DRAFT TUBE SCAFFOLD (CBT) MISSOURI BASIN REGION
Specifications Bureau of Reclamation
Eastern Colorado Area Office, Loveland, Colorado Aluminum Work Platforms Fabrication and Delivery
BACKGROUND
The Bureau of Reclamation’s Eastern Colorado Area Office (ECAO) manages numerous hydropower facilities within the Colorado-Big Thompson (C-BT) Project. Designs have been completed for new draft tube work platforms for five of these facilities. The draft tube work platforms are temporary structures which can be installed during unit outages to safely perform maintenance work within the draft tubes. Some units have Pressure Regulating Valves (PRVs) which act as a bypass for the turbine and main draft tube. For units with PRVs, there are separate designs for scaffolds to be used in the PRV draft tubes.
SCOPE
The scope of this award includes all parts, material, and labor to fabricate and deliver the five platforms as specified and depicted in the Reclamation design drawings included with this solicitation. The scope of this contract DOES NOT include installation of the platforms or any on-site work beyond delivery.
The vendor is to provide pricing for all five (5) separate Contract Line Item Numbers (CLINs) – one for each facility. Reclamation may award any number of these CLINs based on available funding. Reclamation guarantees at least one will be awarded this fiscal year with the anticipation of awarding the remaining structures as optional items next fiscal by September 30, 2022. The total number of CLIN’s/structures awarded will be determined at time of initial award.
The CLINs include the following items (see drawings for more detail and parts lists):

(3) Reviewing and, where required by the contract, approving submittals of technical data, shop drawings, samples, literature, plans, or other data required to be delivered by the Contractor to the Government.
(b) The Contractor will receive a copy of the written COR designation from the Contracting Officer. It will specify the extent of the COR’s authority to act on behalf of the Contracting Officer.
(c) Technical direction must be within the scope of work stated in the contract. Only the Contracting Officer is authorized to determine if a change is within the scope of the contract; therefore, the COR does not have the authority to, and may not, issue any technical direction that -
(1) Constitutes a direction of additional work outside the Contract requirements;
(2) Constitutes a change as defined in the contract clause entitled “Changes;”
(3) In any manner causes an increase or decrease in the total contract cost, or the time required for contract performance;
(4) Changes any of the expressed terms, conditions or specifications of the contract; or
(5) Interferes with the Contractor's right to perform the terms and conditions of the contract.
(d) All technical direction shall be issued in writing by the COR.

(2) Advise the Contractor that the Government will issue a written change order.
(f) A failure of the Contractor and Contracting Officer either to agree that the technical direction is within the scope of the contract or to agree upon the contract action to be taken with respect to the technical direction will be subject to the provisions of the clause entitled “Disputes.”

52.216-04 ECONOMIC PRICE ADJUSTMENT-LABOR AND MATERIAL (JAN 2017)
(a) The Contractor shall notify the Contracting Officer if, at any time during contract performance, the rate of pay for labor (including fringe benefits) or the unit prices for material shown in the Schedule either increase or decrease. The Contractor shall furnish this notice within 60 days after the increase or decrease, or within any additional period that the Contracting Officer may approve in writing, but not later than the date of final payment under this contract. The notice shall include the Contractor’s proposal for an adjustment in the contract unit prices to be negotiated under paragraph (b) of this clause, and shall include, in the form required by the Contracting Officer, supporting data explaining the cause, effective date, and amount of the increase or decrease and the amount of the Contractor’s adjustment proposal.
SOLICITATION # 140R6021Q0044 BUREAU OF RECLAMATION
DRAFT TUBE SCAFFOLD (CBT) MISSOURI BASIN REGION
(b) Promptly after the Contracting Officer receives the notice and data under paragraph (a) of this clause, the Contracting Officer and the Contractor shall negotiate a price adjustment in the contract unit prices and its effective date. However, the Contracting Officer may postpone the negotiations until an accumulation of increases and decreases in the labor rates (including fringe benefits) and unit prices of material shown in the Schedule results in an adjustment allowable under paragraph (c)(3) of this clause.
The Contracting Officer shall modify this contract (1)to include the price adjustment and its effective date and (2)to revise the labor rates (including fringe benefits) or unit prices of material as shown in the Schedule to reflect the increases or decreases resulting from the adjustment. The Contractor shall continue performance pending agreement on, or determination of, any adjustment and its effective date.
(c) Any price adjustment under this clause is subject to the following limitations:
(1) Any adjustment shall be limited to the effect on unit prices of the increases or decreases in the rates of pay for labor (including fringe benefits) or unit prices for material shown in the Schedule. There shall be no adjustment for-
(i) Supplies or services for which the production cost is not affected by such changes;
(ii) Changes in rates or unit prices other than those shown in the Schedule; or
(iii) Changes in the quantities of labor or material used from those shown in the Schedule for each item.
(2) No upward adjustment shall apply to supplies or services that are required to be delivered or performed before the effective date of the adjustment, unless the Contractor’s failure to deliver or perform according to the delivery schedule results from causes beyond the Contractor’s control and without its fault or negligence, within the meaning of the Default clause.
(3) There shall be no adjustment for any change in rates of pay for labor (including fringe benefits) or unit prices for material which would not result in a net change of at least 3 percent of the then-current total contract price. This limitation shall not apply, however, if, after final delivery of all line items, either party requests an adjustment under paragraph (b) of this clause.
(4) The aggregate of the increases in any contract unit price made under this clause shall not exceed 10 percent of the original unit price. There is no percentage limitation on the amount of decreases that may be made under this clause.
(d) The Contracting Officer may examine the Contractor’s books, records, and other supporting data relevant to the cost of labor (including fringe benefits) and material during all reasonable times until the end of 3 years after the date of final payment under this contract or the time periods specified in subpart
4.7 of the Federal Acquisition Regulation (FAR), whichever is earlier.

PROVISIONS
52.212-2 EVALUATION – COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, delivery date, experience/past performance and price in this order. The following factors shall be used to evaluate offers:
1) Delivery Date
2) Experience/Past performance
3) Price
The above evaluation factors are listed in order of importance with the delivery date and experience being more important than price. The Government reserves the right to award to other than the lowest offer if it is determined that the delivery date and experience of another offer justifies the higher price and is best interest to the Government.
Prospective offerors shall provide sufficient information in order to make an adequate award determination based on the following evaluation factors:
(1) Delivery Date – The contractor must provide estimated delivery dates for each CLIN with quote.
(2) Experience/Past performance – The contractor should have at least five years of experience building structures similar to these specifications. Contractors must provide proof of their scaffolding project experience with resumes or other supporting documentation and provide references from at least two other jobs/projects similar in size and scope of at least over $30K.
(3) Price - All proposed prices will be reviewed for price reasonableness and any instances of unbalanced pricing. For any trade-offs performed, the price component will be the sum of the total prices for all CLIN’s on the Price Schedule.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
