute a proper invoice, the payment request shall comply with the applicable Prompt Payment clause included in the contract, the clause 52.212-4 Contract Terms and Conditions – Commercial Items included in commercial item contracts, or the requirements identified in FAR 52.232-27, Prompt Payment for Construction Contracts, and include the items listed in paragraphs (a)(2)(i) through (a)(2)(xi) of this clause.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3-5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.
Concurrent to submitting an invoice in IPP, the contractor may submit any supporting documentation to the http://www.ipp.gov/ http://www.ipp.gov/ mailto:ippgroup@bos.frb.org contracting officer at ebradford@usbr.gov. Contractors are cautioned that supporting documentation e-mailed to the contracting officer must not conflict with the IPP submission. Conflicts between the IPP submission and supporting documentation may result in a delay in approval and/or rejection of submitted invoices.
When e-mailing supporting documentation to the contracting officer, the subject line of the email shall be formatted as follows: Contract Number, Invoice Number, Contracting Officer's last name (e.g., 140R2018R00000_Invoice No.
1_Smith). The invoice shall be attached to the email and named using the following format: Contract Number, Contractor Name, Invoice Number, Invoice Amount (e.g., 140R2022R00000_World Test, Inc. - Inv. No. 1 - $5,678).
Invoices shall not include information that would compromise Personally Identifiable Information, such as full social security numbers, dates of birth, etc. The final invoice shall be submitted and will be approved in accordance with payment terms and conditions contained in the contract, after all, if any, settlement actions are complete. The contractor must clearly identify the last payment as the ‘Final Invoice’.”

WBR 1452.201-80 CONTRACTING OFFICER’S REPRESENTATIVE’S AUTHORITIES

a) Performance of the work under this contract shall be subject to the technical direction of the Reclamation Contracting Officer's Representative (COR). The term “technical direction” is defined to include, without limitation:
(1) Inspecting and accepting or rejecting work performed under the contract.
(2) Representing the Government in technical phases of the work. The COR is responsible for the technical administration of the contract and will provide instructions and interpretations to the Contractor on all technical matters relating to the contract. The COR will supervise or oversee all Government technical and administrative personnel assigned to assist the COR.
(3) Reviewing and, where required by the contract, approving submittals of technical data, shop drawings, samples, literature, plans, or other data required to be delivered by the Contractor to the Government.
(b) The Contractor will receive a copy of the written COR designation from the Contracting Officer. It will specify the extent of the COR's authority to act on behalf of the Contracting Officer.
(c) Technical direction must be within the scope of work stated in the contract. Only the Contracting Officer is authorized to determine if a change is within the scope of the contract; therefore, the COR does not have the authority to, and may not, issue any technical direction that -
(1) Constitutes a direction of additional work outside the Contract requirements;
(2) Constitutes a change as defined in the contract clause entitled “Changes;”
(3) In any manner causes an increase or decrease in the total contract cost, or the time required for contract performance;
(4) Changes any of the expressed terms, conditions or specifications of the contract; or
(5) Interferes with the Contractor's right to perform the terms and conditions of the contract.
(d) All technical direction shall be issued in writing by the COR.
(e) The Contractor must proceed promptly with the performance of technical direction duly issued by the COR in the manner prescribed by this clause and within its authority under the provisions of this clause. If, in the opinion of mailto:ebradford@usbr.gov.
the Contractor, any instruction or direction by the COR falls within one of the categories defined in (c)(1) through (c)(5) of this clause, the Contractor must not proceed and must notify the Contracting Officer in writing within five
(5) working days after receipt of any such instruction or direction and must request the Contracting Officer to modify the contract accordingly. Upon receiving the notification from the Contractor, the Contracting Officer must -
(1) Advise the Contractor in writing after receipt of the Contractor's letter that the technical direction is within the scope of the contract effort and does not constitute a change under the Changes clause of the contract; or
(2) Advise the Contractor that the Government will issue a written change order.
(f) A failure of the Contractor and Contracting Officer either to agree that the technical direction is within the scope of the contract or to agree upon the contract action to be taken with respect to the technical direction will be subject to the provisions of the clause entitled “Disputes.”

SAFETY AND HEALTH-BUREAU OF RECLAMATION

(a) The Contractor shall not require any person employed in the performance of this contract (including subcontracts) to work under conditions which are unsanitary, hazardous, or dangerous to an employee’s health or safety.
(b) Contractor shall comply with the most current version of the Bureau of Reclamation’s Reclamation Safety and
Health Standards (RSHS) and, if incorporated, 52.236-13 Accident Prevention.

(c) Comply with the standards (29 CFR) issued by the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor, www.osha.gov.
(d) In the event there is a conflict between the requirements contained in paragraphs (b) and (c) referenced herein, or in the Statement of Work (SOW) or Performance Work Statement (PWS), the more stringent requirement shall prevail.
(e) If required in the SOW or PWS, the Contractor shall submit a written proposed safety program as prescribed in the RSHS and the written specifications.
(f) The Contractor shall maintain an accurate record of and shall report to the Contracting Officer (or authorized representative) in the manner prescribed by the Contracting Officer, all cases of death, occupational diseases, or traumatic injury to employees or the public involved, and property damage in accordance with the RSHS and OSHA guidelines.

(g) If the contractor deems that an updated version of the RSHS constitutes a substantive change to the contract, affecting price or time (or both), the contractor may request a contract modification in accordance with the terms of the contract.

(a) General Security Requirements:
(1) This clause addresses security requirements, including general procedural requirements, information security requirements, contractor employee suitability requirements, identification card requirements, site security requirements, vessel exclusion barriers, and information technology security requirements. Within this clause, COR means Contracting Officer's Representative. If there is no COR appointed and identified to the Contractor, the term instead will mean the Program Manager or any other authorized individual responsible for technical oversight under the contract. “Work site” means the Government facility, office, construction site, and any other area within the Government office or facility that the Contractor must access to accomplish work under this contract.
(2) The work performed under this contract shall only be accomplished by individuals (in the employment of the Contractor or any subcontractors) whose conduct and behavior is consistent with the efficiency of the Federal Service and the requirements of this contract, and who are acceptable to the contracting officer. If Reclamation finds a Contractor employee to be unsuitable or unfit for his or her assigned duties, the contracting officer will direct the Contractor to remove the individual from the contract and access to the Federal facility at which the contract activities are occurring.
(3) The Contractor’s employees governed by this contract may need access to sensitive information and/or sensitive areas. The Federal Government (Government) reserves the right, in its sole discretion, to determine suitability of Contractor personnel and deny access to any sensitive information or project specific area to any personnel for any cause.
(4) The Contractor is responsible for informing and ensuring compliance by its employees with any applicable security procedures of the Government facility where work may be performed under this contract.
(5) Any Contractor employee that will have access to a Federally-controlled facility or information system will be required to have a Government-issued identification card, consisting of a Personal Identity Verification (PIV) Card, a temporary identification card, or a visitor badge. (Note: within the Department of the Interior this card is known as a DOI Access Card.) During performance of the contract, the Contractor shall keep the COR apprised of any http://www.saferfederalworkforce.gov/ http://www.saferfederalworkforce.gov/ http://www.saferfederalworkforce.gov/ changes in personnel, or changes in personnel access or duration, to ensure that performance is not delayed by compliance with credentialing processes.
(6) A Contractor employee will not be provided access to a Government facility or information system until a Government PIV Card, temporary identification card, or visitor identification badge has been issued to the Contractor employee. For those individuals that will be receiving a PIV Card, the Government may, at its discretion, issue a temporary identification card or visitor identification badge after the electronic background investigation forms have been received and the investigation is initiated.
(7) All Contractor employees shall access the facility via the facility’s entry screening system and visibly display the Government-issued PIV Card, temporary identification card, or visitor identification badge at all times.
Contractor employees must visibly wear the Government-issued identification card at all times they are on Government facilities. Contractor employees are responsible for the safekeeping of all Government-issued identification cards, whether on-site or off-site. Cards that have been lost, damaged, or stolen must be reported to the COR and DOI Access Sponsor immediately, but not later than within 24 hours. The Contractor shall return all identification cards and card keys and any other Government property and information upon completion of performance or when personnel depart permanently or for a period of 7 days or more. The Contractor may be required to turn in access control cards or identification cards on a daily basis.
(8) Misuse or loss of access control or identification cards, or failure to comply with required surrender of such cards may, at Government discretion, result in Contractor personnel being denied access to the work site, at no cost to Government. The Contractor may be charged up to $500 for each occurrence for any required replacement of Government-issued access control or identification cards due to loss or misuse. At the end of contract performance, or when a Contractor employee is no longer working under this contract, the Contractor shall ensure that all access control and identification cards are returned to the COR.
(9) All Contractor personnel, including subcontractor personnel, with access to the work site shall be U.S. citizens or foreign individuals legally residing in, or legally admitted to, the U.S. For all non-U.S. citizens working under this contract, irrespective of length of time working on the contract, the Contractor shall provide to the COR, legible and valid copies of the individual’s passport and visa (unless individual is on the Visa Waiver Program) a minimum of 14 calendar days prior to beginning work or arriving at the facility. A driver’s license is not acceptable identification. In addition, a completed form I-94 shall be submitted to the COR upon the individual’s arrival at the work facility and prior to beginning work.
(10) The Contractor shall report all contacts with entities, individuals, and counsel/representatives (including foreign entities and foreign nationals) who seek in any way to obtain unauthorized access to sensitive information or areas. The Contractor shall report any violations of contract provisions, laws, executive orders, regulations, and guidance to the contracting officer. The Contractor shall report any information raising a doubt as to whether an individual’s eligibility for continued employment or access to sensitive information is consistent with the interests of National Security and the Public Trust.
(11) Unsanctioned, negligent, or willful inappropriate action on the part of the Contractor (or its employees) may result in termination of the contract or removal of some Contractor employees from Reclamation facilities at no cost to the Government. These actions include, but are not limited to, exploration of a sensitive system and/or information, introduction of unauthorized and/or malicious software, inappropriate release of sensitive information, or failure to follow prescribed access control policies and/or security procedures. Failure to comply with Reclamation policies, procedures, or other published security requirements may result in termination of the contract or removal of some contracted employees from Reclamation buildings and/or facilities at no cost to the Government.
(12) All provisions of this clause shall equally apply to all subcontractors. The Contractor shall incorporate the substance of this clause in all subcontracts.
(13) These security requirements apply to all sections of this Contract including Contract Drawings and other Contract Specifications as applicable. Related documents include other general provisions of Construction or Operations and Maintenance type Contracts, including FAR clauses by reference or as amended by related documents.
(b) Information Security Requirements.
(1) Sensitive Information. The term “sensitive information” means any information which warrants a degree of protection and administrative control as defined by Reclamation or that meets the criteria for exemption from public disclosure set forth under Sections 552 and 552a of Title 5, United States Code: the Freedom of Information Act and the Privacy Act. Sensitive information is generally categorized as CONTROLLED UNCLASSIFIED INFORMATION (CUI), but in some cases may include other unclassified information. (The protection of National Security information is beyond the scope of this clause. If any work on National Security information is required under this contract, it is addressed under other contract clauses.) The Contractor shall protect this type of information from unauthorized release into public domain, or to unauthorized persons, organizations, or subcontractors. Information which, either alone or in aggregate, is deemed sensitive by Reclamation shall be handled and protected in accordance with Reclamation Directives and Standards SLE 02-01 Identifying and Safeguarding Controlled Unclassified Information (CUI), which is available from the COR or at http://www.usbr.gov/recman/DandS.html#sle.
(i) Any Government-furnished information or material does not become the property of the Contractor and may be withdrawn at any time. Upon expiration or termination of the contract, all documents released to the Contractor and any material created using data from such documents shall be returned to the COR for final disposition.
Government-furnished information residing on any electronic systems (laptops, servers, desktops, media) shall be deleted from those systems using a COR-approved data erasure solution. Only with prior authorization from the contracting officer may the Contractor retain the material. The Contractor or subcontractor shall not disclose or release the materials provided to the Contractor to any individuals of the Contractor's organization not directly engaged in providing services under the contract or that do not have a valid need-to-know. All technical data provided to the Contractor by the Government shall be protected from public or private disclosure in accordance with the markings printed on them. All other information relating to the items to be delivered or the services to be performed under this contract shall not be disclosed by any means without prior approval of the contracting officer.
Prohibited dissemination or disclosure includes but is not limited to: permitting access to such information by foreign nationals or by immigrant aliens who may be employed by the Contractor, publication of technical or scientific papers, advertising, disclosure to Contractor staff not investigated and deemed acceptable at the appropriate information sensitivity level, and any other public release. The Contractor shall maintain, and furnish upon request of the contracting officer, records of the names of individuals who have access to sensitive material in its custody and the sensitive material to which the individuals had access. All questions regarding information security, access, and control shall be referred to the COR.
(ii) The Contractor shall not release to anyone outside the Contractor’s organization any sensitive, or otherwise protected information, regardless of medium in which it is contained (for example, film, tape, document, electronic), pertaining to any part of this contract or any Reclamation program or activity, unless the contracting officer has given prior written approval. This includes, but is not limited to, news releases, marketing promotions, articles, interviews, reports, social media posts, and any other media releases. Requests for approval shall identify the specific information to be released, the medium to be used, the purpose for the release, and a description of the need-to-know. The Contractor shall submit its request to the contracting officer ten business days before the proposed date for release. Subcontractors shall submit requests for authorization to release through the prime Contractor to the contracting officer.
(iii) The Contractor shall notify the COR immediately when known or suspected loss/compromise of sensitive http://www.usbr.gov/recman/DandS.html#sle information or other documents, notes, drawings, sketches, reports, photographs, exposed film or similar information which may affect the security interests of Government has occurred.
