(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.228-5 Insurance - Work on a Government Installation. (JAN 1997)

(a) The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the schedule or elsewhere in the contract.

(b) Before commencing work under this contract, the Contractor shall notify the Contracting Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government's interest shall not be effective (1) for such period as the laws of the State in which this contract is to be performed prescribe, or (2) until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer.

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

1452.228-70 Liability Insurance (JUL 1996)

(a) The Contractor shall procure and maintain during the term of this contract and any extension thereof liability insurance in form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer. The named insured parties under the policy shall be the Contractor and the United States of America. The amounts of the insurance shall be not less than as follows:

(b) Each policy shall have a certificate evidencing the insurance coverage. The certificate shall identify the contract number, the name and address of the Contracting Officer, as well as the insured, the policy number and a brief description of contract services to be performed.

The contractor shall furnish the Contracting Officer with a copy of an acceptable insurance certificate prior to beginning the work.

DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (April 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury’s Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. SCOPE OF WORK

Assateague Island National Seashore

Purchase of Sand/Clay Mix and Clamshell for Parking Lot Repairs

Purpose:

• This is for the purchase of sand clay mix material and crushed clamshell material to maintain and repair the road and parking areas at Assateague Island National Seashore. Points of delivery will Include:

• The stockpile area for the recreational beach in the Toms Cove area of the Chincoteague Island National Wildlife Refuge in Chincoteague, Virginia. The material will be used to repair parking areas at this location.

• The stockpile area located in the developed area of Assateague Island National Seashore in Berlin, Maryland. The material will be used to repair parking lots and roads at this location.

Description of Purchase:

• The properties of a sand-clay mix to use for road base must compact to be used under a shell surface. The shell must be free of fresh clam body material that will cause a prolonged undesirable odor. The clamshell must also be free of any foreign matter such as processing waste, stones, gravel, etc. The park reserves the right to reject any material that is not suitable for its intended use. The vendor will supply and deliver the material to designated stockpile sites.

• The material must be of a clay and sand mix suitable for a compactable base for roads and parking lots. The material must have the properties to compact to construct a base for roads and parking lots.

• The shell must be clamshell (not oyster shell, mussel shell, etc.) broken into pieces of assorted sizes, but not crushed so fine as to be ground into powder. The shell must be free of fresh clam body material that will cause a prolonged undesirable odor. The clamshell must also be free of any foreign matter such as processing waste, stones, gravel, etc.

• Samples of the sand-clay mix and clamshell material must be provided and approved by the COR prior to acceptance and approval of delivery. The COR reserves the right to reject any subsequent delivery of product that does not meet this specification or is otherwise unsuitable for use. The supplier will be responsible for completely removing from the project site any product that is rejected by the COR. The contractor will have each load approved by a representative of the government.

Seller Responsibilities

• The contractor shall work around the government’s work schedule. Monday to Friday 6:30 am to 2:30 pm EST.

• No deliveries will be allowed on weekends or holidays due to heavy visitation.

• The contractor shall supply to COR a list of all trucks or vehicles that will be making deliveries of materials the list must contain Model, Year, Tag#, Serial Number, color, body dimensions of area where the material is transported and any additional information requested by

COR..

• The contractor shall allow the government to measure the sizes of body of each truck to confirm measurement.

• The contractor will provide the trucks, equipment, and drivers necessary to deliver material addressed in this scope.

• The contractor shall deliver consistent load sizes for the truck or vehicle as agreed upon with COR.

• The contractor will deliver material to address stated in this scope.

• The contractor will dump each load on site in the area as directed by the government.

• The contractor will operate their vehicle in a safe manner.

• THE CONTRACTOR WILL REQUIRE THEIR DRIVERS TO OBEY ALL SPEED LIMITS, ALL LOCAL LAWS

DICTATING LOAD CAPACITIES, AND DRIVE IN A SAFE DEFENSIVE MANNER AT ALL TIMES.

Responsibilities of Government

• The government will provide suitable area that includes ample space for turnaround and solid base for dumping.

• The government will maintain the stockpile areas and maintain space for delivering.

• The government will maintain stockpile area and keep material pushed up.

• Purchase of four thousand (4000) cubic yards of a clamshell material. The material will be delivered to 8586 Beach Road, Chincoteague, VA.

• Purchase of one thousand five hundred (1500) cubic yards of sand-clay mix. The material will be delivered to 8586 Beach Road, Chincoteague, VA.

• Purchase of five hundred (500) cubic yards of a clamshell material. The material will be delivered to 6615 Bayberry Drive, Berlin, MD.

Project Completion Criteria

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The quoter shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".

(d) Representation. The quoter represents that it ___ will, ___ will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.

(e) Disclosures. If the quoter has represented in paragraph (d) of this provision that it "will" provide covered telecommunications equipment or services", the quoter shall provide the following information as part of the quote-

(1) A description of all covered telecommunications equipment and services quoted (include brand; model number, such as original equipment manufacturer (OEM) number, manufacturer part number, or wholesaler number; and item description, as applicable);

(2) Explanation of the proposed use of covered telecommunications equipment and services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b) of this provision;

(3) For services, the entity providing the covered telecommunications services (include entity name, unique entity identifier, and Commercial and Government Entity (CAGE) code, if known); and

(4) For equipment, the entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known).

52.204-26 Covered Telecommunications Equipment or Services-Representation (Oct 2020)

(a) Definitions. As used in this provision, "covered telecommunications equipment or services" and "reasonable inquiry" have the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Procedures. The quoter shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".

(c) (1) Representation. The quoter represents that it □ does, □ does not provide covered telecommunications equipment or services as a part of its quoted products or services to the Government in the performance of any contract, subcontract, or other contractual instrument.

(2) After conducting a reasonable inquiry for purposes of this representation, the quoter represents that it □ does, □ does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services.

52.212-2 Evaluation - Commercial Items. (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:

Factor 1 - Price

1. Price shall be evaluated for price realism and price reasonableness.

2. Price reasonableness and price realism will be determined considering other competitive prices received and comparison to the Independent Government Estimate.

(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful quote within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote's specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
