1452.201-70 AUTHORITIES AND DELEGATIONS (SEPT 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum.

The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause.

A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

PART 1. GENERAL

1.1 SUMMARY OF WORK

SCOPE

The work to be performed under this contract for “Upgrade Frontcountry Networked Fire Alarm System for Remote Monitoring” consists of providing all labor, tools, materials, equipment, and incidentals required to perform the work identified in this Statement of Work

(SOW).

PROJECT LOCATION

The road entrance to Denali National Park & Preserve is located at Milepost (MP) 237 on the Parks Highway (Alaska Route 3).

The primary location of work included in this contract is within the frontcountry (FC) area of Denali Park, generally including those areas along the first three miles of the Denali Park Road.

Included within the frontcountry area are the Visitor Center Campus (located at Denali Park Road approximate MP 1.5), C-Camp (Denali Park Road approximate MP 3), and the park Headquarters (HQ)/ Housing Area (Denali Park Road approximate MP 3.3).

1.2 GENERAL REQUIREMENTS

A. LODGING

Lodging and other amenities are available in local communities outside Park property. Park housing is not available and establishment of a camp on National Park Service property will not be permitted.

B. EXISTING FACILITIES AND UTILITIES

1. The Contractor shall be responsible for preventing damage to Government-owned facilities and utilities, including damages resulting from inadvertent discharges of fire suppression systems resulting from the Contractor’s negligence. If damage occurs, repair to the satisfaction of the Contracting Officer (CO) at no additional expense to the Government.

2. Reasonable quantities of utilities including electricity available from existing sources and access to existing toilet facilities will be available to the Contractor without cost.

3. Contractor-generated waste resulting from execution of work under this contract may be disposed of in existing waste receptacles without cost to the Contractor.

1. Before start of work, the Contractor will attend a meeting to be chaired by the Contracting Officer (CO) or designated representative. The meeting agenda will include the following:

a. Correspondence procedures

b. Designation of responsible personnel

c. Changes

d. Accident reporting

e. Submittal of shop drawings, project data, and samples

f. Coordination requirements

D. SUBMITTAL PROCEDURES

1. Transmit all submittals (except color samples) in .pdf format with transmittal form DSC-16. Standard submittals shall be legible when printed at 8.5x11 size. All shop drawings must be legible when printed at 11x17 size.

2. Provide each submittal with a number or other unique identifier, including revision identifier.

a. Submittal number shall use a sequential number (e.g., .001). Re-submittals shall include an alphabetic suffix after another decimal point (e.g., .001.A).

b. Re-submittals: Make re-submittals using the same process used with the initial submittal.

c. Note date and content of previous submittal.

d. Note date and content of revision in the title block on the CM-16E and clearly indicate the extent of revision.

e. Re-submit submittals until they are marked “Approved” or “Approved with notations”.

3. Allow 14 calendar days for processing of submittals, starting when the Contracting Officer’s Representative receives a submittal by email from the Contractor. When the submittal review is completed, an e-mail notification will be sent to the Contractor. No extension of the Contract Time will be authorized because of failure to transmit submittals enough in advance of the Work to permit processing, including resubmittals.

4. Submittals will be disapproved without technical review if identification information is missing, not filled in, or if placed on the back of the submittal;

an incorrect format of submittals is provided; the transmittal form is

140P9724Q0047 Page 17 of 42 incorrectly filled out; submittals are not coordinated; or submittals do not show evidence of Contractor’s approval.

5. Any work done or orders for materials or services placed before approval shall be at the Contractor’s own risk.

6. Action Submittals: Contracting Officer will review each submittal, generate comments on corrections or modifications required, and indicate the appropriate action on the CM-16E Transmittal Form. The submittal will be marked in one of three ways as defined below:

a. APPROVED: Acceptable with no corrections.

b. APPROVED WITH NOTATIONS: Minor corrections or clarifications required. All comments are clear and no further review is required.

The Contractor shall address all review comments when proceeding with the work.

c. DISAPPROVED - RESUBMIT: Rejected as not in accordance with the contract or as requiring major corrections or clarifications. The Contracting Officer will identify the reasons for disapproval. The Contractor shall revise and resubmit with changes clearly identified.

E. SAFETY

1. Contractor shall have a safety program that meets all federal, state, and local requirements. Submit an Accident Prevention Plan to the CO prior to beginning work on the project site.

2. Equipment or tools not meeting OSHA requirements will not be allowed on the project. Comply with contract clause entitled "Accident Prevention". In case of conflicts between Federal, State, and local safety and health requirements, the most stringent shall apply. Failure to comply with the requirements of this section and related sections may result in suspension of work.

3. Qualifications of Employees:

a. All employees must be physically qualified and able to perform assigned duties in a safe manner.

b. Do not allow employees to perform work whose ability or alertness is impaired because of prescription or illegal drug use, fatigue, illness, intoxication, or other conditions that may expose themselves or others to injury.

c. Operators of vehicles, manlifts, etc. shall be able to understand signs, signals, and operating instructions, and be fully capable of operating such equipment. Provide operating instructions for all equipment.

d. Newly hired operators shall be individually tested by an experienced operator or supervisor to determine if they are capable of safely operating equipment.

4. Accident Reporting

a. A project reportable accident is defined as death, occupational disease, traumatic injury to employees or the public, fires, and property damage by accident in excess of $100.

b. Notify Contracting Officer immediately in the event of a reportable accident.

c. Within 7 days of a reportable accident, fill out and forward to Contracting Officer an Accident/Property Damage Report (Form CM- 22). Form may be obtained from the Contracting Officer.

5. Safety Meetings

a. Prior to beginning work, conduct a safety meeting with all personnel and the CO to review the Accident Prevention Plan.

b. In addition, at a minimum, conduct daily 15-minute "toolbox" safety meetings.

6. Fire and Life Safety

Comply with the requirements of NFPA 241 (Standard for Safeguarding Construction, Alteration, and Demolition Operations). Prohibit cigarette smoking, vaping, and chewing tobacco use within 50 feet of buildings.

F. CONTRACTOR’S USE OF PREMISES

1. Work Hours: The Contractor’s operation hours for work inside the Park shall be limited to 8 a.m. to 6 p.m., Monday through Saturday.

2. Work will be performed in occupied facilities during a period of active operations in the Park. Contractor shall closely coordinate scheduling of all activities that may impact Park operations with the Contracting Officer. In addition, the Contractor shall provide appropriate notification to local or remote alarm monitoring centers of any activities impacting fire alarm system status.

3. Provide a list of contact personnel of the Contractor and subcontractors including addresses and telephone numbers for use in the event of an emergency. As changes occur and additional information becomes available, correct and change the information contained in previous lists.

4. The ARCC is a controlled access area. The CO will coordinate access for the contractor into this facility and all other work areas.

5. Areas for storage of small quantities of materials and performance of administrative tasks incidental to work on this contract may be available within the C-Camp area upon request from the Contractor.

G. SCHEDULE

Submit a project schedule for review and approval by the CO. Schedule must be submitted within three calendar days of Notice to Proceed.

H. PROJECT COMPLETION

1. Cleaning: Remove all tools, equipment, surplus materials, and rubbish.

Restore or refinish surfaces of existing facilities that are marred, scratched, or damaged due to the work of this contract to match original condition. At time of final inspection, project shall be thoroughly clean and ready for use.

2. Substantial Completion and Final Inspection: Submit written certification that project is substantially complete, and request in writing a final inspection.

Contracting Officer (CO) or designated representative will make an inspection within 2 days of receipt of request.

3. When CO determines that the work is substantially complete, they will prepare a list of deficiencies to be corrected before final acceptance and issue a Letter of Substantial Completion.

4. If CO determines that the work is not substantially complete, they will immediately notify Contractor in writing, stating reasons. After completing work, Contractor shall resubmit certification and request a new final inspection.

5. After all deficiencies have been corrected, a Letter of Acceptance will be issued.

I. OPERATION AND MAINTENANCE DATA

Submit components of the system, servicing requirements, record drawings, inspection data, test reports, replacement part numbers and availability, location and contact information for service.

1.3 GOVERNMENT FURNISHED ITEMS

The Government will furnish the following items:

A. Windows 10-based personal computer with keyboard, mouse, and dual displays and which meets the minimum hardware specifications for the Contractor-furnished and installed incident management software system elsewhere specified in this SOW.

B. Required computer network and telephone (POTS) connections and infrastructure.

C. Digital copies of facility floor plans, if required. Floorplans will be provided in either AutoCAD (.dwg) or Adobe Portable Document Format (PDF) as chosen by the Contractor.

D. Central Monitoring Station (CMS) services.

1.4 CONTRACTOR FURNISHED ITEMS

All items not specifically indicated as being Government-furnished shall be Contractor-furnished.

1.5 PERIOD OF PERFORMANCE

All work shall be completed as soon as feasible but not later than (NLT) July 31, 2024.

1.6 DEFINITION OF SOLICITATION ITEMS

Provide a lump sum quote to accomplish all specified work for each item and option as follows:

A. BASE ITEM

The base item includes all elements required to upgrade the existing FC networked fire alarm system to enable monitoring by the central monitoring station (CMS) specified elsewhere in this SOW, as well as enabling user-configurable notifications via Edwards cloud-based ConnectedSafety+ platform. Include provision of a one-year subscription this service. Upon completing installation, the Contractor shall fully test the completed fire alarm system in accordance with the requirements of Chapter 14 of NFPA 72 and provide a minimum of four hours of in-person, on-site training to Park maintenance and dispatch personnel. The training session shall be digitally recorded and submitted electronically along with completion and closeout documentation required by Chapter 7 of NFPA 72. All work shall be warranted against defects in materials and labor for a period of one year after substantial completion.

PART 2. DESCRIPTION OF WORK

2.1 BACKGROUND

Currently, NPS dispatchers working in the Alaska Region Communication Center (ARCC) located in the Shaffer Building (Building 570) in Denali National Park & Preserve (DENA) provide code-required around-the-clock monitoring of DENA’s frontcountry area building fire alarm systems. Projected staffing shortages and possible future interruptions in government funding impair ARCC’s ability to continue providing continuous alarm monitoring and dispatch, so the ARCC has chosen to contract monitoring and dispatch to a third-party central monitoring station (CMS) as permitted by NFPA. Unfortunately, there is currently no way for the Park’s existing networked fire alarm system to transmit alarm signals off site to this third-party monitoring station. The objective of performance under this contract therefore is to upgrade DENA’s networked fire alarm system to automatically transmit alarm, trouble, and supervisory signals to a UL-Listed, off-site, CMS while simultaneously retaining the capability to continue to monitor signals from ARCC.

2.2 EXISTING CONDITIONS

A. DENA’s existing networked fire alarm system is based on Edwards EST-3 platform and consists of multiple EST-3 fire alarm panels networked to a FireWorks workstation located in DENA’s Shaffer Building (Building 570) located in the C-Camp area of the Park. An additional FireWorks client terminal is located in the former Steam Plant (Building 54) located in the Park’s Headquarters (HQ)/Housing Area.

B. There are four EST-3 fire alarm panels located in the Visitor Center Campus area.

These panels are located in the Employee Dining Room (Building 546), Murie Science and Learning Center (MSLC, Building 547), Denali Visitor Center (DVC, Building 548), and the DVC Book Store (Building 550). All four panels are equipped Edwards MN-COM1S devices to enable communication with the FireWorks workstation located in the Shaffer Building via the Park’s existing fire alarm Virtual Local Area Network

(VLAN).

C. There are two EST-3 fire alarm panels located in the Park’s Headquarters (HQ)/Housing Area. These two panels monitor a total of five data circuits. The EST-3 “Panel 1” located in the Steam Plant (Building 54) monitors two class-A data circuits serving 14 buildings including the following: HQ Six Plex Apartment (Building P51), HQ Duplex A&B (Building P252), HQ Residence (Building P171), HQ Residence (Building P34), HQ Residence (Building P26), HQ Residence (Building P27), HQ Residence (Building P28), HQ John House (Building 112), HQ Duplex Apartments A&B (Building P12), HQ Area 3-Plex Garage (Building 217), HQ Duplex Apartments A&B (Building P13), HQ Superintendent’s Duplex Residence A&B (Building P23), and HQ IT Building (Building 53). Panel 1 reports to “Panel 2” (an EST-3 panel located in the combined Resources Building/Resources Addition (Building 102/118) via an inter-panel communications line. Panel 2 monitors three class-A data circuits serving 15 buildings, including the following: HQ Panabode Residence (Building S170), HQ Panabode Residence (Building S169), HQ Residence (Building P251), HQ Human Resources Office (Building 107), HQ Administration

Office (Building 123), HQ Barn Office (Building 106), HQ Interpretation Office (Building 101), HQ Commercial Services Office (Building 103), HQ Kennels (Building 105), HQ Headquarters Office (Building 21), HQ Rock House Residence (Building P111), HQ Afterthought Residence (Building P640), and HQ Upfront Office (Building 110). Panel 2 is equipped with an MN-COM1S device to enable communication with the FireWorks workstation in the Shaffer Building via the fire alarm VLAN.

D. There are two EST-3 panels located in the Park’s C-Camp area. The EST-3 panel located in Maintenance/B&U (Building 380) receives signals from that building as well as a GE Fire Shield Plus panel located in the Maintenance Auto Shop (Building 164).

The second EST-3 panel in the C-Camp area is located in the Shaffer Building (Building 570) and supports the adjacent Shaffer Annex/Over and Out (Building 911).

Both EST-3 panels communicate with the FireWorks workstation using an MN- COM1S device over the VLAN.

E. The FireWorks workstation in Building 570 and the client terminal in Building 54 currently run FireWorks version 8.20.00 under a Windows 7 operating system.

2.3 SCOPE, GENERAL

This intent of work performed under this contract is to upgrade DENA’s networked fire alarm system, including the FireWorks workstation to enable code-compliant transmission of fire alarm signals to the central monitoring station (CMS) contracted by the ARCC, currently anticipated to be DHS’ Federal Protective Service (FPS) MegaCenter (https://www.dhs.gov/megacenters).

Communication with the CMS shall be via internet protocol (IP) using the Park’s existing ethernet network infrastructure with redundant communication over dedicated Plain Old Telephone Service (POTS) lines.

In addition to monitoring by the CMS, the completed fire alarm system shall allow local monitoring by ARCC dispatch personnel and provide additional, user-configurable notifications of fire alarm system status and events via email, as well as via desktop and mobile applications using Edwards cloud-based Connected Safety+ Software as a Service (SaaS) platform.

All fire alarm system design, programming, and installation work shall be performed by appropriately qualified personnel working for an installing contractor that is currently listed as an Edwards-certified Strategic Partner. The resulting networked fire alarm system shall be complete and fully functional and meet the requirements of the latest edition of NFPA 72, the National Fire Alarm and Signaling Code (NFSC) and NFPA 70, the National Electrical Code (NEC).

2.4 CONCEPTUAL SYSTEM CONFIGURATION

Based on preliminary discussions with representatives from Edwards, the following is a general description of the assumed scope of upgrades required to achieve the performance objectives identified in this SOW:

A. Replace the existing EST-3 fire alarm control panel located in the Shaffer Building (Building 570) with an EST-4. Reuse existing panel components to the extent possible based on compatibility between the EST-3 and EST-4 platforms. Turn over all components removed from the existing EST-3 panel which are unsuitable for re-use to the CO.

B. Equip the new EST-4 panel with an Edwards 4-FWAL series firewall to enable secure IP communications between the networked fire alarm system and the CMS and ConnectedSecurity+ portal.

C. Equip the new EST-4 panel with a MODCOM for redundant communication with the CMS via POTS lines.

D. Install current version FireWorks software on a new, Government-furnished computer to be located in the Dispatch Center within the Shaffer Building. This FireWorks workstation must be suitable for use as the primary monitoring and dispatch interface when the CMS is not in use. As such, the new FireWorks workstation will interface with the new EST-4 and the existing networked fire alarm panels to properly display all alarm, trouble, and supervisory signals registered on any networked panel.

E. The existing FireWorks client in the Steam Plan (Building 54) will be decommissioned; no replacement FireWorks client is…
