STATEMENT OF WORK
Background / Introduction
The Muir House, home of the famous conservationist and “Father of the National Park
Service,” John Muir for the last 24 years of his life from 1890-1914, is a three-story
Italianate Victorian structure built in 1882 by Muir’s father-in-law, Dr. John Strentzel.
On December 21, 2001 staff at John Muir National Historical Site in Martinez, CA discovered flooding of the Muir
House basement with about 10” of standing water throughout, including the museum collection storage area.
Flooding was due to an act of vandalism which included turning on the hose on the exterior the building and leaving it running for over 24 hours before it was discovered. Clogged drains in the basement compounded the issue.
Upon discovery of the flooding, the water was immediately turned off and standing water pumped out. All affected museum collections were separated and assessed for damage. Approximately 35 cubic feet of archival materials, including historic books and administrative files, were separated and/or wrapped in plastic and immediately placed in a freezer to inhibit mold growth.
Scope
Contractor will perform vacuum freeze-dried treatment of 35 cubic feet of frozen documents and books.
The following treatment methods should NOT be used: simple freeze drying, desiccant drying, dehumidification drying, thermal drying, vacuum thermal drying, thermal vacuum freeze drying or gamma irradiation.
The 35 cubic feet of materials includes park administration and museum record files as well as the following 17 historic books: JOMU 4981a, JOMU 4981p, JOMU-00089 “John of the Mountains,” JOMU-00460 “The Ways of
John Muir,” JOMU-00087 “John Muir” – 11 volume set, “Geological Survey 1895-96,” and JOMU 3558.
Tasks & Details
Contractor shall travel to John Muir NHS to appropriately pack frozen contents and transport to (if within local area) or ship overnight to contractor facility. Materials will be treated at the contractor’s facility. Contractor is responsible for packing and shipping materials back to John Muir NHS.
Location
Contractor will pack items and pick up for shipment at John Muir NHS:
Muir House
John Muir National Historic Site
4202 Alhambra Ave.
Martinez, CA 94553
Treatment will be performed at the contractor’s facility. Contractor will complete NPS museum property loan form and shall provide a General Facility Report (https://www.nationalww2museum.org/sites/default/files/2017-

(u) Unauthorized Obligations.
(1) Except as stated in paragraph (u)(2) of this clause, when any supply or service acquired under this contract is subject to any End Use License Agreement (EULA), Terms of Service (TOS), or similar legal instrument or agreement, that includes any clause requiring the Government to indemnify the Contractor or any person or entity for damages, costs, fees, or any other loss or liability that would create an Anti-
Deficiency Act violation (31 U.S.C. 1341), the following shall govern:
(i) Any such clause is unenforceable against the Government.
(ii) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement. If the EULA, TOS, or similar legal instrument or agreement is invoked through an “I agree” click box or other comparable mechanism (e.g., “click-wrap” or “browse-wrap” agreements), execution does not bind the Government or any Government authorized end user to such clause.
(iii) Any such clause is deemed to be stricken from the EULA, TOS, or similar legal instrument or agreement.
(2) Paragraph (u)(1) of this clause does not apply to indemnification by the Government that is expressly authorized by statute and specifically authorized under applicable agency regulations and procedures.
