Remove Hazardous Trees and Limbs on or near Earthworks

(EAST) MAJOR ACQUISITION BUYING OFFICE

The U.S. Department of the Interior, National Park Service, Kennesaw Mountain National Battlefield Park (KEMO), located in Kennesaw, GA, requires the removal of hazardous and potentially hazardous trees throughout the park.

The North American Industry Classification System (NAICS) code is 561730. The Government intends to award a firm fixed price contract in accordance with FAR Part 12, Acquisition of Commercial Items, and FAR Part 13, Simplified Acquisition Procedures.

Statement of Services

1. Project Site:

Kennesaw Mountain National Battlefield Park 905 Kennesaw Mountain Drive, Kennesaw, GA, 30152.

2. Background:

Kennesaw Mountain National Battlefield Park preserves a Civil War battlefield of the Atlanta Campaign. The Visitor Center provides introductory information about the park and the battle.

While walking some of the 18+ miles of interpretive walking trails you will see historic earthworks, cannon emplacements and various interpretive signs. There are 3 monuments representing states that fought here. Kennesaw Mountain is 1808 feet above sea level. It is approximately a 700-foot incline from the Visitor Center to the mountain's summit. The hike up is approximately 1.4 miles on the road and 1.2 mile up the trail. Kennesaw Mountain National Battlefield Park was authorized for protection by the War Department in 1917 and was transferred to the Department of the Interior as a unit of the National Park System in 1933. The 2992+- acre park includes the site of some of the heaviest fighting of the Atlanta Campaign. The park was set aside by Congress as an important cultural property dedicated to public inspiration and interpretation of the significant historic events that occurred here.

3.0 General Statement of Work:

The purpose of this Statement of Work is to establish a contract for the removal of hazardous and potentially hazardous trees and limbs to the civil War Earthworks at the Kennesaw Mountain National Battlefield Park. This project also requires the removal of trees and large limbs which have fallen across the earthworks.

This contract includes the removal of 164 Hazardous Trees with DBHs ranging from 16” to 40” and hazardous tree limb removal as directed. The National Park Service will mark all trees prior to removal. No trees or limbs not marked by the NPS are to be removed. This contract will last 10 to 12 months. The period of performance is from mid-2024 to mid-2025.

The work will be ordered, as needed by the National Park Service (NPS) approximately once per month. Park employees will mark trees each month for removal. Trees will range from 16 inches to 40 inches in diameter and up to 100+ feet high. Trees will be removed, and debris chipped and/or moved from park boundaries, roads, parking lots and trails as ordered by the NPS.

Tree stumps shall be cut at ground level.

Of particular concern in these cutting operations is the protection of the historic earthworks.

These earthen fortifications date back to the battle here and are a major resource to be protected within the park boundaries. These earthworks are particularly vulnerable to damage by the operation of both the tracked and wheeled vehicles which are often used in timbering operations.

It is essential and mandatory that the contractor meet with the COTR and representatives of the park’s interpretive staff before operations begin in any new area, so they can be shown what these earthworks look like and discuss how best to protect them.

3.1 Work Descriptions:

Tree Removal: Trees indicated for removal by the NPS shall be removed in a safe manner to prevent injury of workers and/or visitors using the adjacent areas. When ordered by the NPS, tree debris and limbs will be chipped and hauled to a NPS approved area for disposal. When chipping is not ordered by the NPS, the contractor will spread tree debris and limbs evenly across the area of disposal.

The contractor may harvest large trees and limbs that they actively remove. Salvaged wood, should the contractor choose to re-utilize the material, will be removed immediately after felling, chipping and bucking of individual trees. Removed/harvested trees are the property of the contractor.

Trail Closures: Temporary trail closures of one hour or less are permissible for public safety reasons. Closures longer than one hour must be scheduled and approved by the NPS prior to closure and the commencement of the work. Special care must be taken to prevent damage to the surrounding area or adjacent trees, brush and other vegetation. The contractor will post appropriate warning signs indicating the removal process is underway.

Desired Results: With the completion of the tree and limb removal from and around the earthworks project at Kennesaw Mountain National Battlefield Park, trees and limbs order by the NPS shall be removed and/or chipped and spread in the area of disturbance and the worksites will show little indication of that removal. Stumps ultimately shall be cut at ground level.

3.2 Certified Arborist:

Contractor must be a Certified Arborist ISA (International Society of Arboriculture) or equivalent.

Contractor must be trained and knowledgeable in all aspects of arboriculture. Contractor must show three or more years of full-time, eligible, practical work experience in arboriculture.

3.3 Certified Arborist Bidding:

Because of the complexity of the project, it HIGHLY RECOMMENDED for bidders to visit worksite.

4.0 Bid List

Provide price unit price for each service described and size provided.

Type A Tree Removal: Felling Only Services include Felling tree, limbing dropped trees and ensure direct soil contact.

5.0: HAULING RESTRICTIONS:

When hauling on National Park Service roads, do not exceed the following load restrictions:

Where the ground is saturated with water or during periods of freezing and thawing, the Contracting Officer may impose further load restrictions or suspend hauling.

5.1 Haul vehicles shall turn around only at intersections and parking areas, not on the park Road.

5.2 Operate loaded vehicles hauling material at speeds not exceeding the posted speed limit and spaced at 500-foot minimum intervals. On bridges, speeds shall not exceed 25 MPH and not more than one loaded hauling vehicle will be allowed on any bridge at one time. Hauling of materials, supplies, and equipment over the park road, other than within the limits of the project, will not be permitted without prior approval of the Contracting Officer. Load restrictions on park roads are identical to the state load restrictions with such additional regulations as may be imposed by the Contracting Officer.

6.0: EQUIPMENT:

• Equipment that is leaking any type fluids shall be repaired immediately or removed from the park.

• Equipment deemed unsafe by the NPS will be repaired immediately or removed from the park.

7.0: Hours of Operation:

Contractor working hours shall take place Monday through Friday, 7:00 AM and no after 5:00 PM. The contractor may work other hours only with submission of a written request and subsequent permission of the Contracting Officer.

Work on weekends or on Federal Holidays and at night may be performed only with submission of a written request and subsequent permission of the Contracting Officer. All work shall be scheduled by the NPS, five (5) workdays or more notice will be given by the NPS.

8.0: PROTECTION AND RESTORATION OF PROPERTY:

The contractor shall be responsible for the preservation from injury or damage, resulting directly or indirectly from the execution of the work, of all public and private property along and adjacent to the park. Contractor shall use every precaution necessary to prevent damage to historic earthworks, pipes, conduits, and other underground structures; also, all overhead structures such as wires, cables, etc.; and poles, trees, shrubbery and crops, within or outside of the project area. Use of heavy machinery on or near earthwork will not be permitted to avoid any damages to the historic earthworks. Any damage by the contractor or his employee shall be repaired at once at the contractor expense. The contractor will stop work immediately as directed by the COR if there is a suspicion of potentially undocumented cultural and natural resources. In such cased the NPS would require review and documentation of such resources.

9.0: SAFETY:

• The contractor shall comply with pertinent provisions of the Occupational Safety and

Health Act (OSHA), state, local, safety, laws, and all pertinent provisions of the contract.

• The contractor shall comply with pertinent Environmental Protection Agency laws.

• All tools, equipment and other related materials will be removed at the end of each workday and the area will be left neat and clean.

• The contractor shall adhere to standards as applicable to MUTCD (Manual on Uniform

Traffic Control Devices).

• The KEMO Safety Officer has the authority to issue restraint or cease-and-desist orders to the contractor when violations or unsafe acts are present and threaten government and contractor employees or damage to government property.

• The contractor shall immediately report to the Contracting Officer, COR and KEMO safety officer all accidents resulting in employee injury, death, or damage to property while performing this contract.

• The contractor must keep the entrance roads and parking lots open for public use at all times during removal activities.

• Contractor shall provide all traffic flaggers and other traffic control measures and must be in place and functional at all times during the tree removal and trimming in public areas, roads, trails and parking lots. Special care must be taken to prevent impacting the surrounding areas and facilities.

• The contractor will post appropriate warning signs indicating periods of tree removal and trimming work.

• The successful contractor shall use best management practices for tree removal and trimming, following all NPS, State, County and OSHA regulations pertaining to tree removal and trimming. Employees utilizing chain saw equipment shall wear approved safety equipment to include chaps, hard hat, eyes and hearing protection.

• All equipment shall be in good and safe working condition. Contractor shall inspect all equipment at the start of the workday.

• Contractor shall start each day with a safety briefing/meeting with all contractors on the work site.

10. INSURANCE:

The Contractor shall be insured in accordance with the State of Georgia insurance regulations and pertinent provisions of the Contract. The government is not responsible for damage to Contractor’s equipment, vehicles, tools, or materials or their employees and any personal property brought on site. The government will not accept any liability due to Contractor employee negligence.

• Workers Compensation- The contractor shall furnish proof of worker’s compensation insurance to the Contracting Officer for those employees performing work related to this contract and shall comply with the Workman’s Compensation Laws of the Commonwealth of Kentucky and the State of Tennessee.

• Liability- Contractor shall maintain a level of insurance that will protect the Contractor and Government from any claims as a result of bodily injury (including death) and property damage which may arise from and during the performance of this contract and shall submit proof of insurance to the Contracting Officer.

11. CONTRACTOR USE OF SITE:

Contractor shall have limited use of the construction site for construction-related operations only.

Limited use of premises to areas within the Contract. Do not disturb portions of the project site beyond areas in which the work is indicated. Contractor will prevent damage to natural surroundings. Damage to natural surroundings will be restored through NPS-approved methods for repairing or replanting, at no additional cost to the government.

12. MOTOR VEHICLE AND TRAFFIC REGULATIONS:

Contractor, sub-contractor and material supplier employees (altogether referred to as “contractor employees” in paragraphs 12, 13, 21 and 23) operating motor vehicles shall possess a valid driver's license. Driver and vehicle permit, licenses, registrations and proof of insurance shall be maintained in all contractor employee vehicles at all times and made available upon request.

Contractor employees shall always comply with federal vehicle motor law requiring seat belts be worn. Contractor employees shall adhere to the posted speed limits. Contractor employees are expected to comply with all KEMO regulations.

13. NON-PAYMENT FOR ADDITIONAL WORK:

Any additional contractor performed services not specified in contract, either at its own volition or at the request of an individual other than the appointed Contracting Officer, except as may be explicitly authorized in the contract, shall be performed at the financial risk of the Contractor.

Only the appointed Contracting Officer is authorized to bind the Government to a change in specifications, contract terms, or conditions.

14: PROJECT CLOSE OUT:

The project period of performance is for 12 months with the exception of more days allowed for bad weather. When the contractor cannot work because of bad weather, the contractor must contact the COR in writing and provide the explanation and request additional days for inclement weather circumstances.

The FOB point will be Destination. “FOB Destination” means that all costs for transportation or freight from the shipping point shall be paid by the contractor and included as a separate line item. The total price should include all shipping cost.

The following provisions and clauses apply to this procurement: FAR 52.212-01 Instructions to Offerors – Commercial Items; FAR 52.212-02, Evaluation – Commercial Items is applicable, and the following shall be included in paragraph (a) of this provision: Quotes will be evaluated based on best value to the Government, which will result from lowest price technically acceptable. FAR 52.212-03, Offeror Representations and Certifications – Commercial Items;

Prohibition on Text Messaging and Using Electronic Equipment Supplied by the Government while Driving (Oct, 2009)

This Executive Order introduces a Federal Government-wide Prohibition on the use of text messaging while driving on official business or while using Government –supplied equipment.

Additional guidance enforcing the ban will be issued at a later date. In the meantime, please adopt and enforce policies that immediately ban text messaging while driving company-owned or –rented vehicles, government-owned or leased vehicles, or while driving privately owned vehicles when on official government business or when performing any work for or on the behalf of the government. Beginning May 1, 2011, payment requests for all new awards must be submitted electronically through the U. S. Department of the Treasury’s Internet Payment Platform System (IPP).

Payment terms for existing contracts and orders awarded prior to May 1 remain the same. The Contractor must use IPP for contracts and orders awarded May 1 and later, and must use the non- IPP invoicing process for those contracts and orders awarded prior to May 1.

The contractor must submit to the CO and the COR the payroll for the general contractor and any applicable sub-contractors and an updated schedule.

The contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instruction via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3 – 5 business days of the contract award date.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
