Statement of Work (SOW)
5‐Million Pound Universal Testing Machine & Instron 8800 MT Electronic Controls
Upgrade Assessment Introduction The Bureau of Reclamation’s (Reclamation) Concrete and Structural Laboratory operates several testing machines for testing the strength of various materials. In order to provide certifiable test data using the
5‐Million Pound Universal Testing Machine (5‐Mil), the current electronic controls require upgrading to maintain manufacturer support and serviceability.
Scope This requirement is for assessing the existing electronic controls systems and providing modernization/upgrade recommendations with associated final design and construction cost estimates.
The assessment will be conducted on the entirety of the existing system which includes an Instron test controller and software, Rockwell Automation programmable logic controller (PLC) hardware and software, PLC input/output (IO) devices, hydraulic equipment motors/pumps and associated controls, variable frequency drives (VFD), and ancillary equipment and controllers.
Qualifications Company must be a current and verifiable Rockwell Automation System Integrator Partner at
Silver Level or above.
Company in business designing and installing control systems for at least 20 years.
Company not tied to specific hardware or software platforms (i.e., able to incorporate various third‐party hardware and software integration)
Tasks
1. Review Existing Documentation
a. Original design specifications for existing controls system
b. Schematics of existing controls system
c. Instron 8800 MT test controller and associated testing software
d. PC hardware and operating system
2. On‐Site Assessment of Existing Electronic Controls System Hardware and Software
a. Performed on site at Reclamation’s Concrete and Structural Laboratory in the presence of Reclamation personnel

3. Develop Upgrade/Modernization Plan
a. Provide list of hardware and software components requiring upgrade or replacement to facilitate functionality with modern hardware and software.
i. Hardware and software components must be compatible with an upgraded or replacement Instron controller and testing software.
ii. Must consult directly with Instron to provide a recommendation for upgrade/modernization of the Instron controller and software.
iii. Recommended components must be new, unused, off‐the‐shelf items that can be easily serviced or replaced.
iv. Provide list of hardware and software alternatives.
b. Provide list of optional hardware and software component upgrades or replacements that provide additional safety, redundancy, functionality and/or opportunity for future expansion of the system.
c. Provide specifications, cut sheets, etc. for hardware and software components listed for upgrade/replacement.
d. Provide list of recommended spare parts to maintain on‐hand, including the recommended quantity of each component.
4. Develop Final Design and Construction Cost Estimate
a. Develop a detailed cost estimate for performing final design activities associated with the recommended upgrade path.
b. Develop a detailed cost estimate for construction/installation of the recommended upgrade path.
5. Develop Final Design and Construction Schedules
a. Provide an estimate of the duration of final design activities.
b. Provide a basic construction/installation schedule detailing major activities beginning with deactivation of the current system through completion of installation.
i. Incorporate anticipated lead times for materials and components.
ii. Incorporate installation of the Instron controller and testing software.
iii. Incorporate commissioning of the Instron controller and testing software.
iv. Incorporate calibration activities to be provided by Instron.
Deliverables
1. A full scope of work quote for upgrade/modernization and construction/installation of a new control system. The quote shall detail hardware and software modernization and provide alternatives or options that arise throughout the assessment and quote development.
2. A detailed cost estimate for final design activities and construction/installation of the new control system. The cost estimate shall provide line items for any alternatives or options.
3. An estimated construction/installation schedule. The schedule shall include total outage time.
Place of Performance The on‐site assessment will be conducted at Reclamation’s Concrete and Structural Laboratory, located within Building 56 at the Denver Federal Center in Lakewood, Colorado.
Period of Performance Tasks associated with this scope of work, including providing deliverables to Reclamation, is not to exceed 12 weeks.
The on‐site assessment phase of the work shall be performed during the hours of 8 AM to 5 PM, Monday through Friday. The on‐site assessment must not be performed on Federal holidays.
Documentation Reclamation will provide documentation pertaining to the existing control system. Documentation includes, but is not limited to, drawings, specifications, schematics, OEM manuals, etc. associated with the 5‐Million Pound Universal Testing Machine structural and mechanical components, the existing
Instron 8800 MT Controller, the existing PC hardware and software, etc.

PLATFORM (IPP) (APR 2013)
Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).
'Payment request' means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The Contractor shall also submit an electronic copy of the IPP invoice to SEE EMAIL BOX BELOW once the invoice has been submitted to IPP. Failure to email the invoice may cause significant delay or possible rejection of your payment request.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of St. Louis (FRBSTL) within 3 - 5 business days of the contract award date. If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

WBR 1452.201-80 CONTRACTING OFFICER’S REPRESENTATIVE’S AUTHORITIES AND LIMITATIONS

a) Performance of the work under this contract shall be subject to the technical direction of the Reclamation Contracting Officer's Representative (COR). The term "technical direction" is defined to include, without limitation:
(1) Inspecting and accepting or rejecting work performed under the contract.
(2) Representing the Government in technical phases of the work. The COR is responsible for the technical administration of the contract and will provide instructions and interpretations to the Contractor on all technical matters relating to the contract. The COR will supervise or oversee all Government technical and administrative personnel assigned to assist the
COR.
(3) Reviewing and, where required by the contract, approving submittals of technical data, shop drawings, samples, literature, plans, or other data required to be delivered by the Contractor to the Government.
(b) The Contractor will receive a copy of the written COR designation from the Contracting Officer. It will specify the extent of the COR's authority to act on behalf of the Contracting Officer.
(c) Technical direction must be within the scope of work stated in the contract. Only the Contracting Officer is authorized to determine if a change is within the scope of the contract; therefore, the COR does not have the authority to, and may not, issue any technical direction that -
(1) Constitutes a direction of additional work outside the Contract requirements;
(2) Constitutes a change as defined in the contract clause entitled "Changes;"
(3) In any manner causes an increase or decrease in the total contract cost, or the time required for contract performance;
(4) Changes any of the expressed terms, conditions or specifications of the contract; or
(5) Interferes with the Contractor's right to perform the terms and conditions of the contract.
(d) All technical direction shall be issued in writing by the COR.
(e) The Contractor must proceed promptly with the performance of technical direction duly issued by the COR in the manner prescribed by this clause and within its authority under the provisions of this clause. If, in the opinion of the Contractor, any instruction or direction by the COR falls within one of the categories defined in (c)(1) through (c)(5) of this clause, the Contractor must not proceed and must notify the Contracting Officer in writing within five (5) working days after receipt of any such instruction or direction and must request the Contracting Officer to modify the contract accordingly. Upon receiving the notification from the Contractor, the Contracting Officer must -
(1) Advise the Contractor in writing after receipt of the Contractor's letter that the technical direction is within the scope of the contract effort and does not constitute a change under the Changes clause of the contract; or
(2) Advise the Contractor that the Government will issue a written change order.
(f) A failure of the Contractor and Contracting Officer either to agree that the technical direction is within the scope of the contract or to agree upon the contract action to be taken with respect to theRFQ 140R8122Q0345 technical direction will be subject to the provisions of the clause entitled "Disputes."

(d) Comptroller General Examination of Record. 52.212-2 EVALUATION-COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Trade Off
Technical and past performance, when combined, are significantly more important than cost or price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERCIAL PRODUCTS AND

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v)) of this provision.
(a) Definitions. As used in this provision—
“Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
Immediate owner means an entity, other than the offeror, that has direct control of the offeror.
Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
Inverted domestic corporation, means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules andRFQ 140R8122Q0345 definitions of 6 U.S.C. 395(c).

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture
Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education;

(6) Have been voluntarily suspended. "Sensitive technology"—
Sensitive technology—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran;
or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3)of the International Emergency Economic Powers Act (50 U.S.C.
1702(b)(3)).
Service-disabled veteran-owned small business concern—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service connected, as defined in 38 U.S.C. 101(16).
Small business concern—
(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and size standards in this solicitation.
(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.
Small disadvantaged business concern, consistent with13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that—
