1.0 Public Law

The Bureau of Reclamation (Reclamation) is responsible to develop and implement the Program to Meet Standards (PTMS), which was initiated pursuant to P.L. 108-361, Section 103(d)(2)(D). The goal of PTMS is to meet all existing water quality standards and objectives for which the Central Valley Project (CVP) has responsibility.

2.0 Background

Reclamation currently operates to meet the Total Maximum Daily Load (TMDL) objective under terms and conditions of CVP water rights. The San Joaquin River has a Total Maximum Daily Load (TMDL) in effect which requires that electrical conductivity (EC) at the San Joaquin River near Vernalis, where the river enters the Sacramento-San Joaquin River Delta, be less than 700 �s/cm during the irrigation season and less than 1,000 �s/cm the rest of the year to protect irrigation use in the south Delta. In order to protect the quality of irrigation supply water upstream of the Delta, the salinity will now also be managed at the San Joaquin River at Crows Landing and San Joaquin River at Maze Road monitoring stations.

The Bureau of Reclamation (“Reclamation”), which provides irrigation water to many irrigation districts in the San Joaquin Valley, sponsors and coordinates real-time salinity management for the San Joaquin River. Reclamation uses the Watershed Analysis Risk Management Framework (WARMF) model and real-time data to perform forecasts and monitor sources of flow and salinity in the watershed. WARMF is a physically based model which simulates the flow and water quality within the watershed. Flow volume and salt mass are tracked from inflows and precipitation through diversions, irrigation, evapotranspiration, and return flows. The WARMF model domain extends from the San Joaquin River at Lander Avenue to the San Joaquin River at Vernalis. In 2023, Systech Water Resources released WARMF version 7.0, whose graphical user interface has new capabilities including display of shapefiles and the ability to run macros which combine a sequence of internal and external processes.

3.0 Objectives

The objectives of this Performance Work Statement (PWS) are to provide Reclamation’s technical support to evaluate alternatives for a programmatic management approach to meet the salt TMDL requirements under this PTMS program.

4.0 Type of Contract

The Government intends to award a firm fixed price type of contract.

5.0 Period of Performance

The period of performance for this requirement is July 1, 2023 to November 30, 2024.

6.2. Hours of Operations

The Contractor is responsible for conducting business, between the hours of 8:00 AM-6:00 PM Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor shall not be reimbursed when the government facility is closed for the above reasons. The Contractor shall at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons.

6.3 Place of Performance

The work to be performed under this contract shall be performed at the Contractor’s facility and at the locations of public stakeholder’s meetings. Contractor shall participate in stake holder meetings in Modesto, CA and Technical Review Team meetings at the Regional Water Board, Rancho Cordova, CA as dictated by Reclamation.

7.0 Scope of Work or Task

Task 1 - WARMF Version 7.0 Customization and Forecast Evaluation The new graphical user interface of WARMF version 7.0 has new capability and flexibility for Reclamation to customize, evaluate, and improve its flow and water quality forecasts. By programming macros, new functions would be made available to Reclamation including:

• Creating scenarios for comparison of forecasting alternatives

• Running diffusive wave vs kinematic wave hydrologic simulations

• Evaluation of effectiveness of different self-calibration and forecasting / data extrapolation methods

• Changing model boundary conditions

• Automated adjustment of initial conditions when changing simulation start dates

As directed by Reclamation, the contractor shall develop and implement the WARMF 7.0 program changes, macros and utilities to customize the WARMF version 7.0 graphical user interface for the San Joaquin River WARMF model.

Deliverable: Updated WARMF 7.0 executable file, utility executable files, and macro files integrated into the San Joaquin River WARMF 7.0 application files.

Task 2 - Automated Groundwater Pumping Calculation Irrigators in the San Joaquin Valley prefer to use surface water to irrigate their crops since it is generally

San Joaquin River WARMF Model Improvements less expensive and lower in salinity than groundwater. Groundwater pumping makes up the difference between surface water supply and crop irrigation demand. Groundwater pumping has been calculated manually for past years as input to the WARMF model. For real-time simulation, average pumping rates for the day of the year have been used. Actual groundwater pumping is quite variable by water year, however, so this is a source of error in WARMF’s simulation of the quantity and salinity of agricultural runoff. For this task, the contractor shall create a function within WARMF 7.0 which shall calculate the groundwater pumping needed in real-time given the applied water rate and surface water supply. The WARMF 7.0 macro processing will be modified to call this function as part of the forecasting data preprocessing macro.

Deliverable: Updated WARMF 7.0 executable file and macro file integrated into San Joaquin River WARMF 7.0 application files.

Task 3 - Upgraded Automated Data Retrieval A utility program called by WARMF currently retrieves data from the California Irrigation Management Information System, California Data Exchange Center, U.S. Geological Survey, and California-Nevada River Forecast Center. The contractor shall add automated data retrieval from additional data sources such as HydroMetCloud to bring data collected by irrigation districts into WARMF in real-time. The data retrieval utility and WARMF macros shall also be upgraded to provide specific error messages when data is not available, and training will be provided for manual data entry when a data source is not available.

Deliverable: Updated executable file and control file for automated data retrieval utility program integrated into San Joaquin River WARMF 7.0 application files.

Task 4 - Self-calibration of Maze Road Flow and EC Monitoring Data There is an existing self-calibration utility program which calibrates real-time simulation of flow and EC (Electric Conductivity) in the San Joaquin River at Crows Landing and at Vernalis. The monitoring station in the San Joaquin River at Maze Road is an additional location where the Bureau of Reclamation needs to forecast flow and EC. There have been two issues with the monitoring data at Maze Road:

during high flow in the Stanislaus River but low flow in the San Joaquin River, backwater effects raise the water level in the San Joaquin River at Maze Road resulting in inaccurately high measured flow at the Maze Road gage. The second issue with the Maze Road gage has been irregular maintenance and therefore unreliable data. For this task, the contractor shall expand its self-calibration utility to also calibrate the WARMF model simulated flow and EC for the San Joaquin River at Maze Road site with checks to calibrate that location when the hydrologic conditions and data quality permit it.

Deliverable: Updated self-calibration executable file and control file for self-calibration utility program integrated into San Joaquin River WARMF 7.0 application files.

Task 5 - Forecasting of Surface Water Diversions Currently, WARMF forecasts surface water diversions based on average values for the time of year.

Actual diversions are highly dependent upon water supply, however. In summer of dry years, the Patterson (PWD) and West Stanislaus (WSID) Irrigation Districts may divert no water from the San Joaquin River, whereas in wet years each may divert over 100 cfs. The Modesto (MID) and Turlock (TID) Irrigation Districts divert water from the Tuolumne River and apply it to land which drains to the

San Joaquin River. The amount they divert is also limited by available supply. Diversion data is available in real-time (MID, TID) or near real-time (PWD, WSID) so that recent data can be used to estimate future diversions. The contractor shall scale other diversions along the San Joaquin River (Twin Oaks, El Solyo, Reclamation District 2064, riparian diversions) using PWD and WSID as a guide.

The contractor shall develop a tool which uses recent and real-time data to extrapolate diversion data through the forecast period. The contractor shall add the tool to the existing data preprocessing macro used for forecasting in WARMF 7.0.

Deliverables: Executable file with surface water diversion forecasting utility and updated WARMF forecasting preprocessing macro, both integrated into San Joaquin River WARMF version 7.0 application file.

(a) Definition. As used in this clause–

Commercial and Government Entity (CAGE) code means–

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity by unique location; or

52.217-8 Option to Extend Services Nov 1999

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 14 days prior to contract expire.

(d) Comptroller General Examination of Record. (a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause.

A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. (a) Performance of the work under this contract shall be subject to the technical direction of the Reclamation Contracting Officer's Representative (COR). The term “technical direction” is defined to include, without limitation:

(1) Inspecting and accepting or rejecting work performed under the contract.

(2) Representing the Government in technical phases of the work. The COR is responsible for the technical administration of the contract and will provide instructions and interpretations to the Contractor on all technical matters relating to the contract. The COR will supervise or oversee all Government technical and administrative personnel assigned to assist the COR.

(3) Reviewing and, where required by the contract, approving submittals of technical data, shop drawings, samples, literature, plans, or other data required to be delivered by the Contractor to the Government.

(b) The Contractor will receive a copy of the written COR designation from the Contracting Officer. It will specify the extent of the COR’s authority to act on behalf of the Contracting Officer.

(c) Technical direction must be within the scope of work stated in the contract. Only the Contracting Officer is authorized to determine if a change is within the scope of the contract; therefore, the COR does not have the authority to, and may not, issue any technical direction that -

(1) Constitutes a direction of additional work outside the Contract requirements;

(2) Constitutes a change as defined in the contract clause entitled “Changes;”

(3) In any manner causes an increase or decrease in the total contract cost, or the time required for contract performance;

(4) Changes any of the expressed terms, conditions or specifications of the contract; or

(5) Interferes with the Contractor's right to perform the terms and conditions of the contract.

(d) All technical direction shall be issued in writing by the COR.

(e) The Contractor must proceed promptly with the performance of technical direction duly issued by the COR in the manner prescribed by this clause and within its authority under the provisions of this clause. If, in the opinion of the Contractor, any instruction or direction by the COR falls within one of the categories defined in (c)(1) through (c)(5) of this clause, the Contractor must not proceed and must notify the Contracting Officer in writing within five (5) working days after receipt of any such instruction or direction and must request the Contracting Officer to modify the contract accordingly. Upon receiving the notification from the Contractor, the Contracting Officer must -

(1) Advise the Contractor in writing after receipt of the Contractor's letter that the technical direction is within the scope of the contract effort and does not constitute a change under the Changes clause of the contract; or

(2) Advise the Contractor that the Government will issue a written change order.

If there is no COR appointed and identified to the Contractor, the term instead will mean the Program Manager or any other authorized individual responsible for technical oversight under the contract. “Work site” means the Government facility, office, construction site, and any other area within the Government office or facility that the Contractor must access to accomplish work under this contract.

(2) The work performed under this contract shall only be accomplished by individuals (in the employment of the Contractor or any subcontractors) whose conduct and behavior is consistent with the efficiency of the Federal Service and the requirements of this contract, and who are acceptable to the contracting officer. If Reclamation finds a Contractor employee to be unsuitable or unfit for his or her assigned duties, the contracting officer will direct the Contractor to remove the individual from the contract and access to the Federal facility at which the contract activities are occurring.

(3) The Contractor’s employees governed by this contract may need access to sensitive information and/or sensitive areas. The Federal Government (Government) reserves the right, in its sole discretion, to determine suitability of Contractor personnel and deny access to any sensitive information or project specific area to any personnel for any cause.

(4) The Contractor is responsible for informing and ensuring compliance by its employees with any applicable security procedures of the Government facility where work may be performed under this contract.

(5) Any Contractor employee that will have access to a Federally-controlled facility or information system will be required to have a Government-issued identification card, consisting of a Personal Identity Verification (PIV) Card, a temporary identification card, or a visitor badge. (Note: within the Department of the Interior this card is known as a DOI Access Card.) During performance of the contract, the Contractor shall keep the COR apprised of any changes in personnel, or changes in personnel access or duration, to ensure that performance is not delayed by compliance with credentialing processes.

(6) A Contractor employee will not be provided access to a Government facility or information system until a Government PIV Card, temporary identification card, or visitor identification badge has been issued to the Contractor employee. For those individuals that will be receiving a PIV Card, the Government may, at its discretion, issue a temporary identification card or visitor identification badge after the electronic background investigation forms have been received and the investigation is initiated.
