Description:

This is a combined synopsis/solicitation for a commercial items prepared in accordance with the format outlined in FAR Subpart 12.6. Streamlined Procedures for Evaluation and Solicitation for Commercial Items,” as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; Quotes are being requested, and a written solicitation document will not be issued.

The National Park Service, East Buying Office has a requirement to Purchase a 26 – 30’ watercraft to be used to maintain offshore resources at Fort Pulaski National Monument. This solicitation is a Request for Quotes (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2022-07.

The associated North American Industrial Classification System (NAICS) code for this procurement is 115310, with a small business size standard of $8,000,000.00.

The contractor must have the Representation and Certifications in SAM.gov, completed and updated prior to award.

The Government contemplates the award of a single Firm-Fixed Price Contract using the best value – Lowest Priced Technically Acceptable (LPTA) source selection procedures. All eligible and responsible sources may submit a quote, which if timely received, shall be considered by the Agency. Companies must have valid Unique Entity Identifier (UEI) number and be registered with System for Award Management (www.sam.gov). SAM.gov offers free services. An offeror must ensure that they are self-certified under NAICS Code 115310 in the Representations and Certifications portion of SAM.gov. The basis of award is the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award will be made to the responsible respondent pursuant to FAR subpart 9.1.

(EAST) MAJOR ACQUISITION BUYING OFFICE

The U.S. Department of the Interior, National Park Service, Kennesaw Mountain National Battlefield Park, located in Kennesaw, GA, has a requirement to remove hazardous trees throughout the park caused by Pine Beetle Infestation (CCC Fire Road Area).

Statement of Services

1. Project Site:

Kennesaw Mountain National Battlefield Park 905 Kennesaw Mountain Drive, Kennesaw, GA, 30152.

2. Background:

Kennesaw Mountain National Battlefield Park preserves a Civil War battlefield of the Atlanta Campaign. The battle was fought here from June 18, 1864, until July 2, 1864. There are 4 battlefield areas at the park: The Kolb farm area, Visitor Center including the top of Kennesaw Mountain, off Burnt Hickory Road and the main site is located at Cheatham Hill.

The Visitor Center provides introductory information about the park and the battle. While walking some of the 18+ miles of interpretive walking trails you will see historic earthworks, cannon emplacements and various interpretive signs. There are 3 monuments representing states that fought here. Kennesaw Mountain is 1808 feet above sea level. It is approximately a 700-foot incline from the Visitor Center to the mountain's summit. The hike up is approximately 1.4 miles on the road and 1.2 mile up the trail. Kennesaw Mountain National Battlefield Park was authorized for protection by the War Department in 1917 and was transferred to the Department of the Interior as a unit of the National Park System in 1933.

The 2992+- acre park includes the site of some of the heaviest fighting of the Atlanta Campaign. The park was set aside as an important cultural property dedicated to public inspiration and interpretation of the significant historic events that occurred here.

3. General Statement of Work:

The purpose of this Statement of Work is to establish a contract for the removal of hazardous and potentially hazardous trees and limbs caused by pine beetle infestation at the north end of Kennesaw Mountain Nation Battlefield Park surrounding the Visitor Center grounds around the Brumby trail and ccc fire road area., approximately 2.5-mile radius and covers nearly 20 acres of dead pine trees. The work will be ordered, as needed by the National Park Service (NPS), work needs to be completed by Sept. 30, 2022. Trees will range from 10 inches to 37+ inches in diameter and up to 100+ feet high. Trees will need to be cut down and debris chipped and/or moved from park boundaries, roads, parking lots and trails as order by the NPS. Tree stumps shall be cut at ground level. Of concern in these cutting operations is the protection of the historic earthworks. These earthen fortifications date back to the battle here and are a major resource to be protected within the park boundaries. These earthworks are particularly vulnerable to damage by the operation of both the tracked and wheeled vehicles which are often used in timbering operations. It is essential and mandatory that the contractor meet with the COTR and representatives of the park’s interpretive staff before operations begin in any new area, so they can be shown what these earthworks look like and discuss how best to protect them.

Any large, mature oak trees will be handled with separate compliance.

Park employees along with tree arborist have determined around 350/400 Pine trees in a 20 acres area will need to be fallen and chip. A total of about 300+- trees will need to be removed. This contract will last two months. Contractor will start work August 2022 and finish September 30, 2022.

4. Work Descriptions:

Tree Removal: Removed trees and debris shall be fallen safely to prevent injury of workers and/or visitors using the adjacent areas. When ordered by the NPS, tree debris and limbs will be chipped and hauled to a NPS approved area for disposal. When chipping is not ordered by the NPS, the contractor will spread tree debris and limbs evenly across the area of disposal.

The contractor may harvest large trees and limbs that they actively remove. Salvaged wood, should the contractor choose to re-utilize the material, will be removed immediately after felling, chipping, and bucking of individual trees. Removed/harvested trees are the property of the contractor.

Trail Trimming: Temporary trail closures of one hour or less are permissible for public safety reasons. Closures longer than one hour must be scheduled and approved by the NPS prior to closure and the commencement of the work.

Special care must be taken to prevent damage to the surrounding area or adjacent trees, brush and other vegetation. The contractor will post appropriate warning signs indicating the removal process is underway.

Limb Trimming: The contractor may be required to trim the area prism of large limbs and other overhead (or horizontal) obstacles that could prevent the safe use of those roads, parking lots, trails, or adjacent public use areas. The area prism also includes horizontal limbs or obstructions that protrude into the vertical plane from the trail tread sides, roads, parking lots or adjacent public use areas.

Climbing of trees may be required to accomplish some trimming work.

Desired Results: With the completion of the tree and limb removal project at Kennesaw Mountain National Battlefield Park, trees, and limbs order by the NPS shall be removed and/or chipped and spread in the area of disturbance and the worksites will show little indication of that removal. Stumps ultimately shall be cut at ground level. Park boundaries, roads, parking lots and trails will be free of hazardous trees that may interfere with safe use of those areas.

5. Certified Arborist:

Contractor must be a Certified Arborist ISA (International Society of Arboriculture) or equivalent

Contractor must be trained and knowledgeable in all aspects of arboriculture. Contractor must show three or more years of full-time, eligible, practical work experience in arboriculture.

6. Certified Arborist Bidding:

Because of the complexity of the project, it may be necessary for bidders to visit worksite.

Services Include: Felling trees and limbing dropped trees in place enough to ensure direct soil contact with fallen tree.

Type B Tree Removal Services Include: Felling trees, limbing dropped trees, moving all tree debris into the park 60 feet away from all park boundaries, roads, and trails to keep fire breaks open. Cut and spreading debris ensure direct soil contact.

This is a major vehicle traffic area and contractor shall provide additional traffic flaggers and other traffic control measures and must be always in place and functional during the tree removal operations.

7 :HAULING RESTRICTIONS:

When hauling on National Park Service roads, do not exceed the following load restrictions:

3 axles 57,000 4 axles 62,000 4 or more axles 66,000 Where the ground is saturated with water or during periods of freezing and thawing, the Contracting Officer may impose further load restrictions or suspend hauling.

7.1 Haul vehicles shall turn around only at intersections and parking areas, not on the park Road.

7.2 Operate loaded vehicles hauling material at speeds not exceeding the posted speed limit and spaced at 500-foot minimum intervals. On bridges, speeds shall not exceed 25 MPH and not more than one loaded hauling vehicle will be allowed on any bridge at one time. Hauling of materials, supplies, and equipment over the park road, other than within the limits of the project, will not be permitted without prior approval of the Contracting Officer. Load restrictions on park roads are identical to the state load restrictions with such additional regulations as may be imposed by the Contracting Officer.

8 : EQUIPMENT

Equipment that is leaking any type fluids shall be repaired immediately or removed from the park.

Equipment deemed unsafe by the NPS will be repaired immediately or removed from the park.

9 : INSPECTION – CONTROL OF WORK

Contractor working hours shall take place Monday through Friday, not before 7:00 AM and no after 6:00 PM. The contractor may work other hours only with submission of a written request and subsequent permission of the Contracting Officer. Work on weekends or on Federal Holidays and at night may be performed only with submission of a written request and subsequent permission of the Contracting Officer. All work shall be scheduled by the NPS, five (5) workdays or more notice will be given by the NPS.

10 : PROTECTION AND RESTORATION OF PROPERTY

The contractor shall be responsible for the preservation from injury or damage, resulting directly or indirectly from the execution of the work, of all public and private property along and adjacent to the park. Contractor shall use every precaution necessary to prevent damage to historic earthworks, pipes, conduits, and other underground structures; also, all overhead structures such as wires, cables, etc.; and poles, trees, shrubbery, and crops, within or outside of the project area. Any damage by the contractor or his employee shall be repaired at once at the contractor expense. The contractor will stop work immediately as directed by the COR if there is a suspicion of potentially undocumented cultural and natural resources. In such cased the NPS would require review and documentation of such resources.

11 : SAFETY

The contractor must always keep the entrance roads and parking lots open for public use during removal activities. Contractor shall provide all traffic flaggers and other traffic control measures and must be always in place and functional during the tree removal and trimming in public areas, roads, trails, and parking lots. Special care must be taken to prevent impacting the surrounding areas and facilities. The contractor will post appropriate warning signs indicating periods of tree removal and trimming work. The successful contractor shall use best management practices for tree removal and trimming, following all NPS, State, County and OSHA regulations pertaining to tree removal and trimming.

Employees utilizing chain saw equipment shall wear approved safety equipment to include chaps, hard hat, eyes and hearing protection. All equipment shall be in good and safe working condition. Contractor shall inspect all equipment at the start of the workday. Contractor shall start each day with a safety briefing/meeting with all contractors and NPS staff on the work site.

12 : PROJECT CLOSE OUT

The project period of performance is for 12 months except for more days allowed for bad weather. When the contractor cannot work because of bad weather, the contractor must contact the COR in writing and provide the explanation and request additional days for inclement weather circumstances.

The FOB point will be Destination. “FOB Destination” means that all costs for transportation or freight from the shipping point shall be paid by the contractor and included as a separate line item. The total price should include all shipping cost.

Simplified Acquisition evaluation procedures pursuant to FAR Part 13, will be applied in the evaluation of quotes received. Failure to submit the information called for in this solicitation may render the quote unacceptable. Only those quotes deemed responsive will be evaluated. The Government will award a single firm-fixed price services contract resulting from this solicitation to the responsible Quoter whose quote conforms to the solicitation requirements and is determined to be the “Best Value”; that is, the lowest priced, technically acceptable quote. Technical acceptability must meet or exceed the standards set for non-price factors. The government will evaluate information based on the following evaluation criteria:

Technical and Past Performance when combined, are approximately equal to cost or price.

Technical Approach: Respondent shall describe a realistic plan, to include the means (labor, equipment, and materials) and methods (plan of work), logical sequencing of activities (including interdependencies of activities), and schedule, necessary to successfully complete the work within the required performance period. The plan shall list the specific equipment availability, safety plan, crew(s) (size and composition) proposed to work concurrently, any other available resources, and daily production rate required in accordance with the attached Statement of Work (SOW). A rating of either “Acceptable” or “Unacceptable” will be assigned to this non-price factor. The standard for this factor is met and is acceptable when the responses provided by the Quoter can support a complete understanding of the work to be performed, potential obstacles and mitigation, and the specific requirements that are to be met to successfully complete the contract within the time required. Technical factor shall evaluated on an acceptable and unacceptable basis (See table below).

TECHNICAL CAPABILITY RATINGS:

Past Performance: Respondent shall complete Past Performance Questionnaire(s) that can confirm your company has successfully completed relevant services in the past five years as outlined in the Statement of Work. Offeror shall submit past performance information on three (3) projects of similar scope and magnitude. Past Performance must reflect work that was completed within three (3) years of the solicitation closing date. Past performance information must consist of final performance evaluations of project(s) or project references who can provide performance assessments. References shall consist of officials from the issuing contracting agency who oversaw the performance of the project. The Government reserves the right to obtain past performance information from other sources such as the references and the Contractor Performance Assessment Reporting System (CPARS) and other Federal

Reasonableness will be determined considering other competitive prices received and comparison to the independent Government estimate. If multiple contract line items are included in the price schedule, prices will also be evaluated to determine whether any line items are unbalanced. Offerors are cautioned to distribute costs appropriately. The price submission will be evaluated but not rated.

52.219-1 -- Small Business Program Representations.

As prescribed in 19.309(a)(1), insert the following provision:

Small Business Program Representations (Sep 2021)

(a) Definitions. As used in this provision--

“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business concern eligible under the WOSB Program.

“Service-disabled veteran-owned small business concern”--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) “Service-disabled veteran” means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and the size standard in paragraph (b) of this provision.

“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States, and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13 CFR 124.106) by individuals who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

“Veteran-owned small business concern” means a small business concern--

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

“Women-owned small business concern” means a small business concern--

(1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and

(2) Whose management and daily business operations are controlled by one or more women.

“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127),” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.

Notice of Total Small Business Set-Aside (Nov 2020)

(a) Definition. “Small business concern,” as used in this clause, means a concern, including its affiliates that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the size standards in this solicitation.

(b) Applicability. This clause applies only to--

(1) Contracts that have been totally set aside or reserved for small business concerns; and

(2) Orders set aside for small business concerns under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F). *

(c) General.

(1) Offers are solicited only from small business concerns. Offers received from concerns that are not small business concerns shall be considered nonresponsive and will be rejected.

(2) Any award resulting from this solicitation will be made to a small business concern.

(d) Agreement. A small business concern submitting an offer in its own name shall furnish, in performing the contract, only end items manufactured or produced by small business concerns in the United States or its outlying areas. If this procurement is processed under simplified acquisition procedures and the total amount of this contract does not exceed $25,000, a small business concern may furnish the product of any domestic firm. (a) Definitions. As used in this contract--

"HUBZone small business concern" means a small business concern, certified by the Small Business Administration that appears on the List of Qualified HUBZone Small Business Concerns maintained by the Small Business Administration.

“Service-disabled veteran-owned small business concern”—

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) “Service-disabled veteran” means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

(1) That is at least 51 percent owned by one or more women, or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and

(2) Whose management and daily business operations are controlled by one or more women.

(b) It is the policy of the United States that small business concerns, veteran-owned small business concerns, service-disabled veteran-owned small business concerns, HUBZone small business concerns, small disadvantaged business concerns, and women-owned small business concerns shall have the maximum practicable opportunity to participate in performing contracts let by any Federal agency, including contracts and subcontracts for subsystems, assemblies, components, and related services for major systems. It is further the policy of the United States that its prime contractors establish procedures to ensure the timely payment of amounts due pursuant to the terms of their subcontracts with small business concerns, veteran-owned small business concerns, service-disabled veteran-owned small business concerns, HUBZone small business concerns, small disadvantaged business concerns, and women-owned small business concerns.

(c) The Contractor hereby agrees to carry out this policy in the awarding of subcontracts to the fullest extent consistent with efficient contract performance. (1) The Contractor may accept a subcontractor’s written representations of its size and socioeconomic status as a small business, small disadvantaged, business, veteran-owned small business, service-disabled veteran-owned small business, or a women-owned small business if the subcontractor represents that the size and socioeconomic status representations with its offer are current, accurate, and complete as of the date of the offer for the subcontract.

(2) The Contractor may accept a subcontractor's representations of its size and socioeconomic status as a small business, small disadvantaged business, veteran-owned small business, service-disabled veteran-owned small business, or a women-owned small business in the System for Award Management (SAM) if--

(i) The subcontractor is registered in SAM; and

(ii) The subcontractor represents that the size and socioeconomic status representations made in SAM are current, accurate and complete as of the date of the offer for the subcontract.

(3) The Contractor may not require the use of SAM for the purposes of representing size or socioeconomic status in connection with a subcontract.

(4) In accordance with 13 CFR 121.411, 124.1015, 125.29, 126.900, and 127.700, a contractor acting in good faith is not liable for misrepresentations made by its subcontractors regarding the subcontractor's size or socioeconomic status.

(5) The Contractor shall confirm that a subcontractor representing itself as a HUBZone small business concern is certified by SBA as a HUBZone small business concern by accessing the System for Award Management or by contacting the SBA. Options for contacting the SBA include—

52.232-19 Availability of Funds for the Next Fiscal Year (APR 1984)

Funds are not presently available for performance under this contract beyond June 30, 2020. The Government's obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise for performance under this contract beyond June 30, 2020, until funds are made available to the Contracting Officer for performance and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer.

52.237-2 Protection of Government Buildings, Equipment, and Vegetation (APR 1984)

The Contractor shall use reasonable care to avoid damaging existing buildings, equipment, and vegetation on the Government installation. If the Contractor's failure to use reasonable care causes damage to any of this property, the Contractor shall replace or repair the damage at no expense to the Government as the Contracting Officer directs. If the Contractor fails or refuses to make such repair or replacement, the Contractor shall be liable for the cost, which may be deducted from the contract price.

LOC-DOI ELECTRONIC INVOICING - Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (April 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. (a) Interested parties may request an independent review at a level above the Contracting Officer of protests filed directly with the agency. This review is available as an alternative to consideration of the protest by the Contracting Officer or as an appeal of the Contracting Officer's response to the protest. An interested party may:

(1) Protest to the Contracting Officer;

(2) Protest directly to the Bureau Procurement Chief without first protesting to the Contracting

Officer; or

(3) Appeal a contracting officer’s decision to the Bureau Procurement Chief.
