This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with FAR Part 13 and additional information included in this notice. The Bureau of Reclamation intends to award a Firm-Fixed Price Purchase Order for services represented in the Performance Work Statement. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-02, as of March 16, 2023.

This requirement is being solicited as 100% Small Business Set-Aside and will be awarded based on a comparative evaluation of past performance and price under FAR Part 13.

Performance Work Statement Portable Toilets for Lake Berryessa

1.0 General

This is a non-personal services contract to provide portable toilets and related services for the California Great Basin Region, Bureau of Reclamation. The Government shall not exercise any supervision or control over the contract service providers performing the services. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

2.0 Period of Performance

May 1, 2023 to September 30, 2023

4.0 Contractor Furnished Items and Services

The Contractor shall provide all equipment, supplies, management, supervision, personnel, and transportation except as specified herein as government-furnished, necessary to assure that all services are in accordance with the contract and all applicable laws and regulations. The contractor shall ensure all work meets performance standards specified in this Performance Work Statement (PWS) and referenced documents.

5.0 Contract Changes

Additional services required by changes in mission assignments must be documented by a written contract modification. If the contractor receives a request from Reclamation personnel directing or requesting work that the contractor believes is not within the terms of the PWS or the contract, then the contractor must notify the Contracting Officer of the request. The only person that has the authority to modify the terms of the contract or request work for which compensation will be provided is a Contracting Officer.

6.0 Items Required

The contractor will provide 37 portable toilets. 11 of the toilets must be Americans with Disabilities Act (ADA) compliant. The remaining 26 toilets will be standard units.

The contractor will coordinate with the designated Contracting Officer’s Representative (COR) to determine site layout and placement of the toilets at each location.

8.0 Tasks

A. The Contractor shall provide cleaning service, pump out service, and restocking service.

B. The following locations will be serviced 3 times per week (Thursday, Saturday, and

Sunday), including holidays.

D. The Markley Cove turnout toilets should be pumped early in the day (especially on Sunday) to avoid vehicles blocking access.

E. The Contractor shall provide emergency services as needed within 12 to 24 hours after notification by the COR.

F. The Contractor shall work with the COR with placement of toilets within recreation areas upon delivery.

G. The Contractor may be required to move toilets within the recreation areas if needed.

This action shall be accomplished within 12 to 24 hours of notification by the COR.

H. The Contractor maybe required to add or subtract units based on the visitation needs of the recreation areas. The COR shall notify the contractor if this action is needed.

I. Any additional costs associated with moving toilets, adding or subtracting toilets, falls within the scope of this contract and will be negotiated through bilateral contract modifications.

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

The Contractor should upload supporting documentation to the IPP website that will allow the Government to confirm that the invoice is acceptable for payment.

The invoice should not have any conflicting information to the information submitted to IPP.

Invoices shall not include information that would compromise Personally Identifiable Information, such as full social security numbers, dates of birth, etc. The final invoice shall be submitted and will be approved in accordance with payment terms and conditions contained in the contract, after all, if any, settlement actions are complete. The contractor must clearly identify the last payment as the ‘Final Invoice’.”

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment.
